There are two basic scenarios: (i) either the public prosecutor has declined/failed to prosecute, in which case the victim can force their hand and trigger a public prosecution by filing a complaint and an application for damages as a civil party – that’s called “constitution de partie civile *par voie d’action*”; or (ii) the prosecution has already been set in motion, in which case the victim can apply to the court to join the proceedings as a civil party seeking damages – that’s called “constitution de partie civile *par voie d’intervention*”.
