Seguros Colectivos de Deudores
I.- Resolución 35.308 SSN. Alcances
La Resolución 35.308 de la Súper Intendencia de Seguros de la Nación que regula el seguro de vida al cual son obligados a adherir los tomadores de crédito por préstamos‚ compras en cuotas‚ descubiertos en cuentas o pagos parciales de los saldos de tarjetas de crédito‚ entre otros y que entrará en Vigor desde el 1º de enero de 2011, establece en sus partes de mayor relevancia:
a) El seguro colectivo sólo debe contemplar la cobertura por fallecimiento, con la opción de incorporar la cláusula adicional de invalidez total y permanente. Los clientes son libres de contratar otras coberturas adicionales (por ej. incapacidad parcial‚ desempleo‚ accidentes personales‚ etc.), pero no pueden ser impuestas.
b) Establece que se podrán incorporar cláusulas por enfermedades preexistentes y determina que se entenderá como tal: “Por enfermedad preexistente se entiende a toda enfermedad que padeciera el asegurado, diagnosticada con anterioridad a su incorporación al seguro, y que fuera la causa directa del fallecimiento o incapacidad total o permanente del mismo durante los primeros meses de vigencia del certificado individual. Este plazo no podrá exceder los 12 meses”
c) Determina y detalla cuales serán los riesgos no cubiertos.
d) Agrega requisitos a incluir en los certificados individuales.
e) Deberá preverse la designación de beneficiarios para percibir el excedente, en caso que exista, una vez cancelado el saldo deudor.
f) Los seguros se deben ofrecer sin opción de cláusulas de participación de utilidades, reajuste de primas o similares.
g) La norma prohíbe que el tomador o solicitante de crédito se le cobren “gastos por gestión del seguro” u otros conceptos similares. Si hubiera tales gastos deberán ser pagados por el asegurador directamente. El mandatario o gestor deberá trasladar al asegurado el premio que cobre la aseguradora sin adicionar ningún tipo de gasto o comisión adicional. Asimismo la entidad aseguradora deberá controlar que esto sea así efectivamente y pondrá a disposición de los asegurados, en Internet u otro medio las tarifas correspondientes, para que los asegurados puedan ejercer su derecho a la información y control sobre la tarifa pagada y la efectivamente cobrada por la aseguradora.
h) Todo gasto o comisión que el agente institorio y/lo tomador considere pertinente percibir por su gestión deberá formar parte del honorario que cobre de la aseguradora como tal, no pudiendo trasladar recargo alguno en el débito por el premio de seguro.
i) En ningún caso podrá reunirse en la misma persona la calidad de tomador y/o beneficiario de la póliza y de agente institorio.
j) Toda cobertura adicional a los seguros colectivos de deudores deberá ser ofrecida al asegurado en forma separada y optativamente.
II.- Seguros Colectivos cobrados a usuarios de las tarjetas XXXXXXXX
En primer lugar es necesario detallar los seguros que actualmente la compañía ofrece a sus usuarios como obligatorios, esto es, al momento de contratar cualquiera de sus productos:
Conforme surge del texto de la resolución, solo se debe brindar la cobertura por Seguro de Vida, con la opción de incorporar la cláusula adicional de Invalidez Total y Permanente.
Las demás coberturas deberán ser opcionales:
- Desempleo Involuntario
- Hospitalización
- Invalidez Total y Permanente
- Enfermedades Graves
- Enfermedades Graves con Diagnóstico Terminal
III.- Adecuaciones al Contrato de Tarjeta de Crédito
En este orden de ideas y a fin de adecuarnos a la reglamentación en análisis, se deben realizar las siguientes modificaciones al Contrato de Tarjeta de Crédito:
1) Eliminar la obligatoriedad de todos los seguros mencionados supra, los mismos deberían encontrarse en anexo aparte, con lugar en blanco para que el usuario marque cuales desea contratar.
2) Eliminar el “Costo de administración y gestión de cuenta/ resumen seguro de hospitalización y enfermedades graves y terminales.
3) Eliminar endoso a favor de IC en la medida que entra en contradicción con la Resolución 35.506 SSN donde se prohíbe que el agente institorio (Ic) sea al mismo tiempo el beneficiario. (4.4.)
4) En este punto es dable destacar que, si bien no es un punto que trate esta resolución en cuestión, es necesario que las opciones de Compañías Aseguradoras brindadas a los usuarios no se encuentren vinculadas entre sí, como es el caso de Cardif y El Triunfo.
IV.- Contrato de Agente Institorio
XXXXXXXX y Cardif han celebrado un contrato de agente institorio en fecha 15.11.2007, a través del cual la primera es acreedora de una comisión por los seguros de Cardif que coloca entre sus usuarios.
Al mismo tiempo XXXXXXXX es tomador de la póliza de seguro colectivo en beneficio de sus usuarios.
La norma, en su artículo 4.4 prohíbe expresamente que se reúnan en la misma persona la calidad de tomador y/o beneficiario de la póliza y de agente institorio, resulta éste un punto de suma importancia, por lo que la compañía deberá adecuarse a la misma.
V.- Póliza de Seguro
La póliza deberá modificarse en relación a los siguientes puntos:
- Como se explicó en el punto precedente XXXXXXXX deberá optar entre ser tomador o agente Institorio.
- Deberá preverse la designación de beneficiarios para el saldo en exceso del saldo de deuda (en nuestro caso: “consumo garantizado”).
- Los seguros no podrán ofrecerse con cláusulas de participación de utilidades, reajuste de primas o similares.
Asimismo se deberán incorporar los siguientes requisitos a los certificados individuales, actualmente los mismos no se están entregando, situación ésta que debe modificarse, toda vez que la norma es muy específica a respecto.
1) Personas aseguradas. En caso de ser varios los asegurados bajo la misma tarjeta, deberán figurar todos en el mismo certificado con indicación del porcentaje de su participación en el capital asegurado.
2) Tasa de premio, desagregada por coberturas, gastos, y recargo por agravación del riesgo, éste último de corresponder.
3) Exclusiones por cobertura y enfermedades preexistentes, en caso de corresponder estas últimas.
4) Compañía aseguradora, domicilio y teléfono.
5) Edad máxima de permanencia por cobertura.
