Source text - Spanish MARCAS, REGLAS PARA DETERMINAR SUS SEMEJANZAS EN GRADO DE CONFUSION, CUANDO LOS PRODUCTOS O SERVICIOS SON DE LA MISMA CLASIFICACION.
La marca es todo signo que se utiliza para distinguir un producto o servicio de otros. En la actualidad, vivimos en una sociedad consumista, en donde las empresas buscan incrementar su clientela poniendo a disposición de la población o una mayor cantidad y variedad de artículos para su consumo, con la única finalidad de aumentar la producción de sus productos y, por ende, sus ganancias económicas. El incremento en el número y variedad de bienes que genera el aparato productor, fortalece la presencia de las marcas en el mercado, porque ellas constituyen el único instrumento que tiene a su disposición el consumidor para identificarlos y poder seleccionar el de su preferencia. Ahora bien los industriales, comerciantes o prestadores de servicios podrán usar una marca en la industria, en el comercio o en los servicios que presten; empero, el derecho a su uso exclusivo se obtiene mediante su registro ante la autoridad competente, según así lo establece el artículo 87 de la Ley de Fomento y Protección de la Propiedad Industrial, además en este ordenamiento legal en sus artículos 89 y 90, se indican las hipótesis para poder constituir una marca, así como los supuestos que pueden originar el no registro de la misma. Uno de los objetivos de la invocada ley secundaria, es el de evitar la coexistencia de marcas confundibles que amparen los mismos productos o servicios, y para ello estableció la siguiente disposición que dice:
"Articulo 90. No se registrarán como marcas: ... XVI. Una marca que sea idéntica o semejante en grado de confusión a otra ya registrada, aplicada a los mismos o similares productos o servicios. Sin embargo, si podrá registrarse una marca que sea idéntica a otra ya registrada, si la solicitud es planteada por el mismo titular, para aplicarla a productos o servicios similares..." Por tanto, cuando se trate de registrar una marca que ampare productos o servicios similares a los que ya existen en el mercado, se deben tener en cuenta que dicha marca que ampare productos o servicios similares a los que ya existen en el mercado, se debe tener en cuenta que dicha marca debe ser distintiva por sí misma, es decir, que debe revestir un carácter de originalidad suficiente para desempeñar el papel que le es asignado por la ley, debiendo ser objetiva o real, con la finalidad de evitar toda posibilidad de confusión con marcas existentes.
Determinar la existencia de la confundibilidad de las marcas o la posibilidad de que ella se dé, no siempre, es tarea fácil; no existe una regla matemática, clara y precisa, de cuya aplicación surja indubitable la confundibilidad de un cotejo marcario. La cuestión se hace más difícil ya que lo que para unos es confundible para otros no lo será. Es más, las mismas marcas provocarán confusión en un cierto contexto y en otro no; sin embargo, la confundibilidad existirá cuando por el parecido de los signos el público consumidor pueda ser llevado a engaño. La confusión puede ser de tres tipos: a) fonética; b) gráfica; y c) conceptual o ideológica. La confusión fonética se da cuando dos palabras vienen a pronunciarse de modo similar. En la práctica este tipo de confusión es frecuente, ya que el público consumidor conserva mejor recuerdo de lo pronunciado que de lo escrito. La confusión gráfica se origina por la identidad o similitud de los signos, sean éstos palabras, frases, dibujos, etiquetas o cualquier otro signo, por su simple observación. Este tipo de confusión obedece a la manera en que se percibe la marca y no se representa, manifiesta o expresa el signo.
Translation - English RULES TO DETERMINE WHETHER MARKS ARE CONFUSINGLY SIMILAR WHEN PRODUCTS OR SERVICES ARE OF THE SAME CLASS.
A mark is any symbol used to distinguish a product or service from other products or services. Nowadays, we live in a consumer society where companies seek to increase their clientele, placing at the disposal of the population a greater amount or wider variety of products for consumption with the only aim of increasing production of their products and, consequently, their profits. The increase in the number and variety of products produced by the manufacturing and service sectors strengthens the presence of marks in the market since they are the only instrument at the disposal of consumers to identify and select their preferred products. Moreover, manufacturers, traders or service providers may use a mark in industry or commerce or in the services provided thereby; yet, the right to the exclusive use of a mark is gained through its registration with the competent authority, as set forth in article 87 of the Law on the Promotion and Protection of Industrial Property. In addition, articles 89 and 90 of such law set forth the guidelines in order to be able to establish a mark and the suppositions that may result in the denial of its registration. One objective of the invoked secondary law is to prevent the coexistence of confusable marks covering the same products or services, for which purpose the following provision was laid down:
"Article 90. The following will not be registered as marks: ... XVI. A mark that is identical or confusingly similar to another already registered mark, applied to the same or similar products or services. However, a mark identical to one previously registered may be registered if the application is made by the same owner for use in connection with similar products or services..." Therefore, when a mark is intended to be registered, covering similar products or services as those already existing in the market, it should be taken into account that said mark covering similar products or services already existing in the market, must be individually distinctive, i.e. it must be sufficiently original to fulfill its role as assigned by law, being duly objective or real, in order to avoid any possibility of confusion with existing marks.
