French term

effect extinctif

French to English Law/Patents Finance (general) subrogation
"Basée sur les articles 1250 et 1251 du Code civil luxembourgeois, la subrogation est une opération juridique triangulaire.
Elle permet à un tiers (le subrogé), qui paie la dette que le débiteur a à l’égard d’un créancier (le subrogeant), d'obtenir auprès de ce débiteur le remboursement de ce que le tiers a payé.
Ce paiement n’a pas un effet extinctif, mais translatif.

[See my suggestion for the whole sentence]

I've never posted the same answer to two questions before, but I suggest:
This payment does not extinguish the debt, but transfers it.
Peer comment(s):

agree Josephine Cassar : simple, all encompassing but depends on register

neutral Adrian MM. : Again, you have merely lifted my idea of adding the debt, but without attributing the credit.// Yes. You do. You have included my idea of debt &, contrary to ProZ glossary rules, conflated my answers to the related questions of extinctif and translatif.

I don't understand what you mean by debit and credit, but I haven't lifted anything. My answer is more concise than yours.
disagree Daryo : "My answer is shorter" is a completely irrelevant criteria in legalese. Legal texts (involving other people's money or rights - not to forget) are NOT the place for campaigning about translator's own style preferences.

Criterion. Translators'. I may be a man of few words, but at least I can write English.
