For purposes hereof, the term ''Confidential Information'' as applicable to each party shall mean all business and financial information relating to that party, all proprietary information relating to the Product, and any products or processes produced in connection therewith (excluding, however, that portion of such proprietary information incorporated into a published patent), and all inventions, discoveries, methods, plans, techniques, processes, documents, drawings, data, sample, patent applications, trade secrets, know-how, and information of the applicable party that is related thereto; provided, however, that Confidential Information shall not include anything that (i) is or lawfully becomes in the public domain, other than as a result of a breach of an obligation hereunder; (ii) is furnished to the recipient by a third party having a lawful right to do so; or (iii) was known to the recipient at the time of the disclosure.
Disclaimer
Except as specified in this agreement and to the maximum extent permitted by applicable law, the Licensor is not representing nor giving warranties of any kind, expressed, implied, statutory or otherwise relating to, without limitation, validity, title, fitness for a particular purpose, merchantability, non-infringement of third party rights, or arising out of course of conduct or trade custom or usage, all of which are expressly disclaimed.
Disclaimer of Consequential Damages
In no event shall either party be liable to the other for any amounts representing its loss of profits, loss of business, or its indirect, special, exemplary, consequential, or punitive damages, arising from the performance or non-performance of this Agreement, except as expressly provided in this agreement.
Translation - German Vertrauliche Informationen
Für die Zwecke dieser Vereinbarung meint der Begriff “Vertrauliche Informationen”, anwendbar auf die Parteien, sämtliche mit dieser Partei verbundenen geschäftlichen und finanziellen Informationen, sämtliche geschützten Informationen bezüglich des Produktes, sowie jegliche, in Verbindung mit demselben hergestellten Produkte oder Verfahren (mit Ausnahme solcher geschützten Informationen, die in einem veröffentlichten Patent eingetragen sind), sowie sämtliche hiermit verbundenen Erfindungen, Entdeckungen, Methoden, Pläne, Techniken, Verfahren, Dokumente, Zeichnungen, Daten, Muster, Patentanwendungen, Geschäftsgeheimnisse, Know-how und Informationen der entsprechenden Partei; vorausgesetzt, dass vertrauliche Informationen keine Informationen umfassen, die (i) rechtmäßig gemeinfrei sind oder werden, außer als Ergebnis einer Verletzung von Verbindlichkeiten unter dieser Vereinbarung; (ii) dem Empfänger durch eine dritte Partei übermittelt werden, welche ein gesetzmäßiges Recht dazu besitzt; oder (iii) dem Empfänger zum Zeitpunkt der Auskunft bekannt waren.
Ausschlussklausel für Haftung
Mit Ausnahme der Vorgaben in dieser Vereinbarung und soweit gesetzlich zulässig, lehnt der Lizenzgeber jegliche Haftung oder Gewährleistung ab, sowohl ausdrücklich als auch stillschweigend oder gesetzlich, oder anderweitig unbeschränkt in Bezug auf Gültigkeit, Anspruch, Gebrauchstauglichkeit, Marktgängigkeit, Verletzung von Rechten Dritter, oder sich ergebend aus Verhaltensführung oder Handelsbrauch oder Nutzungsform, die sämtlich ausdrücklich abgelehnt werden.
Ausschlussklausel für Folgeschäden
Unter keinen Umständen ist eine Partei der anderen gegenüber haftbar für jegliche Nachteile, die ihr durch Gewinnausfall oder Geschäftsausfall entstehen, oder durcindirekte, spezielle, oder exemplarische Schäden, oder Schäden durch Strafschadensersatz, entspringend aus der Erfüllung oder Nicht-Erfüllung dieser Vereinbarung, außer wie ausdrücklich in dieser Vereinbarung vorgesehen.

Source text - English The contents of the General Specification for Labels shall apply to ALL labels manufactured for XXX group of companies and the conditions stated will form part of the purchase order requirements.
The specification requirements and quality standards detailed in this document shall apply to all label designs and all ancillary processes in the following categories.
All primary label types which are to be affixed to spirits containers, e.g. Front, Back, Neck, Shoulder, Strip Stamp.
1.1 All substrates utilised in the manufacture of conventional or self-adhesive primary labels.
1.2 All labels printed by Gravure, Flexo, Litho, Letterpress or Silk Screen processes.
1.3 All lables utilising ancillary processed such as Bronzing, Varnishing, Embossing, Foil Blocking, Overprinting, Cutting / Punching.

My background is academic (Arts and Science), including a degree in Library and Information Science from the University of Western Ontario, Canada. After finishing my M. A. in Berlin, I spent several years in Canada, where I also gained work experience as a customer service representative.
After my return to Germany I was employed in several office and administrative positions. Among other occupations, I worked with an office service company for several years as an in-house translator and interpreter. In 2003 I acquired the accredited qualification “Translator and Interpreter for the English language” (German IHK - Chamber of Trade and Industry).
Since 2006 I work as a freelance translator and interpreter.
As a sworn translator, I am authorized to provide certified translations.
