Swedish term

återvinning till konkursboet

Swedish to English Law/Patents Finance (general) Reorganization/bankruptcy
This phrase appears in a "rekonstruktörsrapport":

Upplysning om egendom har frångått gäldenären under sådana förhållanden att den kan bli föremål för återvinning:

Granskningen i återvinningshänseende avser huvudsakligen transaktioner som skett från dagen för ansökan om företagsrekonstruktion den xx november 200x och de sista tre månaderna före denna fristdag. Grund för återvinning saknas. Ej heller i övrigt har jag träffat på förhållanden som kan föranleda ***återvinning till konkursboet***.

Would "recovery by the bankruptcy estate" work?

Thanks!

Anna Herbst Mar 4, 2009:
What is a translation? It is essential in a translation to convey the actual message and in a legal context this becomes all the more important. It is not acceptable in a legal translation to make sweeping interpretations or draw conclusions leaving out steps that may seem superfluous. We have to leave such decisions to the client or their lawyers.
I still maintain that Nils' translation of "återvinning till konkursboet" as "recovery in favour of the creditors" is a grave mistranslation. "Konkursboet" is the debtor, not the creditor. A recovery in favour of the debtor may well in the end benefit the creditors, but that is for the courts to decide.
Further to Nils' answer, the term "bankruptcy estate" is certainly not an unknown concept in English. It is used in bankruptcy law in Australia, NZ, the UK and the US. That it would be mistaken for "deceased estate" as suggested is unlikely.

recovery in favo(u)r of the creditors

There is AFAIK no snappy term for "konkursboet", so we
have to take it one step further, to the creditors.

I Sverige, ja.

I engelkspråkiga länder fungerar det inte så.

Prova t.ex.

http://iate.europa.eu/iatediff/SearchByQuery.do

och plocka in Sv->En och "konkursbo"
Referenserna är just till kreditorerna, inte till
"konkursboet" i sig.

Of course, it is possible to talk about the "estate" but the problem
is that this is an unknown concept in English. If that route is chosen, an explantion about this needs to be added, or the reader
will most likely think that the bankrupt person is also dead.
Correct, but....

Phrasign it in terms of the creditors, OTOH, is immediately
comprehensible.

disagree Sven Petersson : Konkursboet är en juridisk person; se http://www.ab.se/go.asp?mainpage=http://www.ab.se/mainframe/... Det är därför vilseledande att skriva "in favo(u)r of the creditors".

disagree Anna Herbst : Konkursboet is the debtor, not the creditor. This is a very serious mistake, Nils. Good US info at http://topics.law.cornell.edu/wex/Bankruptcy/ See my discussion point.

No, not a mistake. Of course the "bankruptcy estate" is the debtor, but anything recovered by the estate is in turn in favor of the creditors. And, again, I tried to provide a translation easily comprehended by a US or UK reader.
