Custas are not costs Custas or custas judiciais are the fees payable to the court for the administration of justice, they are not equivalent to costs, which in EN legalspeak are the parties own legal expenses incurred in the prosecution of their claims. In this respect Chaves de Mello is mistaken.

This has got nothing to do with maturity. The order provides that the court fees are to be paid by the unsuccessful party in the action at first instance and in the appeal. Here Vencido means loser, or unsuccessful party.

See my comment on Maria's answer. My answer is incomplete as it should make it clear that the court fees are paid in proportion to the success achieved by the parties.
