I am not sure what they are trying to say when using "deemed" in this sentence:
"The United States and other countries control or prohibit certain international transactions involving exports, deemed exports, re-exports, and imports."

Bedoelen ze veronderstelde exports, dus exports, veronderstelde exports, wederexports en imports?
Of vermeende exports?

Zeer gewaardeerd als iemand hier wat licht op kan werpen.

inderdaad veel te vinden Ha, je kwam op dezelfde plek uit...

Maar dan overdracht i.p.v. verkoop, omdat 'verkoop' specifiek voor de Indiase versie van deemed export lijkt te gelden. Voor Amerika zit het iets anders.

Wat is g-trans trouwens? Toch niet... ?

Ben even de draad kwijt Ik dacht dat ik helemaal niks over "deemed exports" kon vinden (gisteravond laat...), maar hier een duidelijke omschrijving: 1. What is the "deemed export" rule?

An export of technology or source code (except encryption source code) is "deemed" to take place when it is released to a foreign national within the United States. See §734.2(b)(2)(ii) of the Export Administration Regulations (EAR). For brevity, these questions and answers refer only to "technology" but apply equally to source code.

Dit wordt volgens g-trans vertaald als "aan export gelijkgesteld" of "aan uitvoer gelijkgestelde verkoop"?

Ik had een mooie vertaling ("met uitvoer gelijkgestelde verkoop") gevonden op EUR-lex (zie bijvoorbeeld http://tinyurl.com/dxk3k2c ), maar bij nader inzien geldt die alleen voor India en niet voor de VS.

Deemed Export Definition
A deemed export release in the United States is a release of technology or source code that is subject to the Export Administration Regulations to a foreign national. Such release is "deemed" to be an export to the home country or countries of the foreign national. Release of technology includes access by the following means:
Visual inspection (such as reading technical specifications, plans, blueprints, etc.).
Oral exchange of technology, including when technology is made available by practice or application under the guidance of persons with knowledge of the technology.
Posting information on a website or FTP site for downloading.

1. What is the "deemed export" rule?

Het gaat dus om de 'release' van technologie of broncode aan een buitenlander, die wordt gelijkgesteld aan uitvoer naar diens vaderland. Gelet op de bovenstaande context vind ik 'overdracht' wel passend voor 'release', of anders misschien 'bekendmaking'. Verder zou ik de Engelse term er tussen haakjes bij vermelden.

In de Oxford Dictionary of Law (Martin & Law) staat onder 'deemed':
Supposed. In the construction of some documents (particularly statutes) an artificial construction is given to a word or phrase that ordinarily would not be so construed, in order to clarify any doubt or as a convenient form of drafting shorthand.
In Black's Law Dictionary (Garner) staat onder 'deem': Deem has been traditionally considered to be a useful word when it is necessary to establish a legal fiction either positively by 'deeming' something to be what it is not or negatively by 'deeming' something not to be what it is (...)

Bedankt Ghislaine. Ik had de woordenboeken ook geraadpleegd, maar daarmee alleen kom je er dikwijls niet uit.