To determine actual or possible confusability of marks is not always an easy task; there is no clear and precise algorithm whose application makes it possible to indisputably determine confusability in a mark comparison. The matter is made even more difficult taking into account that what is confusable to some is not so to others. Moreover, the same marks will lead to confusion in one context and not in another. However, confusability will exist when consumers might be misled by the similarity of the symbols. Confusion can be of three sorts: a) phonetic; b) graphic; and c) conceptual or ideological. Phonetic confusion arises when two words are pronounced similarly. In practice, this sort of confusion is frequent given that consumers have a better memory of pronunciation than the written word. Graphic confusion occurs by the identicalness or similarity of the symbols, whether words, phrases, drawings, labels or any other symbol, upon their mere observation. This sort of confusion depends on the manner in which the mark is perceived and not how the symbol is represented, shown or expressed.

Source text - Spanish Objeto y alcance.
Esta Disposición tiene por objeto el establecimiento del modelo y contenido mínimo del informe definitivo de certificación del cumplimiento de los requisitos establecidos en la vigente normativa por los sistemas técnicos de juego empleados para el desarrollo y explotación de los juegos objeto de la correspondiente licencia general o singular.
El informe definitivo de certificación será emitido por una o varias de las entidades designadas a estos efectos por la Comisión Nacional del Juego y tendrá como objeto la obtención de la homologación de los sistemas técnicos de juego de los operadores.
Deberá presentarse un informe por cada licencia general o singular que hubiera sido otorgada al operador interesado.
El informe definitivo de certificación, cuyo modelo y contenido mínimo se establece en esta Disposición, alcanza a la certificación de los sistemas técnicos de juego de los operadores con licencia general para el desarrollo y explotación de las modalidades de juego a las que se refieren las letras c), e) y f) del artículo 3 de la Ley 13/2011, de 27 de mayo, de regulación del juego, y respecto de los tipos de juego regulados hasta la fecha de publicación de la misma.
La homologación de terminales físicos de carácter accesorio no es objeto de esta Disposición.
Asimismo esta Disposición desarrolla el procedimiento de gestión de cambios a que se refiere el artículo 8.4 del Real Decreto 1613/2011, de 14 de noviembre, por el que se desarrolla la Ley 13/2011, de 27 de mayo, regulación del juego, en lo relativo a los requisitos técnicos de las actividades de juego, complementando a lo ya dispuesto en apartado 4.13 de la Resolución de 16 de noviembre de 2011, de la Dirección General de Ordenación del Juego, por la que se aprueba la disposición por la que se desarrollan las especificaciones técnicas que deben cumplir los sistemas técnicos de juego.
Segundo.
Definiciones.
A los efectos de esta Disposición, los términos que en ella se emplean tendrán el sentido que se establece en el apartado 1.2 de la Disposición por la que se desarrollan las especificaciones técnicas que deben cumplir los sistemas técnicos de juego objeto de licencias otorgadas al amparo de la Ley 13/2011, de 27 de mayo, de regulación del juego, aprobada por Resolución de la Dirección General del Juego de 16 de noviembre de 2011 (BOE de 18 de noviembre de 2011).
Translation - English Purpose and scope.
The purpose of this Provision is to establish the model and minimum content of the final certification report on the compliance with the requirements laid down in the regulations in force for technical gaming systems used for the development and operation of games subject to the corresponding general or specific licence.
The final certification report will be issued by one or more agencies authorised for such purpose by the National Gaming Commission and the objective of such report is to approve operators' technical gaming systems.
A report must be submitted for each general or specific licence granted to the corresponding operator.
The final certification report, whose model and minimum content is established herein, covers the certification of technical gaming systems of operators with a general licence for the development and operation of the varieties of games specified in parts c), e) and f) of article 3 of Law 13/2011 of 27 May on the regulation of gaming and with respect to the types of games regulated up until the publication date thereof.
The approval of supplementary physical terminals is not subject to this Provision.
