Only the first one would be capitalized, if it’s the first letter of the sentence, otherwise I’d advise against it.

: Diría que si es un texto jurídico de España, lo correcto es marido y mujer o "los cónyuges". Esposo y esposa se emplearía en otro contexto no jurídico

I think the target audience should be made clear. Anyway, it seems to me that "esposo" and "esposa" work better.

Would it still be "Marido" and "Mujer?" In the first sentence it just seems a little odd to say "La mujer será responsable..."