VI.- Obligaciones a cargo de la Compañía Aseguradora
La Resolución 35.308, hace nacer en cabeza de la compañía aseguradora en su carácter de mandante, una seria de obligaciones, algunas de ellas se relacionan con las formalidades que deberán seguir frente a esta normativa, otras las cuales se exponen a continuación tienen impacto directo en el negocio de XXXXXXXX:
- Deberá arbitrar todos los medios a fin de controlar que el mandatario o gestor haya cobrado al deudor sólo el premio fijado sin adicionar ningún costo.
- Cardif o la compañía aseguradora de que se trate, deberá publicar en su página Web las tarifas correspondientes al Seguro de Vida Colectivo, y en esta línea, sería deseable que XXXXXXXX en su propio sitio Web tenga un enlace a esa página, para facilitarle a los usuarios su derecho a la información.
Adicionalmente, deberemos ajustar otros puntos de la relación comercial entre XXXXXXXX y la Aseguradora:
- Exigir la entrega de los certificados de cobertura y polizas ya que en el contrato suscripto con Cardif esta la obligación en cabeza de Ic.
- Planes de cobertura aprobados por SSN
VII.- Conclusiones
La resolución 35.308 de la SSN ha venido a definir pautas mínimas y uniformes referentes a la contratación de seguros de vida de saldo deudor, arrojando claridad en algunos puntos que tenía esta práctica, habitual por cierto, en las entidades financieras y emisoras de tarjetas de crédito.
El beneficio para XXXXXXXX debe ser exclusivamente la cobertura del saldo deudor y no la percepción de cargo alguno derivado del seguro mismo.
Es necesario receptar esta normativa a fin de evitar futuras multas, denuncias y acciones judiciales colectivas de asociaciones de Defensa de Consumidores y Usuarios.

Debtors’ Group Life Insurance
I.- Resolution 35.308 SSN. Scopes
National Insurance Superintendence Resolution 35.208, which regulates life insurance to be adhered by holders of credit under the nature of loans, purchases made in quotas, overdrawn accounts o partial payments of credit card balances, amongst others, will enter into force on January 1st 2011, and confirms as follows within its entirety of major relevance:
a) Group insurance should only contemplate coverage upon occurrence of death, with the option of incorporating an additional clause covering total or permanent disability. All clients are free to contract other additional insurance coverage (for example: partial disability, unemployment, personal accidents, etc.), however these are not to be imposed.
b) Establishes possible incorporation of clauses in the event of pre-existent deceases and determines acknowledgement as such: “A pre-existent decease will be understood as any decease suffered by the insured person, diagnosed prior to incorporation in the insurance policy, and is the direct cause of death or of total or permanent disability of the insured person during the first months of validity of the individual certificate. This term will not exceed 12 months.
c) Determines and details which of the risks do not hold coverage.
d) Adds requisites to be included in individual certificates.
e) Appointment of beneficiaries should be established in order to receive surpluses, in the event these exist, once debit balances have been duly cancelled.
f) Insurance policies will be offered without share of profits, premium readjustments or similar option clauses.
g) The norm prohibits a credit holder or applicant from being charged “insurance administration expenses” or other similar concepts. In the event of such expenses, these should be borne directly by the insurance company. The insurance representative or broker will transfer the premium charged by the insurance company over to the insured individual without adding any kind of expense or additional commission. The insurance entity will likewise control this is done and will make available on the Internet or by other means, the corresponding rates so that all insured individuals may exercise their right to information and control of valid rates and what has been charged by the insurance company.
h) All expenses or commissions that a Proxy agent and/or a holder considers pertinent to receive under the concept of administration procedures, should be part of the fee charged by the insurance company as such, without being able to transfer any kind of surcharge in the debit of the insurance premium.
i) At no time will one same person be entitled to hold capacity of an insured person and/or beneficiary of the policy and of a proxy agent.
j) All additional coverage to group insurance debtors will be offered to insured persons separately and in the form of an option.
II.- Group Insurance charged to XXXXXXXX card users
In first place, it is necessary to detail the insurance coverage the company currently offers to users as obligatory, that is, at the time of contracting any of their products.
In accordance with the text arising from the resolution, only coverage for Life Insurance should be granted, with the option of incorporating the Total and Permanent Disability additional clause.
Other insurance coverage should be kept optional:
- Involuntary unemployment
- Hospitalization
- Total and Permanent Disability
- Serious Deceases
- Serious Deceases with Terminal Diagnosis
III.- Credit Card Contract Adaption
Along this line of ideas and in order to adapt to the regulations under analysis, the following modifications should be made to the Credit Card Contract:
1) Eliminate mandatory concepts of all insurance policies mentioned supra, those which should be indicated in a separate annex, with a blank space so that users may mark off those they wish to contract.
2) Eliminate “Cost of account/statement administration and management hospitalization and serious terminal desease insurance”.
3) Eliminate endorsement in favor of IC insofar it enters into contradiction with Resolution 35.506 SSN that prohibits the proxy agent (lC) being at the same time the beneficiary. (4.4)
4) Is would be convenient to emphasize in this point that, even though it is not a point that concerns the resolution in question, all options offered to users and granted by Insurance Companies, will not be associated with each other, as in the case of Cardif and El Triunfo.
IV.- Proxy Agent Contract
XXXXXXXX and Cardif celebrated a proxy agent contract dated 11.15.2007, which establishes that the former is the creditor of a Cardif insurance coverage commission placed on XXXXXXXX users.
Similarly, XXXXXXXX is the holder of a group insurance policy in benefit of its users.
Article 4.4 of the norm expressly prohibits enabling one same person having the capacity of a holder and/or beneficiary of the policy and proxy agent. This point is of utmost importance, reason for which the company must adapt accordingly.
V.- Insurance Policy
The following points in the policy should be modified:
- As explained in the preceding points, XXXXXXXX should opt between being the holder or the Proxy agent.
- Appointment of beneficiaries for the surplus balance arising from the debit balance (in our case: “guaranteed consumption”).
- Insurance policies may not be offered with share of profits, premium readjustments, or similar clauses.
In addition, the following requisites should be incorporated into the individual certificates, which are currently not being delivered, a situation that must be modified as the norm is very specific in this respect.
