können Sie mir bitte helfen, die Feinsinnigkeit zwischen den zwei benannten Ausdrucken zu verstehen?

In einem Kommentar zu einer BGH-Entscheidung steht Folgendes:

"3. Handelt es sich bei der Modifikation um eine für den Fachmann SELBSVERSTÄNDLICHE ABWEICHUNG? Das wird im Zweifel auch nicht problematisch sein.

4. Handelt es sich um eine MODIFIKATION, die für den Fachmann NAHELAG? Wenn allerdings eine MODIFIKATION vorliegt, die für den Fachmann NAHELAG und die NICHT SELBSTVERSTÄNDLICH war - dieses Szenario hat der BGH offen gelassen. Musste hier nicht entschieden werden."

In beiden Fällen könnte es sich im Französischen um 'évidence' handeln. Doch muss es ja in dem genauen Kontext einen Unterschied geben, oder?

Was würden Sie bitte dazu als gutes deutsch-franzözisches Wörterbuch im Bereich Recht/Jura vorschlagen?

Explanation:
Pour moi, "selbstverständlich sein", c'est effectivement "relever de l'évidence", avec un "niveau d'évidence" un peu plus élevé que "nahe liegend", où l'on a plus une idée de cheminement logique, d'où ma proposition :-)

Explanation:
Dans les conclusions en allemand ci-dessous, « selbstverständliche Abweichung » est traduit par « modification raisonnable » ; selon le contexte, dans les documents UE, « naheliegend » traduit un caractère raisonnable, évident ou équivalent. On pourrait comprendre que dans cet exemple, on oppose le caractère équivalent mais non raisonnable d’une modification (problème qui n’aurait pas été traité par la BGH).
