Which is more correct in a division of property agreement? Marido y mujer or Esposo y Esposa? Would the words be capitalized?

Como ya se dijo, en español jurídico latinoamericano, husband sería "esposo"; en español peninsular, "marido".

I'm sorry not to be a little clearer. Here is an example of the kind of usage I mean: "Wife will be solely responsible for all payments, debts and obligations associated with said home and shall indemnify and hold Husband harmless with respect thereto. Husband shall sign any necessary documentation to transfer the deed solely to Wife within twenty (20) days of presentment of these documents to him by Wife.'
Would it still be "Marido" and "Mujer?" In the first sentence it just seems a little odd to say "La mujer será responsable..."

Only the first one would be capitalized, if it’s the first letter of the sentence, otherwise I’d advise against it.

A very common, set phrase. :)

I think the target audience should be made clear. Anyway, it seems to me that "esposo" and "esposa" work better.
