Quando si ha minorata difesa
L'aggravante della minorata difesa della vittima si configura allorquando il reo ha commesso il reato approfittando di una situazione di debolezza della persona offesa, debolezza connessa al tempo, al luogo o alla condizione della vittima stessa, che erano tali da ostacolare la difesa pubblica o privata e dei quali il colpevole ha approfittato.

Often it is not possible to distinguish violent behavior from the lawful interpersonal approach, also aimed at even more lawful sexual encounters. The difference between the two cases depends very often on the way in which you show your interest and, in this case, a lot also depends on the context in which the attentions occur. There are positions that can generate one imbalance of power: a teacher / pupil or editor / curator relationship and aspiring author.

If asking is lawful and responding and courtesy, this amiable exchange of intentions can be distorted by unequal relationships, when a refusal by the woman can lead to negative work repercussions. The threat can be implicit or explicit (one or the other depends on the level of awareness and misunderstanding of the abuser). In any case, the woman is not in a position to choose freely because it is not simply an approach between consenting people.

It is not for us to determine whether it is a crime or not, but according to what we have learned and that we can (for the moment) report only in an extremely filtered form we are talking about behaviors that go beyond the boundaries of professional ethics.

In the case of crimes, however, remember that there are aggravating conditions, which the Criminal Code (art.61, paragraph 5, 11 and 11 ter) explains how “having taken advantage of circumstances of time, place or person, also with reference to age, such as to hinder public or private defense, having committed the fact with abuse of authority or domestic relations, or with abuse of office relationships, of work performance, of cohabitation, or hospitality, having committed a crime against the person to the detriment of a minor subject within or adjacent to education or training institutions“.

D. Aggravating Circumstances
5.13 Under Article 39 of the Penal Code, the following circumstances will constitute aggravating circumstances provided that they are neither constitutive elements nor special aggravating circumstances of any given offence:

e) Taking advantage of the circumstances of time, place or person to hinder public or private defense, such as stealing from a person who is asleep, or committing a theft in the middle of the night, or stealing from a child;

Folgende erschwerende Umstände kamen hinzu: Brutalität, Schwere und systematischer Charakter der Handlungen, die ihm vorgeworfen wurden, die hohe Anzahl von Opfern wie auch der Umstand, dass er seine Macht missbraucht hat.

Gestützt auf die Aussagen der Beschwerdeführerin sowie den Ausführungen im Haftantrag ist nicht zu beanstanden, dass die Staatsanwaltschaft den dringenden Tatverdacht der Entführung
(Art. 183 StGB) bejaht hat. Erschwerende Umstände im Sinn von Art. 184 StGB liegen keine vor. Unbestritten ist sodann, dass die Beschwerdeführerin nicht im Schweizerischen Strafregister verzeichnet ist.
