French term

effect translatif

French to English Law/Patents Finance (general) subrogation
"Basée sur les articles 1250 et 1251 du Code civil luxembourgeois, la subrogation est une opération juridique triangulaire.
Elle permet à un tiers (le subrogé), qui paie la dette que le débiteur a à l’égard d’un créancier (le subrogeant), d'obtenir auprès de ce débiteur le remboursement de ce que le tiers a payé.
Ce paiement n’a pas un effet extinctif, mais translatif."

effect of transferring the debt

NB assign or transfer a debt, but convey chattels or land.

Again, note the typical Daily Mail on Line readers' comment: 'this will certainly effect the situation...'

neutral philgoddard : I'm glad you've chosen plain English, but I think my version is more compact.

translative effect

This is a regular translation for 'effect translatif' in English articles on continental law, and it is the same construction as 'resolutory effect'. It seems a bit literal, but it works.

This payment does not extinguish the debt, but transfers it.
