Konkubinat, zwany bardziej współcześnie związkiem partnerskim (choć niektórzy przedstawiciele doktryny uważają, iż pojęcia te nie są tożsame – przyznając konkubinatowi znaczenie związku osób dwóch różnych płci, zaś związkom partnerskim także znaczenie, w sytuacji gdy partnerami są osoby tej samej płci) to zgodnie z ugruntowanym poglądem wspólne pożycie analogiczne do małżeńskiego, tyle, że pozbawione legalnego węzła. Oznacza to istnienie więzi duchowej, fizycznej i ekonomicznej, łączącą dwoje osób. Związki takie jednakże nie podlegają żadnej rejestracji.
Wobec powyższego, konkubentom nie przysługują prawa jakie kodeks rodzinny i opiekuńczy przyznaje względem siebie osobom, które zawarły ze sobą związek małżeński. Nie ma także możliwości, aby przepisy kodeksu rodzinnego stosować względem osób pozostających w konkubinacie w drodze analogii.
