Child is bearing father's surname and as per law 1st January 2005... The Act provided that a child who was born after 1 January 2005 or was younger than 13 years of age at 1 September 2003 (i.e., was born after 1 September 1990) would assume his/her father’s surname, unless both of the child’s parents agreed and specified their intent to transmit to the child either parent’s family name or a hyphenated combination name (the transmission of hyphenated family names to subsequent generations was, however, prohibited).

How can the date of the marriage certificate be AFTER the birth of mentioned child but married BEFORE the birth of the 3 children? This is the first child and there are 3 children in all, yes?

They married in county hall in 1997, one child born in 2000, other 2002 and now 2009. and copie livret famille mentions date delivree as date 1997.

Yes each child bears surname of father, only in the birth certificate of girl, the above declaration is mentioned.

Yes a marriage certificate too is provided. Its issuance date is after the birth of aforementioned child but married in town council before the birth of three children.

What is confusing here is

Two times declaration, once by both parents and other only by father?

Sorry, I misread the original slightly in my first post.
"Le huit août deux mil neuf à dix heures deux minutes est née, du sexe féminin, XXXX, suivant déclaration conjointe du (date), de (les parents)..."
means that the child XXX was born on (date) to the parents (names of mother andf father).

As for the main question, "déclaration conjointe" it no doubt meansd that father is making the statement on behalf of both the mother and himself.

There are 2 more children. Their birth certificate simply mentions. (name of child) and this one mentions name + surname and suivant déclaration conjointe du (date).

Meaning The answer is actually in the text of what you have posted. It states, "suivant déclaration conjointe du xx/xx/xxxx de père et mère..."
In France, you have just a couple of days to declare a birth. Here, the registration is made by the father in the name of both parents.
