A livrança em branco, ou LIVRANÇA CAUÇÃO, é um título pelo qual as entidades garantem o pagamento de uma dívida e, como é normal, a livrança em branco (prevista no art.º 10.º da Lei Uniforme), destina-se a ser preenchida pelo seu adquirente, sendo essa aquisição acompanhada da atribuição de poderes para o seu preenchimento.
Geralmente, quem assina uma letra ou uma livrança e assume a respectiva obrigação cambiária, fá-lo porque já está vinculado por efeito duma relação jurídica anterior.
Esta é a relação jurídica subjacente ou causal, também chamada contrato originário ou relação jurídica fundamental, que pode assumir várias figuras jurídicas, tais como: uma compra e venda, um contrato de mútuo, uma abertura de crédito ou um saldo de conta corrente, um contrato de locação financeira como o dos autos etc…
A livrança não preenchida é acompanhada de um pacto de autorização de preenchimento, onde são determinados os limites e as situações de incumprimento que, a registarem-se, permitem à instituição bancária preenchê-la e planear ação executiva.

Article 10

If a bill of exchange, which was incomplete when issued, has been completed otherwise than in accordance with the agreements entered into, the non-observance of such agreements may not be set up against the holder unless he has acquired the bill of exchange in bad faith or, in acquiring it, has been guilty of gross negligence.


Article 77

The following provisions relating to bills of exchange apply to promissory notes so far as they are not inconsistent with the nature of these instruments, viz: (...) and provisions concerning a bill of exchange in blank (Article 10).
