Avant de prendre une sanction, autre qu'un avertissement, l'employeur doit convoquer le salarié à un entretien préalable en précisant l'objet, la date, l'heure et le lieu de l'entretien. La convocation rappelle au salarié qu'il peut se faire assister par une personne de son choix appartenant au personnel de l'entreprise. Lors de l'entretien, l'employeur indique les motifs de la sanction envisagée et recueille les explications du salarié. La convocation à l'entretien et la notification de la sanction doivent être faites par lettre recommandée ou remise en main propre contre décharge. La sanction ne peut intervenir moins d'un jour franc, ni plus d'un mois après le jour fixé pour l'entretien. Le salarié est informé par écrit de la nature et des motifs de la sanction prononcée à son égard. "