Likewise, this Provision implements the procedure for the management of changes set forth in article 8.4 of Royal Decree 1613/2011 of 14 November, implementing Law 13/2011 of 27 May on the regulation of gaming, with respect to the technical requirements for gaming activities, complementing the provisions already laid down in section 4.13 of the Resolution of 16 November, 2011 of the Directorate-General of Gaming Regulation, whereby the provision for the development of technical specifications to be complied with by technical gaming systems is approved.
Two.
Definitions.
For the effects of this Provision, the terms used herein will assume the meanings set forth in section 1.2 of the Provision implementing the technical specifications to be complied with by technical gaming systems subject to licences granted in accordance with Law 13/2011 of 27 May on the regulation of gaming, approved by resolution of the Directorate-General of Gaming of 16 November, 2011 (BOE [Official Spanish Gazette] of 18 November, 2011).

Nuestra responsabilidad es expresar una opinión sobre los estados financieros basado en nuestra auditoría. Hemos realizado la auditoría de acuerdo con las normas de auditoría generalmente aceptadas en los Estados Unidos de América. Dichas normas requieren que planifiquemos y realicemos las auditorías para obtener una certeza razonable sobre si los estados financieros están exentos de inexactitudes sustanciales.
Una auditoría comprende el realizar procedimientos para obtener evidencia sobre las cantidades y divulgaciones en los estados financieros. Los procedimientos seleccionados dependen del juicio del auditor, incluyendo la evaluación de riesgos de errores significativos en los estados financieros, debido a fraude o error. Al hacer dicha evaluación de riesgo, el auditor considera el control interno relevante a la preparación y presentación razonable de los estados financieros de la entidad para poder diseñar los procedimientos de auditoría que sean apropiados en las circunstancias, pero no con el propósito de expresar una opinión sobre la efectividad de los controles internos de la entidad. Por consiguiente, no expresamos dicha opinión. En nuestra opinión, los estados financieros del año 2014 mencionados anteriormente, presentan razonablemente, en todos los aspectos significativos, la situación financiera de la Asociación al 30 de junio de 2014 y el resultado de sus operaciones y flujos de efectivo para el año terminado en dicha fecha, de acuerdo con los principios de contabilidad generalmente aceptados en los Estados Unidos de América.
Otros
Los estados financieros de la Asociación al 30 de junio de 2013 y para el año terminado en dicha fecha, fueron auditados por otros auditores externos cuya opinión fechada el 7 de noviembre de 2013, expresa una opinión sin modificar de los estados financieros.

La información adicional incluida en los estados por fondos combinados para los años terminados el 30 de junio de 2014 y 2013 indicados en el índice a los Estados Financieros e incluidos en las páginas 53 a la 69 se presenta con el propósito de proveer información adicional de los estados financieros y no para presentar la situación financiera, los resultados de las operaciones y los flujos de efectivo de las fondos individuales. Translation - English Auditors’ Responsibility
Our responsibility consists of expressing an opinion on the financial statements based on our audit. We have performed the audit in accordance with the United States generally accepted auditing standards. Said standards require that we plan and carry out our audits to obtain a reasonable certainty as to whether the financial statements are free of material misstatements.
An audit consists of carrying out procedures to obtain evidence on the amounts and disclosures in the financial statements. The procedures are selected at the auditor’s discretion, including the risk assessment of significant errors in the financial statements due to fraud or error. Upon carrying out said risk assessment, the auditor takes into account the internal control in the preparation and fair presentation of the entity’s financial statements so as to be able to design appropriate auditing procedures according to the circumstances, but not for the purpose of expressing an opinion on the effectiveness of the entity’s internal controls. We do not therefore express such an opinion. An audit also includes an assessment of the appropriateness of the accounting policies used and the reasonableness of the significant estimates made by management, and the general evaluation of the financial statements.
We believe that the evidence we have obtained is sufficient and appropriate in order to provide our audit opinion.
Opinion
In our opinion, the abovementioned financial statements of 2014 are a fair representation, in all significant aspects, of the Association’s financial situation as of June 30, 2014 and the result of its operations and cash flows for the year ending on said date, in accordance with the United States generally accepted accounting principles.
Others
The Association’s financial statements as of June 30, 2013 and for the year ending on said date, were audited by our external auditors whose opinion, dated November 7, 2013, is provided without changing the financial statements.
Additional Information
The additional information included in the combined funds for the years ending June 30, 2014 and 2013 indicated in the table of contents of the Financial Statements and included on pages 53 to 69, are presented in order to provide additional information on the financial statements and not in order to present the financial position, the results of operations and cash flows of individual funds. We have implemented certain limited procedures, which mainly consist of questions put to the management regarding the measurement methods and presentation of the financial information. However, we do not audit or express an opinion on said financial information.