1) Insured persons. In the event there are various insured persons under the same card, they must all be registered in the came certificate, indicating the percentage of their share on the insured capital.
2) Premium rate, recovered by coverage, expenses and surcharge under the concept of aggravated risk, the latter if applicable.
3) Exclusions under concepts of coverage and pre-existing deceases, the latter if applicable.
4) Insurance company, domicile and telephone number.
5) Maximum age for continued coverage.
VI.- Obligations chargeable to the Insurance Company
Resolution 35.308 creates a series of obligations at the head of an insurance company, in their capacity as representatives, a few of which are related to formalities that must be followed in view of this regulation and others indicated below, which have a direct impact on XXXXXXXX’s business:
- Will arbitrate all means in order to control that the representative or broker has collected only the fixed premium from the debtor, without the addition of any further costs.
- Cardif, or the insurance company in question, will publish the rates corresponding to the Group Life Insurance in their webpage, and along these lines, it would be convenient for XXXXXXXX’s own webpage to have a link to this page, in order to facilitate right of information to users.
Additionally, we must adjust other questions related to the commercial relation between XXXXXXXX and the Insurance Company:
- Demand delivery of certificates of coverage and policies, as in the contract subscribed with Cardif, IC takes the lead of this obligation.
- Insurance coverage plans approved by SSN.
VII.- Conclusions
Resolution 35.308, established by the National Insurance Superintendence, has defined minimum and uniform guidelines concerning contracting of debit balance life insurance, giving clarity to some of the points exercised by this practice, undoubtedly customary, in financial entities and issuers of credit cards.
The benefit for XXXXXXXX must exclusively arise from the debt balance coverage and not from payment obligation of the insurance itself.
Acknowledgement of this norm is necessary in order to avoid future penalties, claims and collective legal action arising from Consumer Protection associations and Users.

Purpose
The purpose of the Personal Protective Equipment Policies is to protect the employees of XXXXXXXXXX from exposure to work place hazards and risk of injury through the use of personal protective equipment (PPE). PPE is not a substitute for more effective control methods and its use will be considered only when other means of protection against hazards are not adequate or feasible. It will be used in conjunction with other controls unless no other means of hazard control exist, and is intended to comply with 29 CFR 1910.132.
Personal protective equipment will be provided, used, and maintained when it has been determined that its use is required to ensure the safety and health of our employees and that such use will lessen the likelihood of occupational injury and/or illness.
This section addresses general PPE requirements, including eye and face, head, foot and leg, hand and arm, body (torso) protection. A separate program exits for respiratory protection as the need for participation in this program is established through industrial hygiene monitoring.

Responsibilities:
Safety and Compliance Officer
The Safety and Compliance Officer is responsible for the development, implementation, and administration of XXXXXX’s PPE policies. This involves:
1. Conducting workplace hazard assessments to determine the presence of hazards which necessitate the use of PPE.
2. Selecting and purchasing PPE.
3. Reviewing, updating, and conducting PPE hazard assessments whenever
• a job changes
• new equipment is introduced
• a supervisor or employee requests it
4. Maintaining records on hazard assessments.
5. Maintaining records on PPE assignments and training.
6. Providing training, guidance, and assistance to supervisors and employees on the proper use, care, and cleaning of approved PPE.
7. Periodically re-evaluating the suitability of previously selected PPE.
8. Reviewing, updating, and evaluating the overall effectiveness of PPE use, training, and policies.
Department Managers/Supervisors
The Department Managers and or Supervisors have primary responsibility for implementing and enforcing PPE use and policies in their work area. This involves:
1. Providing appropriate PPE and making it available to employees.
2. Ensuring that employees are trained on the proper use, care, and cleaning of PPE.
3. Ensuring that PPE training certification and evaluation forms are signed and given to The Safety and Compliance Officer.
4. Ensuring that employees are properly using and maintaining their assigned PPE, and follow PPE policies and rules.
5. Notifying the Safety and Compliance Officer when new hazards are introduced or when processes are added or changed.
6. Ensuring that defective or damaged PPE is immediately replaced.
Employees
The PPE user is responsible for following the requirements of the PPE policies. This involves:
1. Properly wearing the PPE as required.
2. Attending required training sessions.
3. Properly caring for, cleaning, maintaining, and inspecting PPE as necessary.
4. Following XXXXXXXXXXX CGA PPE policies and rules.
5. Informing the supervisor of the need to repair or replace PPE.
Employees who disregard and do not follow PPE policies and rules will be subject to disciplinary action up to and including termination.
Procedures
Hazard Assessment for PPE
The Safety and Compliance Officer, in conjunction with Managers/Supervisors, will conduct a walk-through survey of each area to identify sources of work hazards. Each survey will be documented using the Job Hazard Analysis Form, which identifies the work area surveyed, the person conducting the survey, findings of potential hazards, and the date of the survey. The Safety and Compliance Officer will keep the forms in the Safety and Compliance office.
The Safety and Compliance Officer will conduct, review, and update the hazard assessment for PPE whenever:
• a job changes
• new equipment is introduced
• a supervisor or employee requests it
Selection of PPE
Once the hazards of a workplace have been identified, the Safety and Compliance Officer will determine if the hazards can be first eliminated or reduced by the methods other than PPE, i.e., methods that do not rely on employee behavior, such as engineering controls.
If such methods are not adequate or feasible, then the Safety and Compliance Officer will determine the suitability of the PPE presently available; and as necessary, will select new or additional equipment which ensures a level of protection greater than the minimum required to protect our employees from hazards. Care will be taken to recognize the possibility of multiple and simultaneous exposure to a variety of hazards. Adequate protection against the highest level of each of the hazards will be recommended for purchase.
All personal protective clothing and equipment will be of safe design and construction for the work to be performed and will be maintained in a sanitary and reliable condition. Only those items of protective clothing and equipment that meet NIOSH or ANSI (American National Standards Institute) standards will be procured or accepted for use. Newly purchased PPE must conform to the updated ANSI standards which have been incorporated into the PPE regulations, as follows:
• Eye and Face Protection ANSI Z87.1-1989
• Head Protection ANSI Z89.1-1986
• Foot Protection ANSI Z41.1-1991
• Hearing Protection ANSI S3.19-1974
• Hand Protection (There are no ANSI standards for gloves, however, selection must be based on the performance characteristics of the glove in relation to the tasks to be performed.)
