tender

English to French Law/Patents Finance (general)
The text is a Confidentiality Agreement made to preserve the interests of a "finance source" granting a line of credit to a borrower.
"Tender" appears in the following clause and clearly, does not mean "bid"(I think it means someone appointed to manage a company's affairs, but I don't know what it could be in French):
"Unless expressly agreed in writing, both Parties hereby agree that neither they, nor their partners or representatives, nor any individual, entity, corporation, division, subsidiary, employee, agent, consultant or assignee associated with them will make any contact with, deal with, or otherwise become involved in any transaction with any party disclosed or introduced, directly or indirectly, by the Parties, including, but not limited to any banking or lending institution, trust, corporation, individual, representative, **tender** or borrower, buyer or seller, agent or assignee."

tender or lender?

Because 'tender' is written as a pair with 'borrower' I was thinking that there might be a a small mistake in the original text and 'lender' should be written here. But that's just a suggestion.
Because in the same list, only names of persons or institutions are mentioned, I think 'tender' refers to a person. In my dictionary it's synonymous with 'keeper' translated as 'portier, gardien, huissier', which isn't a very reasonable solution in this context, though.
