Spanish term

entrega en depósito

Spanish to English Other Law: Contract(s) vehicles
Estipulación 2: EL CLIENTE (bien directamente o a través del concesionario/distribuidor del fabricante) entrega en depósito el vehículo anteriormente descrito sobre el que JUAN realizará las transformaciones.

The vehicle is being bought as a camper van by an end user, and JUAN is taking the vehicle ( a normal van) and transforming it.

TIA

Discussion

Sandro Tomasi Jun 25, 2021:
@Matt If established, then the return of the vehicle is implicit here due to the other stipulations.
matt robinson (asker) Jun 25, 2021:
The vehicle is to be handed over to the final owner when the work is finished.
Sandro Tomasi Jun 25, 2021:
@Matt Look for clues in the rest of the contract. Is there a section that covers the returning of the vehicle or is there a due date for the work to be completed?
matt robinson (asker) Jun 25, 2021:
Could be that I am overthinking it I immediately thought of "deliver", but then "en deposito" seems redundant. That could be the case, of course, but I was wondering if they meant something like "entrust", as the vehicle is going from the manufacturer's to the owner via a third party (to have work done). I wasn't happy with "entrust" BTW.

Selected

will deliver/shall deliver

Spanish typically uses the present tense for stipilations in contracts
English typically uses does not

Much debate now takes place about "shall" (although it is in widespread legal use)

"Will" has the same implication

Just saw your comment in the discussion about "entrust", Matt, though I'm not sure why you weren't happy with it. It seems to convey the idea here well, i.e., entrusting property to someone else means leaving it with them on a temporary basis.

Spanish term (edited): entregar en depósito

/does / bail to

sobre el que JUAN realizará las transformaciones ... to make conversions rather than tarnsformations, so like the *classic textbook examples* of a garage-owner receiving a motor vehicle for repair or a dry cleaner taking in clothes for cleaning.

Tender in or on bailment is redundant and confusable wth release on bail, so spelt bail and bailment rather than balement. Distinguish from a deposit, custody or trust.

Low confidence level so the asker can pick another answer with confidence.

As the ex-ProZ answerer in the first web ref., retd. English Solicitor William 'Bill' Harrison used to quip: ' if your sort doesn't understnd the term, then I am afraid I cannot help you.'
Example sentence:

Bailment is a legal relationship in common law, where the owner transfers physical possession of personal property ("chattel") for a time, but retains ownership.

Peer comment(s):

neutral AllegroTrans : Technically yes, this would be bailment, but I don't think "entregar" is that "deep" in meaning, and "does" (present tense) doesn't work as a contractual stipulation in English

let's make slight qualifications 1. the asker never picked up on Bill H's bailment translation already in the ProZ glossaries and 2. deliver or tender is only half the picture and ambiguous as to the tenure: absolutely or temporarily in trust or bailment.

surrenders

El contrato de depósito es un contrato mediante el cual el depositante cede la tenencia de una cosa al depositario para que se encargue de custodiarla, debiendo este restituirla cuando el depositante la reclame.

"leaves in" is better in this case
Peer comment(s):

neutral AllegroTrans : This sounds like a permanent disposal, surely it's only for repairs to be carried out// "leave in" isn't formal enough imo

ok and how about "leaves in" or "shall leave in" taking your legalese point on board

delivers to a depot

The depot could be a warehouse but the item for delivery is a vehicle.
The client brings the previously mentioned vehicle to a depot, where a trader or manufacturer's supplier shall deliver the vehicle to the man who carries out its adaptations or adjustments.

'en depósito' = 'in storage' or 'in a warehouse'
Example sentence:

El cliente entrega en depósito el vehículo ya mencionado y descrito, lo cual está depositado con un concesionario y distribuidor del fabricante, que entregará el vehículo sobre que se trabajará, al hombre que va a realizar sus adaptaciones.

Peer comment(s):

disagree AllegroTrans : "en depósito" effectively means "on deposit" not "to a depot"
