Seizure and Holding of Animal Victims Animal abuse cases differ from all other prosecutions in that the primary “evidence” in the case is often a living creature that must be housed, fed and cared for—sometimes for long periods. All states have provisions within their animal abuse laws providing for the seizure of animals being cruelly treated or neglected. In some states, humane agents may remove neglected animals, but only a law enforcement officer may remove abused animals. Some states require that a veterinarian be consulted to determine if seizure is in the best interests of the animals. Such input is desirable even when not specifically required by law. Such seizures can place an enormous burden on the responding agencies.

Responses that Protect Animal Victims 12. Seizing or requiring mistreated animals to be forfeited. People who abuse and seriously neglect animals have demonstrated that they are a serious threat to the animals' well-being. Most states have provisions for police or animal welfare organizations to take mistreated animals into custody. Temporary seizure protects the animal pending the outcome of the legal process, while permanent forfeiture can speed the animals' transfer to a safe, permanent living situation

provisional/temporary removal of an/the animal

The act establishes parallel procedures when an ACO reasonably believes that an animal has been neglected or cruelly treated but has not taken custody of the animal. In this case, the ACO can petition the Superior Court that has venue or Hartford Superior Court to take appropriate action. This can include the physical removal and temporary care and custody of the animal, the authorization of an ACO or licensed veterinarian to care for the animal on site, vesting of ownership of the animal, and the posting of a bond and assessment of costs as described below. - https://www.cga.ct.gov/2007/SUM/2007SUM00230-R01HB-07392-SUM...
