Je pense que "confused and mistaken" est une expression figée, utilisée pour exprimer qu'un témoin a dit quelque chose de faux sans l'accuser de faux témoignage ou de parjure délibéré.
"Faire erreur" me semble relever du même registre de langue que le texte-source.
