German term or phrase: im [Kaufvertrag]
Hi,

This is from a Technical Due Diligence.

DE:

EN:
Assessing the planning status and the building specification in regard to the basic suitability to guarantee the construction/services owed ***as defined in***/***in accordance with*** the sales contract

Does it really mean that or could it possibly mean "***Comparing the current project status with the sales contract*** in order to assess the planning status and the building specification in regard to the basic suitability to guarantee the construction/services owed"?

Thanks,

Sebastian Witte

What I was trying to say was that there does not seem to be a finalised purchase agreement yet at this TDD stage, which is why it would be inappropriate to say "as described in the p. a.", "(as) set forth in the p. a." or "in accordance with the p. a.", as suggested by previous answerers.

-> I am happy to leave "set forth" out. But there were bigger issues with that sentence.

agree  philgoddard: Or sale. Whether it's been drafted yet is not relevant.

neutral  philgoddard: I think this is overtranslation - we don't know this, and it's not what the German says.

-> I disagree with the notion of overtranslation because the context obviously points to a pre-contract(ual) due diligence exercise. See also Björn's notes in the discussion box.

agree  Steve Robbie: But "... are fully reflected in the purchase agreement" is enough. No need to say "wording" or "yet to be finalised" explicitly.

-> True. On second thought, the last part was meant to be explanatory only.

the sales contract/purchase agreement

Explanation:

=>
Assessment/Evaluation of the planning state and the specifications regarding the basic aptness/fitness/eligibility to warrant/protect/enhedge the target output owed ***according to/in line with*** the sales contract/purchase agreement.

Hello Johannes

As I was basically agreeing with you regarding "de-energized," would you be so kind as to change "status" to "state"? I wanted to ask before you posted a glossary entry, but I forgot.
Status sounds wrong to my ears. State is much more common and can easily be confirmed by pulling up several ENS pages. One of those I posted below.
Thank you.

Im Kontext muss es richtigerweise "verify/determine the de-energized state" lauten.

I have modify my proposal for the whole phrase as we have no "sales contract", but a purchase agreement"

Assessment/Evaluation of the planning state and the specifications regarding the basic aptness/fitness/eligibility to warrant/protect/enhedge the target output owed ***according to/in line with*** the purchase agreement.

-> Hier irrt der Verfasser leider, siehe Merriam-Webster u.a.m. Die Nachweise habe ich meinem Vorschlag angehängt.
