Adults of sound mind

It is difficult to be sure without seeing the whole text, but people eligible to participate in clinical trials need to be consenting adults of sound mind who meet other criteria as well.

Les mineurs et les majeurs inaptes
Bien que les règles générales s’appliquent à tout projet de recherche auprès de participants humains, certains cas particuliers sont aussi encadrés par des lignes directrices particulières. C’est le cas notamment de la recherche avec des mineurs (moins de 18 ans) et des majeurs inaptes à donner leur consentement libre et éclairé.

Le Code civil du Québec prévoit des dispositions légales spécifiques pour les mineurs et les majeurs inaptes à donner un consentement libre et éclairé. Les dispositions sont contenues dans l’article 21 :
• 21. Un mineur ou un majeur inapte ne peut participer à une recherche susceptible de porter atteinte à son intégrité qu'à la condition que le risque couru, en tenant compte de son état de santé et de sa condition personnelle, ne soit pas hors de proportion avec le bienfait qu'on peut raisonnablement en espérer.
• Il ne peut, en outre, participer à une telle recherche qu'à la condition que la recherche laisse espérer, si elle ne vise que lui, un bienfait pour sa santé ou, si elle vise un groupe, des résultats qui seraient bénéfiques aux personnes possédant les mêmes caractéristiques d'âge, de maladie ou de handicap que les membres du groupe.
• Dans tous les cas, il ne peut participer à une telle recherche s'il s'y oppose alors qu'il en comprend la nature et les conséquences.

A minor or a person of full age who is incapable of giving consent may participate in research that could interfere with the integrity of his person only if the risk incurred, taking into account his state of health and personal condition, is not disproportionate to the benefit that may reasonably be anticipated.

• Moreover, a minor or a person of full age incapable of giving consent may participate in such research only if, where he is the only subject of the research, it has the potential to produce benefit to his health or only if, in the case of research on a group, it has the potential to produce results capable of conferring benefit to other persons in the same age category or having the same disease or handicap.
