DEFENDANT si costituiva in giudizio eccependo di non essere tenuta ad alcun adempimento non essendo la fattispecie riconducibile alle condizioni di cui al contratto di assicurazione di stipulato da PLAINTIFF e DEFENDANT per garantire eventuale danni conseguenti al trasporto dell'opera; eccependo inoltre che l'opera acquistata dal sig. THIRD PARTY INTERVENER, e allo stesso consegnata in data XXX, poteva essere stata danneggiata durante la fase di disimballaggio e quindi il danneggiamento poteva essere non riconnesso causalmente alle operazioni di trasporto.
Il sig. THIRD PARTY INTERVENER aveva inoltre ad intervenire nel giudizio così instauratosi ***facendo proprie tutte le domande*** coltivate da PLAINTIFF nei confronti di DEFENDANT.
