Source text - English For a period of twelve (12) months from the date of original delivery to Buyer or to Buyer’s order, but in no event for a period of more than two years from the date of original delivery by Ohmeda Medical to an Ohmeda Medical Authorized Dealer, this Product, other than its expendable parts, is warranted to be free from functional defects in materials and workmanship and to conform to the description of the Product contained in this operation manual and accompanying labels and/or inserts, provided that the same is properly operated under the conditions of normal use, that regular periodic maintenance and service is performed and that replacements and repairs are made in accordance with the instructions provided. This same warranty is made for a period of thirty (30) days with respect to expendable parts. The foregoing warranties shall not apply if the Product has been repaired other than by Ohmeda Medical or in accordance with written instructions provided by Ohmeda Medical, or altered by anyone other than Ohmeda Medical, or if the Product has been subject to abuse, misuse, negligence, or accident.
Ohmeda Medical’s sole and exclusive obligation and Buyer’s sole and exclusive remedy under the above warranties is limited to repairing or replacing, free of charge, at Ohmeda Medical’s option, a Product, which is telephonically reported to the nearest Ohmeda Medical Field Service Support Center and which, if so advised by Ohmeda Medical, is thereafter returned with a statement of the observed deficiency, not later than seven (7) days after the expiration date of the applicable warranty, to the Ohmeda Medical Service and Distribution Center during normal business hours, transportation charges prepaid, and which, upon Ohmeda Medical’s examination, is found not to conform with above warranties. Ohmeda Medical shall not be otherwise liable for any damages including but not limited to incidental damages, consequential damages, or special damages.

7.1 The Consultant shall respect and abide by all laws and regulations in force in the beneficiary country and shall ensure that its personnel, their dependants, and its local employees also respect and abide by all such laws and regulations. The Consultant shall indemnify the Contracting Authority against any claims and proceedings arising from any infringement by the Consultant, its employees and their dependants of such laws and regulations.
7.2 The Consultant shall perform the services under the contract with due care, efficiency and diligence, in accordance with the best professional practice.
7.3 The Consultant shall comply with administrative orders given by the Project Manager. Where the Consultant considers that the requirements of an administrative order go beyond the authority of the Project Manager or of the scope of the contract, it shall, on pain of being time-barred, notify the Project Manager, explaining its opinion, within 30 days after receipt thereof.
Execution of the administrative order shall not be suspended because of this notice.

7.3 Müşavir, Proje Müdürü tarafından verilen idari talimatlara riayet edecektir. Müşavirin bir idari talimatla yerine getirilmesi istenilen koşulların Proje Müdürünün yetkilerinin ötesine geçtiğini veya sözleşme kapsamının dışında kaldığını düşünmesi halinde, zaman kısıtlaması nedeniyle, talimatı aldığı zamandan itibaren 30 gün içerisinde Proje Müdürüne bu konuda ihbarda bulunacak ve düşüncesini açıklayacaktır.
İşbu ihbarın yapılması nedeniyle idari talimatın icrası askıya alınmaz.

Source text - English Turkey is party to most of the International Maritime Organization (IMO) Conventions as well as the Mediterranean and Black Sea Memorandums of Understanding (MOU) on port State control. However, in terms of flag State implementation and port State control, Turkey still does not meet most of the European standards. This is clearly illustrated by the Paris MOU statistics indicating that the detention rate of Turkish flagged ships in foreign ports was 23.4 %, which is very high compared to the EU average of 3 %. One of the main reasons of such a high detention rate is the shortage of institutional capacity of the relevant administrations in Turkey. This brings forth the urgent need of the Turkish maritime administrative system to improve its organisation for better conduct of flag state implementation and port state control procedures at national level.
As concerns national legislation’s compliance with acquis, it should be underlined that accession to IMO Conventions is essential but not a sufficient step if not followed by proper transposition of the relevant pieces of the acquis into the Turkish legislation. Although the EU acquis in this field is based upon the relevant international instruments, it requires better enforcement mechanisms for proper implementation of the international rules. Therefore, Turkey needs to develop and, where required, amend its national legislation in compliance with those EU principles.

Bu durum, Türkiye denizcilik idare sisteminin, ülke çapında bandıra uygulamasını ve liman durumu kontrol prosedürlerini daha iyi yürütmeyi sağlayacak şekilde acilen organizasyon yapısını geliştirmesi ihtiyacını öne çıkarmaktadır.
Ulusal mevzuatın Avrupa Birliği Müktesebatı ile uyumunu ilgilendirmesi nedeniyle, IMO Konvansiyonlarına katılımının gerekli olduğu, ancak müktesebatın ilgili kısımlarının Türk mevzuatına aktarılması için yerterli bir adım olmadığının altı çizilmelidir. Bı konudaki AB müktesebatının ilgili uluslararası uygulamalara dayanmasına rağmen, uluslararası kuralların düzgün biçimde uygulanması için daha iyi yaptırım mekanizmalarına ihtiyaç duyulmaktadır. Dolayısıyla, Türkiye’nin ulusal mevzuatına bu AB ilkelerine uygun şekilde geliştirmesi ve gereken yerlerde değiştirmesi gerekmektedir.