Affected employees whose jobs require the use of PPE will be informed of the PPE selection and will be provided approved PPE by XXXXXXXXXXX CGA.
Training
Any worker required to wear PPE will receive training in the proper use and care of PPE before being allowed to perform work requiring the use of PPE. Periodic retraining will be offered to PPE users as needed. The training will include, but is not limited to, the following subjects:
• When PPE is necessary to be worn
• What PPE is necessary
• How to properly adjust and wear PPE
• The limitations of the PPE
• The proper care, maintenance, useful life, and disposal of the PPE
After the training, the employees will demonstrate that they understand how to use PPE properly, or they will be retrained.
Training of each employee will be documented using the Personal Protective Equipment Training Form and kept on file. The document certifies that the employee has received and understood the required training on the specific PPE he/she will be using.
Retraining
The need for retraining will be indicated when:
• An employee’s work habits or knowledge indicates a lack of the necessary understanding, motivation, and skill required to use the PPE (i.e., uses PPE improperly)
• New equipment is installed
• Change in the workplace make previous training out of date
• Changes in the types of PPE to be used make previous training out of date
Cleaning and Maintenance of PPE
It is important that all PPE be kept clean and properly maintained. Cleaning is particularly important for eye and face protection where dirty fogged lenses could impair vision. Employees must inspect, clean, and maintain their PPE according to the manufacturers’ instructions before and after each use.
Supervisors are responsible for ensuring that users properly maintain their PPE in good condition.
Defective or damaged PPE must be reported immediately to the supervisor.
NOTE: Defective equipment can be worse than no PPE at all. Employees would avoid a hazardous situation if they knew they were not protected; but they would get closer to the hazard if they erroneously believed they were protected, and therefore would be at greater risk.
It is also important to ensure that contaminated PPE which cannot be decontaminated is disposed of in a manner that protects employees from exposure to hazards.
Safety Disciplinary Policy
XXXXXXXXX Association believes in order to maintain a safe and healthful workplace, employees must be cognizant and aware of all company, state, and federal safety and health regulations as they aply to the specific job duties required. Employees who disregard and do not follow PPE policies and rules will be subject to disciplinary procedures up to and including dismissal.

Propósito
El propósito de las Políticas de uso de Equipos de Protección Personal es proteger a los empleados de XXXXXXXXXX ante la exposición a situaciones de riesgo en los sitios de trabajo y riesgos de lesiones, mediante el uso de equipos de protección personal (EPP). Los EPP no son sustitutos para obtener métodos de control más efectivos y solo se considerarán para ocasiones en las cuales otros medios de protección de situaciones de riesgo no son viables ni las adecuadas. Dichos equipos se utilizarán en conjunto con otros métodos, a menos no existan otros medios de control de riesgos, cuyo objetivo consiste en cumplir con las normas 29 CFR 11910.132.
Se proveerán todos los equipos de protección personal, los cuales se utilizarán y se mantendrán en uso al determinar su necesidad para garantizar la seguridad y la salud de nuestros empleados, como así también la disminución de probabilidades de lesiones y/o enfermedades ocupacionales.
La presente sección trata de los requerimientos generales de los EPP, incluyendo protección visual y facial, de cabeza, pies y piernas, manos y brazos y corporal (torso). Existe un programa distinto para la protección respiratoria, ya que la necesidad de participación en dicho programa se establece por medio del monitoreo de sanidad industrial.
Las Políticas del uso de Equipos de Protección Personal de XXXXXXXXX incluyen:
• Las responsabilidades de los supervisores y de los empleados

El Oficial de Seguridad y Cumplimiento queda responsable ante el desarrollo, la implementación y administración de las políticas de XXXXXX CGA. Esto implica:
1. Conducir evaluaciones de riesgos en los sitios de trabajo con el objetivo de determinar la presencia de riesgos que hace necesario el uso de EEP.
2. La selección y adquisición de EPP.
3. Revisar, actualizar y conducir evaluaciones de riesgos de EPP al presentarse:
• cambios de trabajos
• introducciones de equipos nuevos
• ante la solicitud de un supervisor o un empleado
4. Mantener registros de evaluaciones de riesgos.
5. Mantener registros de asignaciones y capacitación sobre EPP.
6. Proveer capacitación, orientación y asistencia a los supervisores y empleados en cuanto al uso, el cuidado y aseo de los EPP aprobados.
7. Reevaluar en forma periódica la aptitud de los EPP previamente seleccionados.
8. Revisar, actualizar y evaluar la efectividad general en cuanto al uso, capacitación y políticas de los EPP.
Gerentes/Supervisores de Departamentos
Los Gerentes y Supervisores de los distintos Departamentos cuentan con responsabilidad primordial ante la implementación y aplicación de los usos y las políticas de los EPP en sus respectivas áreas de trabajo. Esto implica:
1. La provisión de EPP apropiados y la disponibilidad que el empleado tenga a dichos equipos.
2. Garantizar que los empleados cuenten con apropiada capacitación para el uso, cuidado y aseo de los EPP.
3. Garantizar que los formularios de certificación y capacitación estén debidamente firmados y entregados al Oficial de Seguridad y Cumplimiento.
4. Asegurar que los empleados estén utilizando y manteniendo los EEP asignados en forma correcta, y estén cumpliendo con las normas y políticas de los EEP.
5. Notificar al Oficial de Seguridad y Cumplimiento ante nuevos riesgos, o al agregar o cambiar algún proceso de seguridad.
6. Garantizar la sustitución inmediata de EEP dañados o defectuosos.
Empleados
El usuario de los EPP es responsable ante el cumplimiento de los requerimientos de las políticas de los EPP. Esto implica:
1. El uso adecuado de los EPP, según respectiva necesidad.
2. Asistir a las sesiones de capacitación necesarias.
3. El cuidado, aseo y mantenimiento EPP, como así también los procedimientos necesarios de inspección.
4. Cumplir con las políticas y normas de los EPP de XXXXXXXXXXX CGA.
5. Informar al supervisor acerca de la necesidad de reparar o sustituir los EEP.
Aquellos empleados que ignoren y no cumplan con las políticas y las normas de los EPP quedarán sujetos a sanciones disciplinarias, hasta e incluyendo despido laboral.
