English to Bosnian: Status of Concession Law in BiH
Source text - English Concessions represent one of the particularly suitable forms of engaging private foreign and domestic capital for financing investments in the field of natural resources use or construction of infrastructure facilities and other public resources in general use.
Concession Laws in Bosnia and Herzegovina on both entity and state levels are passed to that end. These Laws are mutualy harmonized and are setting conditions under which local and foreign legal subjects can be granted concessions for providing infrastructure and services, for financing, designing, construction, maintenance and operation, and for infrastructure and related facilites as well as for utilization of natural resources.
Passing of Concession Law of Bosnia and Herzegovina, Concession Law of Federation of Bosnia and Herzegovina and Concession Law of Republic Srpska shows clear commitment towards improvement of the infrastructure development, provision of services and natural resources’ exploitation through financing via granting concessions.
Due to the lack of its own sources of financing, while starting from the basic commitments for ownership transition and development on the market grounds, BiH wishes to encourage privatization processes and direct foreign investments through development of concessions in those sectors that can not be subject of the privatization. Especially having in mind financing schemes of ambitious development programmes and investments into large infrastructure capacities and other public facilities, primarily those who are the basis of more successful inclusion of BiH in current regional and European-economic integration processes.
Translation - Bosnian Davanje koncesija predstavlja jedan od posebno pogodnih oblika angažovanja privatnog stranog i domaćeg kapitala u svrhu finansiranja investicija u oblasti korišćenja prirodnih resursa ili izgradnje infrastrukturnih objekata i drugih javnih dobara u opštoj upotrebi.
U tom cilju doneseni su zakoni o koncesijama u Bosni i Hercegovini, na entitetskim nivoima i na nivou BiH. Zakoni su u međusobnoj usklađenosti i njima se utvrđuju uslovi pod kojima se domaćim i stranim pravnim licima mogu dodjeljivati koncesije za obezbjeđivanje infrastrukture i usluga, finansiranje, projektovanje, izgradnja, održavanje i rukovođenje radom te infrastrukture i za nju vezanih objekata i uređaja, kao i korišćenje prirodnih resursa.
Usvajanjem Zakona o koncesijama Bosne i Hercegovine, Zakona o koncesijama Federacije Bosne i Hercegovine i Zakona o koncesijama Republike Srpske, izraženo je jasno opredjeljenje ka tome da se razvoj infrastrukture, pružanje usluga i eksploatacije prirodnih resursa unaprijedi finansiranjem kroz dodjelu koncesija.
U nedostatku vlastitih izvora finansiranja, a polazeći od osnovnih opredjeljenja za promjenom vlasništva i razvojem na tržišnim osnovama, BiH želi dati podsticaj privatizacijskim procesima i direktnim stranim ulaganjima kroz razvoj koncesija u onim sektorima koji ne mogu biti predmetom privatizacije. Ovo tim prije kada se imaju u vidu finansiranja ambicioznih razvojnih programa i investiranja u krupne infrastrukturne kapacitete i druge javne objekte, posebno one koji čine osnovu uspješnijeg uključivanja BiH u aktuelne regionalne i euro-ekonomske integracione procese.
