W umowie pośrednictwa bez wyłączności (open listing) sprzedający ma prawo oferować nieruchomość poprzez innych pośredników i zastrzega sobie prawo do osobistej sprzedaży. Oznacza to, że kiedy nieruchomość zostanie sprzedana, tylko ten pośrednik otrzyma prowizję, który doprowadzi do skojarzenia z gotowym do kupna kontrahentem.
W agencyjnej umowie na wyłączność (exclusive agency listing) sprzedający zatrudnia tylko jednego pośrednika do sprzedaży nieruchomości. Sprzedający zastrzega sobie jednak prawo do samodzielnego zbycia nieruchomości bez zobowiązania wypłacenia pośrednikowi prowizji.
W umowie na wyłączność (exclusive right to sell listing) właściciel wybiera tylko jednego pośrednika i wypłaca mu prowizje, jeśli nieruchomość zostanie sprzedana przez którąś ze stron, z właścicielem włącznie
