English term

Interest in possession settlement

English to French Bus/Financial Finance (general) Fiducie
Bonjour,

Titre : "Y.Z. Interest in possession settlement"

Je vous en remercie.

Discussion

Germaine Aug 19, 2018:
Exactement:

Daryo Aug 19, 2018:
"Interest in possession" is one term, "settlement" should be the "settlement" of a trust.

Declined
Interest in possession trust is a common form of trust. It gives the beneficiary an immediate right to income from the trust. A beneficiary is said to have an interest in possession when he has the right to enjoy the trust property. Interest in possession trusts are often created as part of a will. A surviving spouse will be granted a right to the income from the trust by the settlor. Upon the death of the surviving spouse, the rest of the fund may pass to the couple's children or other named persons. Interest in possession trusts are usually used in order to protect capital. Interest in possession can be for a fixed period, indefinite period or for the rest of the beneficiary’s life.

right to enjoy the trust property = interest in possession= le droit de jouissance

settlement = a decision made by the settlor through the trust = disposition de la fiducie
Peer comment(s):

neutral Germaine : 1. Un "droit de jouissance" (right of enjoyment) N'EST PAS un intérêt par possession, i.e. de propriétaire. 2.

disagree Daryo : right reference, but I can't how it connects to your proposed translation // just one example: "le droit de jouissance" would mean the right to live in a house, NOT the right to receive the rent paid by tenants (="interest in possession" of the house)