Procedimientos
Evaluación de Riesgos ante el uso de EPP
El Oficial de Seguridad y Cumplimiento, junto con los Gerentes y Supervisores, conducirá un recorrido de reconocimiento en cada área con el objetivo de identificar las fuentes de riesgos laborales. Se documentará cada estudio mediante el Formulario de Análisis de Evaluación de Riesgos, el cual identifica el área de trabajo estudiado, la persona conduciendo el reconocimiento, hallazgos de riesgos potenciales y la fecha en la cual se llevó a cabo dicho reconocimiento. El Oficial de Seguridad y Cumplimiento archivará los formularios en la oficina de Cumplimiento de Seguridad.
El Oficial de Seguridad y Cumplimiento conducirá, revisará y actualizará las evaluaciones de riesgos para los EPP ante:
• un cambio en alguna tarea laboral
• la introducción de nuevos equipos
• la solicitud por parte de un supervisor o un empleado
Selección de EPP
Al identificar los riesgos potenciales dentro de un área de trabajo, el Oficial de Seguridad y Cumplimiento determinará si dichos riesgos pueden ser eliminados o reducidos mediante el uso de métodos que no impliquen el uso de EPP, o sea, aquellos métodos que no dependan de la conducta de los empleados, como por ejemplo, los controles de ingeniería.
Si dichos métodos no son adecuados o posibles, el Oficial de Seguridad y Cumplimiento determinará la aptitud de los EPP actualmente disponibles, y, según respectiva necesidad, seleccionará equipos nuevos y adicionales que garanticen un nivel de seguridad mayor que el mínimo requerido para proteger a nuestros empleados ante posibles riesgos. Se aplicará sumo cuidado para reconocer la posibilidad de exposiciones múltiples y simultáneas a una variedad de riesgos. Se recomendará la adquisición de equipos de protección que se adecuen al nivel más alto de riesgos.
Para un correcto desempeño de trabajo, toda la vestimenta y los equipos de protección cumplirán con diseños y fabricaciones seguras, y se mantendrán en condiciones apropiadas de sanidad y confiabilidad. Solo se obtendrán o aceptarán para uso aquellos ítems de vestimenta y equipos de protección que cumplan con los estándares Norteamericanos NIOSH o ANSI (American National Standards Institute). Todos los EPP recién adquiridos deberán cumplir con los estándares ANSI actualizados, los cuales se han incorporado a las normas de los EPP, según el siguiente listado:
• Protección visual y facial ANSI Z87.1-1989
• Protección para la cabeza ANSI Z89.1-1986
• Protección de pies ANSI Z41.1-1991
• Protección acústica ANSI S3.19-1974
• Protección de manos (No existen estándares para los guantes, sin embargo la selección debe basarse según las características del trabajo a realizar).
Se le informará a aquellos empleados afectados, cuyas tareas laborales requieren el uso de EEP, acerca de la respectiva selección y se les proveerá EEP aprobados por XXXXXXXXXXX CGA.
Capacitación
Todo empleado que necesite utilizar EPP recibirá capacitación adecuada sobre el uso correcto y el cuidado de dichos EEP antes de permitirlos realizar el trabajo mediante el uso de los EPP. Se ofrecerá recapacitación periódica para aquellos usuarios de EEP, según la necesidad. Dicha capacitación incluirá, sin limitaciones, los siguientes temas:
• Ante la necesidad del uso de EPP en forma de vestimenta
• Los EPP necesarios
• Las formas de adaptar y usar los EPP correctamente.
• Las limitaciones de los EPP
• El uso y mantenimiento correcto, como así también vida útil y eliminación de los EPP
Luego de la capacitación, los empleados demostrarán haber entendido la forma correcta del uso de los EPP, o, a su vez, se los volverá a capacitar.
Se documentará y archivará la capacitación de cada empleado mediante el Formulario de Equipos de Protección Personal. Dicho documento certifica que el/la empleado/a ha recibido y entendido la capacitación requerida en cuanto al uso del EPP específico que utilizará.
Recapacitación
Se indicará una necesidad de recapacitación cuando:
• los hábitos o conocimientos de un empleado indican falta de entendimiento y motivación necesaria, y la aptitud requerida para el uso correcto de los EPP (o sea, utiliza los EPP incorrectamente)
• se instalan nuevos equipos
• los cambios en el lugar de trabajo hagan que la capacitación realizada previamente no esté actualizada
• los cambios en los tipos de EPP a utilizarse hagan que la capacitación realizada previamente no esté actualizada
Aseo y Mantenimiento de los EPP
La correcta limpieza y el mantenimiento de todos los EPP es de suma importancia. El aseo es particularmente importante para todos los equipos faciales y visuales ya que las lentes sucias y nubladas podrán impedir una clara visión. Los empleados deberán inspeccionar, limpiar y mantener sus EPP según las instrucciones del fabricante, antes y luego de cada uso.
Los supervisores quedan responsables ante la garantía de que los usuarios mantengan sus EPP en buenas condiciones.
Todo los EPP se encuentren en condiciones defectuosas o dañadas deberán reportarse al supervisor de inmediato.
NOTA: El uso de equipos defectuosos puede presentar resultados que sean peor que la falta de EPP. El empleado evitaría una situación de riesgo al saber que no cuenta con protección; sin embargo se acercaría aún más al riesgo de creer erróneamente que cuenta con protección, de modo que quedaría ante un riesgo mayor.
También es importante garantizar que aquellos EPP que no puedan descontaminarse, sean eliminados en forma tal que proteja a los empleados ante exposición a riesgos.
Política de Disciplinas de Seguridad
XXXXXXXXX considera que, con el objetivo de mantener un lugar de trabajo seguro y saludable, los empleados deberán tener pleno conocimiento y mantenerse alertos de todas las normas de seguridad de la compañía, del estado y federales, según necesidades de aplicación a las tareas de trabajo.
Aquellos empleados que ignoren y no cumplan con las políticas y las normas de seguridad quedarán sujetos a procedimientos disciplinarios, hasta e incluyendo despido laboral.

