Source text - Spanish Una medida cautelar que permite la realización de sorteos de bingo interconectado en el ámbito de la ciudad de Buenos Aires, fue dictada por la justicia. Se trata de una medida de no innovar para la implementación de los premios; “Jackpot” o “Bingo Acumulado Interconectado (BAI)”.
La justicia hizo lugar a un amparo presentado por la empresa Lamartine S.A., propietaria del bingo Belgrano de la ciudad de Buenos Aires, en contra de la resolución 1221 del 29 de septiembre de 2010 dictada por Lotería Nacional.
En ente regulador había dispuesto en 2009 mediante la resolución 12/09 la posibilidad de la implementacion a futuro de la modalidad de premio Jackpot interconectado. Con el mismo espíritu el organismo había dictado la resolución 851/10 y mediante nota había solicitado a los bingos que operan en la ciudad de Buenos AIres una propuesta metodológica para la implementacion de este modelo de juego.
Las empresas reguladas, despues de haber cumplido los pasos antedichos, se encontraron con la resolución que cuestionan judicialmente (1221/10) que no reglamenta definitivamente esta actividad y desanda los pasos antes mencionados.
Por ello, recurrieron a la justicia, logrando la medida cautelar que ahora se da a conocer.
A través de esta resolución el juez federal Pablo G. Cayssials, del Juzgado Nacional de Primera Instancia en lo Contencioso Administrativo Nº 9, odenó la medida en beneficio de la empresa dueña del Bingo Belgrano.
En los considerandos el juez Cayssials, cita las razones esgrimidas por la empresa para el otorgamiento de premios en base a recursos obtenidos por los aportes simultáneos de las cinco salas de bingo que funcionan en la ciudad de Buenos Aires.
Si bien la industria del juego se expandió de manera sostenida en todo el país durante los últimos años, los letrados del bingo Belgrano consideraron que la sala “a pesar del inicial éxito”, - fue habilitada en 1994 -, “con la apertura de nuevos casinos en la Ciudad y la Provincia de Buenos Aires, perdieron mucho de su público”. Con lo cual el bingo, que está habilitado para 1.100 personas, pasó a recibir por día sólo “40 o 50” clientes.
Esta situación generó graves dificultades económicas en las salas de la ciudad que vieron en la implementación del juego denominado Premio Jackpot o Bingo Acumulado Interconectado (BAI), que consiste en la obtención de un premio adicional para los jugadores que hayan conseguido y cantado el bingo ordinario, con un número de extracción de bolas no superior al límite máximo autorizado, una forma de “incentivo a la menguante clientela" de estas salas de juego.
Finalmente, a través de esta medida de no innovar dictada por el magistrado, y a pesar de la oposición puesta de manifiesto por Lotería Nacional para la implementación de esta modalidadad de apuesta, se le dio la razón al bingo Belgrado, al menos hasta el dictado de una sentencia definitiva.
Translation - English An injunction that allows the realization of networked bingo draws in the area of the city of Buenos Aires, was issued by the courts. This is an injunction for the implementation of the awards "Jackpot" or "Interconnected Jackpot Bingo (BAI)".
The Justice did result to an injunction filed by the company Lamartine SA, which owns the bingo Belgrano of the city of Buenos Aires, contrary to resolution 1221 of September 29, (2010) issued by the National Lottery.
The regulator entity had ordered in 2009 by resolution 12/09 the possibility of a future implementation of the interconnected Jackpot mode. With the same spirit the organism had issued resolution 851/10 and through a note had asked the bingos operating in the city of Buenos Aires a methodological proposal for the implementation of this model of play.
Regulated companies, after having completed the steps above, found that the resolution which is being disputed at the court (1221-1210) does not regulate precisely this activity and goes against the mentioned measures.
Therefore, they went to court, obtaining the injunction which is now made known.
Through this resolution, Judge Paul G. Cayssials, of the National Court of First Instance in Administrative Issues No. 9, ordered the measure in profit of the company owner of Bingo Belgrano.
The judge Cayssials cited the reasons given by the company for granting awards based on funds raised by the simultaneous contributions of the five bingo halls operating in the city of Buenos Aires.
Although the gaming industry has expanded steadily throughout the country in recent years, the scholars of bingo Belgrano believe that the gamble room, "despite its initial success," - was authorized in 1994 -, "with the opening of new casinos in the City and in the Province of Buenos Aires, lost much of its audience.
