French term
actes d’intercession en faveur de tiers
Interzession | Steve Robbie |
Proposed translations
to enter into any guarantee agreements in favour of third parties
so "intercession" is a broad term for any type of guarantee
or: "to stand as guarantor for any third parties"

Mpoma
: yes, fancy word for no particular purpose (although maybe less unusual in Switzerland... who knows?)

Or you could say intervention.

Jennifer Levey
: 'intervention', given the examples mentioned in the ST (nantissements, cautionnements, ...)

Conor McAuley
: Personally I would keep "intercession", which is fine in English, albeit a bit flowery, but the rest is spot on

Mpoma
: The definition in a private law context is given in Tim's answer. This is about standing surety, not about intermediation.

: Intermediation/intervention/intercession: the sort of thing you write when you're not really sure what the source text is on about and want to pass the buck to the reader.

Speak for yourself! I know exactly what the source text is on about - it's explained in the words that follow.

collateral security (AmE: voluntary collateralization) document/s/
> and would cover floating and fixed xcharges + deeds of suretyship etc. ... notamment sous forme de nantissements, cautionnements ou autres.
Would be useful to know the CH GER term for this : Einstandserklärung (?) but, working backwards from collateral warranties and undertakings in contract (refer to your EN contract law notes), I reckon that the inclusion of 'third-party' is wholly un-necessary.
Low confidence level when wearing my Stetson for 'Voluntary Collaterlaization'). Over to our American experts....
Collateral Security Documents means, individually and collectively, (a) the Security Agreements and the financing statements filed pursuant thereto, and (b) the Pledge and Security Agreements, and (c) any additional documents guaranteeing indebtedness,
Voluntary Collateralization. ACE may at any time provide Collateral to secure any LOC (in which case the pricing applicable to such LOC shall be adjusted as set forth on Schedule I).

First sentence, loosely translated, says: Intercession in Swiss company law is when a société anonyme provides loan securities for debts of its parent or sister company or, generally, of its shareholders.
"Burgschaft" and "Garantie" in the second sentence translate to "cautionnement" and "porte-fort" in the Swiss Code of Obligations.