• Personal usuario de gases y líquidos inflamables
4. PROCEDIMIENTO
Almacenamiento
Los tubos o cilindros de gases deben ser almacenados en un área segura, seca y bien ventilada, con ingreso de aire en la parte superior e inferior del recinto, protegidos de las variaciones de temperatura y de descargas eléctricas.
Esta área estará totalmente cercada con elementos incombustibles y señalizados con carteles de PROHIBIDO FUMAR y PELIGRO EXPLOSIVO.
El acceso será restringido, permitiéndose únicamente el ingreso de los responsables de las tareas.
Los distintos tipos de gases deben separarse respetando las combinaciones prohibidas; los cilindros que contengan oxígeno no deberán almacenarse a distancias inferiores a los 8m de los que contengan gases inflamables o materiales altamente combustibles, además se deben separar los llenos de los vacíos.
Se debe colocar señalización, indicando el contenido.
Próximo a los cilindros no pueden almacenarse sustancias inflamables tales como fuel-oil, grasas, lubricantes, líquidos volátiles, etc.
Se deben disponer elementos de fijación (cadenas, rejas, etc.) para evitar la caída accidental de los cilindros.
Los recintos para almacenamiento que requieran iluminación, deberán tener instalaciones antiexplosivos.
Al menos cada 45 días el Coordinador de CSMA deberá verificar las condiciones de las instalaciones y debe completar la planilla XXXXXXXX
Manipulación y Transporte
El personal que manipule cilindros de gas comprimido debe estar informado del riesgo existente.
Los proyectos deberán aceptar únicamente los recipientes aprobados por Normas IRAM, o similares.
No quitar, ni cambiar los números o marcas que aparecen estampados en los cilindros.
Los tubos se deben trasladar, siempre protegidos con el capuchón en carros portatubos, sujetos firmemente por medio de cadenas.
Cuando los cilindros de gas comprimido son transportados en vehículos, deben ir asegurados en posición vertical.
Bajo ninguna circunstancia podrán dejarse tubos sueltos o en posición horizontal.
Está prohibido usar los cilindros como rodillos, o para cualquier otro fin que no sea el de contener gas.
Oxígeno (O2) - Propiedades
Riesgos que ocasiona
• La mayoría de los elementos y sobre todo materiales orgánicos como aceites, grasa, papeles, algunos plásticos, etc., se inflaman en presencia del O2 y un iniciador como una chispa o punto caliente.
• Los cuerpos grasos pueden autoinflamarse en contacto con atmósferas sobreoxigenadas.
Procedimientos de seguridad
• Usar solo materiales compatibles con el oxígeno:
• No utilizar: fundición de hierro, aleaciones de titanio, aleaciones de magnesio (M.1, AZ 31), aleaciones de plata de bajo punto de fusión.
• Los circuitos, equipos y demás elementos que han de entrar en contacto con el O2, deben estar perfectamente limpios, especialmente sin grasa o aceite.
• Los tubos deben tener colocada siempre la tapa de protección de la válvula, para lo cual se debe exigir que se los provea con tapas no removibles (tapas "tulipa“), que permiten colocar el reductor con la protección colocada.
• Para detectar fugas de O2, usar solo agua y jabón.
• Jamas utilizar O2 en reemplazo de aire comprimido.
• Nunca engrase válvulas o robinetes afectados al uso con O2, ya que una fuga iniciará un fuego.
• En caso de perdidas de O2, cerrar todas las válvulas de tubos en uso, no fumar, evitar chispas y ventilar prolongadamente el recinto.
• Jamás debe intentarse el trasvasado de oxígeno a otros envases. Sólo el fabricante está habilitado y conoce si un envase receptor es apto para la presión de carga (cuño del fabricante, prueba hidráulica, etc.)
Hidrogeno (H2)
Procedimientos de seguridad
• Mantener bien ventiladas las zonas de uso y de almacenaje.
• Usar solo agua y jabón para detectar fugas.
• Para descargar, abrir lentamente los robinetes, evitando así la compresión adiabática.
• En caso de incendio dejar arder hasta que se termine la carga, enfriando el tubo con agua.
Acetileno (C2H2)
Riesgos que ocasiona
Hay riesgos de explosión en el caso de:
• Fuga de C2H2 en el ambiente.
• Introducción de C2H2 en un recinto lleno de aire.
• Entrada de aire en una canalización de C2H2.
• Retroceso de O2 en un soplete oxiacetilénico.
• Exposición de tubos de acetileno al fuego o a altas temperaturas.
• Efecto narcotizante en altas concentraciones, y asfixia.
Procedimientos de seguridad
Respecto a los materiales
• Usar solo metales aptos para el uso con C2H2:
Al no ser corrosivo, el acetileno puede estar en contacto con la mayoría de los metales de uso corriente, EXCEPTO: mercurio cobre y plata. Debe evitarse el uso de bronce con más de 66 % de cobre y aleaciones conteniendo plata. No utilizar manómetros de mercurio en líneas de acetileno, pues un contacto accidental producirá acetiluros muy inestables.
• No lubricar robinetes, reductores, válvulas.
• Colocar válvulas de no retorno de llama en las proximidades del soplete (lo mismo en la línea de oxígeno)
• Evitar toda fuga de acetileno. Si no se la puede controlar, dejar venteando al tubo en un lugar abierto, alejado de cualquier área de circulación o trabajo.
Respecto al Acetileno
• Jamás flamee un tubo de acetileno para extraer más producto. El riesgo de que se produzca una explosión por descomposición es alto.
• Jamás trate de ubicar fugas por medio de una llama. Use agua jabonosa.
Acciones en caso de incidentes
Fuga de acetileno sin fuego
• Cerrar la salida del gas.
• Apagar toda llama en la zona donde se generó la fuga. Desconectar equipos eléctricos.
• Ventilar todo lo posible. Si no hay forma de hacerlo, sacar el tubo al exterior y dejarlo vaciar.
Fuga con fuego
• Procurar cerrar el robinete del tubo, aproximándose con un matafuego de Monex abierto y dirigido a la llama.
• Si la fuga no puede controlarse, dejar arder enfriando el tubo con un chorro de agua desde una distancia superior a 30m, parapetándose tras una pared u otro elemento sólido similar.
