Article 277 of the Penal Code governs non-fulfilment of obligations to provide
economic support: “A parent, adoptive parent, guardian or caregiver of a child
under 18 years of age or of a disabled person who deliberately fails to provide the
essential means of subsistence required of him under a final enforceable civil
judgement, an agreement concluded in the Office of the Procurator-General of the Republic or elsewhere, or a ruling by that institution shall be subject to 15 to 50 ***days’ fine***”.

343. The second is a very significant one. It provides for individualization of criminal penalties, i.e. imposition of a monetary fine in ***daily fines***, whereby the number of daily fines cannot be lower than five or larger than 360. Pursuant to the provisions of the Criminal Code, the court shall determine the number of ***daily fines*** having regard to the general rules for sentencing.

343. El segundo aspecto es muy importante. Prevé la individualización de las penas, es decir, la imposición de una sanción económica con arreglo a un sistema de ***días-multa*** según el cual las multas diarias no podrán ser inferiores a 5 ni superiores a 360. El Código Penal prevé que los tribunales deberán determinar el número de ***días-multa*** teniendo en cuenta las normas generales para dictar sentencia.
