Zgadzam się, to jest chyba dość zgrabne - consider (evidence) negatively/unfavorably.

idę w kierunku otherwise the court shall consider the evidence negatively and shall disregard the Respondent's arguments and evidence in the course of further proceedings.... ale jakoś jeszcze nie jest idealnie ;-) stąd pytanie...
