actieve/geldige bevoegdheid Explanation: I.p.v. licentie zou je bevoegdheid kunnen gebruiken. Aufrecht betekent in deze context inderdaad zoiets als: geldig, bestaand, actief. In het Nederlands recht kent men ook begrippen als: slapende bevoegdheid, wakende bevoegdheid en passieve bevoegdheid. Een slapende bevoegdheid is (in Nederland, in bijv. het onderwijs) een bevoegdheid die je automatisch krijgt toegewezen en die je vervolgens niet gebruikt.
