Spanish term

GANANCIALES - Colombia

Spanish to English Law/Patents Law (general) Divorce Proceedings
"Los bienes que queden después de pagar las deudas de la sociedad conyugal son los denominados GANANCIALES, los cuales entraran a repartirse entre ambos cónyuges por partes iguales."

Mi intento:
"Assets remaining after paying the marital partnership’s debts are known as GANANCIALES, which shall be divided equally between the spouses."

El término que más aparece es Community Property pero no estoy segura…

Por favor, ayuda aclarando si aquí Community Property sería la traducción correcta.

Gracias, muchas gracias.

For the benfit of A. Bramhall who dislikes "after-acquired":
Se denominan bienes gananciales o simplemente gananciales en derecho, a todos aquellos bienes adquiridos por los cónyuges DURANTE EL MATRIMONIO, a excepción de los recibidos a título gratuito (my capitalisation)

joint property

Cuando se refiere a gananciales de matrimonios o parejas se traduce como "joint property" porque la propiedades se dividen por la mitad. Si se divorcian cada uno se lleva un 50%.
Espero que ayuda.

Spanish term (edited): gananciales

(net) jointly owned, after-acquired matrimonial property of husband & wife

- rather than ganancias.

after-acquired: notably after marriage and not post.bankruptcy

gananciales: community property, jointly owned property of husband and wife, West & pertaining to property acquired *during marriage*, Butterworths.

Note that régimen de gananciales is one of the (BrE) matrimonial (AmE) marital schemes of property:

'Es el régimen económico matrimonial por el que se hacen comunes para la mujer y el marido las ganancias o beneficios obtenidos indistintamente por cualquiera de ellos y que serán atribuidos por mitad al disolverse la sociedad de gananciales (artículo 1344 del Código Civil).'
Example sentence:

USA: Generally, once the spouses are separated permanently, property acquired is no longer marital property.

USA: Generally, marital property is anything that you or your spouse earned or acquired during your marriage. (In some states that means before you were separated, while in others it means before you were divorced.)

Peer comment(s):

agree AllegroTrans : I think you can omit "of husband and wife"

neutral philgoddard : 'Assets remaining after paying the marital partnership’s debts are known as (net) jointly owned, after-acquired matrimonial property of husband and wife'? I don't think so.

Community property

"Ganaciales" means pertaining to the martial property regime. In this context, I would translate it as "community property".

Eileen's suggestion is also good, but I prefer "community property" because it is the term used in the USA for the same idea of property jointly owned by spouses and divided during divorce. See the reference links below.
Peer comment(s):

agree Andrew Bramhall : Agree, and AMMs " after-acquired" is a direct calque of a Germanic language construct which is wrong anyway.

neutral Eileen Brophy : Community is a very strange noun for a married couple. A community normally consists of a lot more than just two people

It does sound strange, but "community property" is a concept in US law meaning property jointly owned by a married couple. In other words, I wasn't the one who decided it should be called 'community' property
neutral AllegroTrans : This works for US English. but not elsewhere

¿Que se entiende por gananciales?
Los bienes que queden después de pagar las deudas de la sociedad conyugal son los denominados gananciales, los cuales entraran a repartirse entre ambos cónyuges por partes iguales.

¿Cuáles son los bienes que me pertenecen de la sociedad conyugal?
