I meant to say "shall not be called upon to assume any liability". That's what I was getting at.

C’est bien au patient de démontrer le caractère nosocomial de l'infection toutefois « des présomptions graves, précises et concordantes » peuvent suffire pour établir que l’acte de soins est à l’origine de la contamination.

Dans cette affaire, une patiente a été opérée en novembre 1995. Lors de l’intervention qu’elle a subi dans la clinique Chanteclerc son état a nécessité des transfusions sanguines. Par la suite, constatant qu’elle était contaminée par le virus de l’hépatite C, Mme Y. s’est retournée contre la clinique Chanteclerc et le CRTS, aux droits duquel est venu l'Établissement français du sang. Ils ont appelé en la cause M. X., chirurgien qui avait pratiqué l'intervention.
Mme Y. entend rechercher la responsabilité encourue pour violation du contrat de soins passé entre la patiente et l’établissement ainsi que les manquements aux obligations contractuelles (C. civ., art. 1147).
