En cuanto a la tributación ambiental, antes de definirla debemos partir del concepto de extra fiscalidad del tributo, totalmente asumido en la actualidad y que dio un nuevo significado a la consideración del Derecho Financiero como la rama del ordenamiento jurídico que ordena la obtención de ingresos por parte del Estado y los demás entes públicos con el fin de dar cumplimiento a los fines que les son propios.