Tubo recalentándose
• Esta es una situación de alto riesgo pues indica que el acetileno disuelto esta en proceso de descomposición y la explosión del tubo puede estar próxima.
La única acción a tomar es tratar de enfriarlo como en el caso anterior, durante 30 minutos, interrumpir por espacio de 5' y observar si se seca la superficie, señal ésta de que sigue el proceso de descomposición. Jamás se debe intentar aproximarse sin hacer la maniobra indicada, la que se repetirá hasta que la superficie permanezca húmeda durante otros 30'. En este caso verificar al tacto que esté frío y proceder a retirarlo del área con sumo cuidado, hasta un lugar alejado y abierto, donde se lo dejará en reposo. Cercar a 30m.
Denunciar el incidente al proveedor o fabricante.
Precauciones a tomar con los envases
• Los tubos de acetileno no están sometidos a una alta presión interior en condiciones normales (aprox. 7 atm.), por lo que el espesor de sus paredes es relativamente delgado en comparación con la de los otros gases. En consecuencia nunca deben bajarse del camión haciéndolos caer al piso.
• La materia porosa interna también es frágil y debe ser protegida de golpes.
• Los tubos de acetileno deben permanecer siempre verticales.
• Jamás deben ser utilizados para iniciar un arco eléctrico.
• Jamás enganchar un soplete encendido a un tubo de acetileno u oxígeno.
• Bajo ninguna circunstancia intentar sacar el robinete.
• No utilizar conexiones no aptas para C2H2. La conexión de salida es de 3/4”, hembra derecha y la junta de fieltro o teflon.
• Jamás calefaccionar la pared o fondo de un tubo de acetileno. Puede iniciar el proceso de descomposición del mismo.
Solvente de uso industrial
En esta sección de la Norma se detallan aquellos solventes de uso industrial, los que por lo general se almacenan en tambores y/ o bidones de seguridad.
Clasificación
C 1- Solventes inflamables: alcohol de quemar/ aguarrás
C 2- Solventes combustibles: kerosene
C 3- Solventes no inflamables/ no combustibles: Clorothene, Percloroetileno
Recipientes
Identificación
Tambores: deben ser identificados con el nombre del producto y la clase (C1- C2 y C3), con letras bien visibles en su pared.
Los tambores en uso deben tener tapa y canilla de autocierre, así como cable de descarga a tierra y cable con pinza para conectar al bidón respectivo.
Bidones de seguridad: los bidones que contengan solventes clase C1 y C2 serán pintados con rayas rojas y blancas verticales, unos 5 cm de ancho.
Deben tener tapón roscado y cadenilla de puesta a tierra durante el vertido.
Los que contengan solventes clase C3 se pintaran de amarillo.
Precauciones para el uso
• Todos los solventes tienen la propiedad potencial de producir dermatitis y lesiones en los ojos, por lo que durante su manipuleo es obligatorio el uso de guantes de goma o neoprene y antiparras.
• Cuando se deba trabajar con solventes durante tiempos prolongados (más de 30’) es obligatorio utilizar protección respiratoria adecuada. En todos los casos la ventilación debe ser buena, y de ser posible trabajar al aire libre.
• Cuando sea posible, trabajar dentro de campana con tiro forzado. En este caso es obligatorio el uso de guantes de goma y anteojos de seguridad.
• No se permite utilizar solventes dentro de áreas en las cuales se trabaja con llama abierta o se puedan generar chispas.
• Antes de trasvasar solvente C1, C2 se debe asegurar que las puestas a tierra estén bien sujetas. Además debe haber un matafuego de CO2 o polvo químico, en el sector.
• Los trapos embebidos con solvente se colocarán en recipientes metálicos con tapa, hasta su disposición final.

AND INFLAMMABLE LIQUIDS
1. OBJECT
Prevent risks during handling, storage and use of gases and inflammable liquids.
2. SCOPE
Applicable to all XXXXXX’s Projects/Services.
3. RESPONSIBLE PARTIES
• Project/Service Manager
• Work-site/Service Leader
• Supervision
• Personnel users of gases and inflammable liquids.
4. PROCEDURE
Storage
All tubes and gas cylinders should be stored in safe, dry and well ventilated areas, accounting for incoming air in the superior and inferior section of the premise, and protected from temperature variations and electric discharges.
This area should remain completely fenced in with non-combustible elements and signalised by means of billboards reading SMOKING IS PROHIBITED and DANGER EXPLOSIVE.
The are is restricted, allowing entrance only to the established responsible parties of the tasks.
The different kinds of gases should be separated, respecting prohibited combinations; all those containing oxygen should not be stored at distances inferior to that of 8m from those that contain inflammable gases or highly combustible material, as well as separating full cylinders from the empty ones.
Signalising should be placed, for the purpose of indicating respective contents.
Inflammable substances, such as fuel-oil, grease, lubricants, volatile liquids, etc., cannot be stored next to the cylinders.
Fixing elements (chains, bar screens, etc.) should be provided, in order to avoid accidental falling of the cylinders.
The storage premises that require illumination should be provided with anti-explosive installations.
The QHSE Co-ordinator should verify conditions of the installations every 45 days, as a minimum, and should complete the Pl.SK.CSMA.18.01 form.
Handling and Transport
All personnel that handle compressed gas cylinders should be informed as to existent risks.
All projects should only accept containers that are approved by the IRAM Norms, or similar.
The numbers or brands that appear marked on the cylinders should not be either removed or changed.
When transporting tubes, these should be protected with their respective caps and in tube holders firmly fixed by means of chains.
When transporting compressed gas cylinders in vehicles, these should be fixed in vertical positions.
Under no circumstance will loose tubes be allowed to be transported either loosely or in horizontal positions.
Use of cylinders as rollers is prohibited, or any other purpose that differs from gas containers.
Oxygen (O2) - Properties
Risks induced
• The majority of the elements, and especially organic materials such as oils, grease, paper, some plastics, etc., ignite when in the presence of O2 and an initiator such as a spark or hot point.
• Greasy bodies can ignite on their own when in contact with over oxygenated atmospheres.
