Danish term or phrase: hans Tiltale bør frie at være
From the court records of Helsingør: "Politierettens Dom af 16 November 1790 frafaldes, og bør ikke komme Appellanterne til Fornærmelse eller Penges Udgift i nogen Maade, hvorimod de for Oldermanden Reier Thorsen Lund, paa Laugets Vegne, hans Tiltale bør frie at være. Processens Omkostninger ophæves."

I understand that the the judgment of Nov. 16, 1790 was set aside and the appellants did not have to pay the fines that had been imposed upon them, but I'm unclear as to what happened to the head of the ferryman's guild, Reier Thorsen Lund: "hans Tiltale bør frie at være." The costs of the proceedings were waived.

English translation:his > Bill of > Indictment ought to be dismissed
Explanation:
If it's a case-dismissal and fines-cancellation scenario and the case has been AmE: nollr prosequied, then the prosecution against the Head of the Ferrymen's Guild is dismissed.

Otherwise, if the case had been AmE: 'nolle prosequied', the charges remain on file and prosecution can still resume at a later date.

Processens Omkostninger ophæves. > each side to bear their own trial costs.

I can't explain the Danish syntax - frie as fem. agrees with Tiltale?, but surmise that this is the gist of the idea.
