"XXX beschikte over een appreciatiebevoegdheid bij het opleggen van de betwiste boete".

Volgens mij betekent het dat XXX mocht kiezen of ze de boete opleggen of niet maar ik weet geen term in het Engels. Alvast bedankt voor suggesties.

For "boete", it could be "fine" or "penalty"... take your pick based on the context