Safety Procedures
• Only use material that is compatible with oxygen:
• The following is not to be used: fused steel, titanium alloys, magnesium alloys, (M.1, AZ 31), low fusing silver alloys.
• All circuits, equipment and other elements that should enter in contact with O2, should be in perfectly clean condition, principally without grease and/or oils.
• All tubes should always account for the protection valve cap firmly fixed, reason for which it should be strictly requested that they be provided with non-removable caps (“tulip” caps), that will allow placing of the valve with the fixed protection.
• Leakage detection should be verified by using only soap and water.
• Never use O2 in replacement of compressed air.
• Never grease used valves or faucets with O2, as any possible leakage will initiate a fire.
• In the case of O2 leakage, close off all valves belonging to tubes that are in use, no smoking, avoid sparks and ventilate the premises for a lengthy period.
• Pouring of oxygen from one container to another should never be attempted. Only the manufacturer is qualified to carry this through, and acknowledges if a receiving container is fit for pressurised loading (manufacturer’s impression mark, hydraulic test, etc.)
Hydrogen (H2)
Safety Procedures
• Maintain areas of use and storage well ventilated.
• Leakage detection should be verified by using only soap and water.
• In order to discharge, open up the faucets very slowly, avoiding any adiabatic compression.
• In the case of a fire, let it burn until the head is finished, cooling the tube with water.
Acetylene (C2H2)
Risks induced
There exist risks of explosion in the following cases:
• Leakage of C2H2 in the premises.
• Allowing insertion of C2H2 in premises that all full of air.
• Entering of air in a C2H2 canalisation.
• Retrocession of O2 in an oxyacetylene blowtorch
• Acetylene tubes exposed to either fire or high temperatures.
• Narcotising effect in high concentrations, and asphyxia.
Safety Procedures
With respect to materials
• Only use metals that apt for use with C2H2:
Not being corrosive, acetylene can be in contact with practically all metals of normal use, EXCEPT FOR: mercury, copper and silver. Use of bronze with over 66% copper, and alloys that contain silver, should be avoided. Mercury manometers should not be used within lines of acetylene, as an accidental contact will produce very unstable acetylide acids
• Faucets, reducers and valves should not be lubricated.
• Place non-return fire valves in the proximity of the blowtorch (as likewise in the line of oxygen).
• Avoid all acetylene leakage. Should it become uncontrollable, leave the tube to air in an open space and at a distance from all circulating or working areas
With respect to Acetylene:
• Never wave a tube carrying acetylene in order to extract more of the product. The risk that it could produce an explosion due to decomposition is high.
• Never attempt to place any leakage by means of using a flame. Use soapy water.
Actions to undertake in the event of accidents:
Acetylene leakage without fire
• Close the gas outlet.
• Suffocate the flames in the area where the leakage was generated. Disconnect electric equipment.
• Ventilate as much as possible. Should there be no way of doing this, take the tube outdoors and leave it to empty.
Leakage in the form of fire
• Attempt closing the tube’s faucet, drawing close with an open Monex fire extinguisher directed towards the flame.
• Should the flame be uncontrollable, leave the tube to burn, place yourself behind a wall, or similar protection element, and cool it down with a water blast at a distance superior to that of 30m.
Reheated tube
• This accounts for a high risk situation, as it indicates that the dissolved acetylene is in a decomposing process, and the tube’s explosion could be near.
The only action to take up is to attempt cooling it down as described in the aforementioned case, during the course of 30 minutes, interrupting for a short length of 5 minutes, and then observing if the surface has become dry, which is a sign that the decomposing procedure is still under way. Drawing near without carrying though the indicated manoeuvre should never be attempted, that which will be repeated until the surface remains humid for a further period of 30 minutes. In this case, verify that it has gone cold by means of touching it, and then proceed to very carefully withdraw it from the area, removing it to a distant open area where it will be left to rest. Fence the area in at 30m.
Report the incident to the supplier or manufacturer.
Precautions to be taken with the containers
• All acetylene tubes are never submitted to high interior pressure under normal conditions (approximately 7atm.), reason for which the width of its walls is relatively thin compared to those of other gases. Consequently, they should never be brought down from a truck by means of making them fall to the ground.
• The internal porous material is also fragile, and should be protected from bumps.
• All acetylene tubes must always remain standing vertically.
• They must never be used to initiate an electric arc.
• Never hitch a turned on blowtorch to an acetylene or oxygen tube.
• Under no circumstances attempt to take away the faucet.
• Connections not apt for C2H2 should not be used. The outlet connection is that of ¾”, female right and the joint of felt or teflon.
• Never heat the wall or base of an acetylene tube. This could lead to initiating its decomposing process.
Solvents of industrial use
This section of the Norm details the solvents of industrial use, those that are generally stored in safety steel drums.
Classification:
C 1- Inflammable solvents: alcohol for burning / turpentine
C 2- Combustion solvents: kerosene
C 3- Non-inflammable/non-combustion Solvents: Clorothene, Perchloroethylene
Containers
Identification
Drums: Should be identified by means of the name of the product and class (C1-C2 and C3), with clear visible letter placed on the sides.
All drums in use should account for a lid and self-closing tap, as likewise cables with discharge and cables with clamps in order to connect to the respective container.
Safety containers: All containers that are supplied with C1 and C2 class solvents will be painted with red and while vertical lines, of approximately 5cm in width.
They should account for a threaded lid and ground connection during the pour.
Those that contain C3 class solvents will be painted yellow.
Precautions for use
• All solvents account for a potential property that produces dermatitis and eye lesions, reason for which the use of rubber or neoprene hand gloves is obligatory while handling these substances.
• When working with solvents for prolonged periods (over 30 minutes), use of adequate respiratory protection is obligatory. Ventilation must be good for all cases, and if possible, undertake working tasks outdoors.
• When possible, work should be undertaken within the hub with forced draft. In this case, use of rubber gloves and safety eye wear is obligatory.
• Use of solvents are not permitted inside areas in which work is carried through by means of open flames, or where fire sparks are generated.
• Prior to pouring the solvent C1 and C2, earth connections should be assured and well placed. Likewise, there should be a CO2, or chemical powder, fire extinguisher in the sector.
• All rags soaked with solvent will be placed in metallic lidded containers, until their final disposal.
