Ik heb geen idee wat dit hier zou moeten betekenen, wrs klakkeloos overgenomen uit andere voorwaarden. (Het enige dat ik kan vinden is de term 'residual knowledge clauses')

Ik ben het hier niet mee eens en heb dat uitgelegd in mijn vorige D-box entry:

"whether express, implied in law or RESIDUAL" staat of tussen haakjes of tussen komma's

"whether express, implied in law or residual" verwijst terug naar het voorgaande net als "whether express or implied by statute, common law or otherwise"(, with respect...)
Dit is de structuur:
no warranties, representations, statements or guarantees, whether express or implied,
implied?
implied by A, B, C, ... or otherwise
Je kunt 'residual' niet zo maar uit die structuur lichten.
En je kunt 'residual' hier niet vervangen door 'residual copy'.
Lijkt me evident.
In deze specifieke context zou 'residual' ook kunnen verwijzen naar inmiddels van de website verwijderde content, waarbij dan dus wordt beoogd om de disclaimer ook uitdrukkelijk op dergelijke content van toepassing te laten zijn. Verwijderde content wordt over het algemeen bewaard in de vorm van een zgn. 'residual copy'. Zie de vele verwijzingen naar deze term (en de bijbehorende praktijk) in Engelstalige (website)gebruiksvoorwaarden.

'otherwise' was een van mijn eerste gedachten maar kon toen niet direct vinden wat ik zocht.
Heb nu iets andere zoektermen gebruikt:

Iemand die ervaring heeft met deze stuff moet hier een verantwoorde oplossing voor kunnen aanbieden.
Je hebt mensen die heel deskundig zijn op een bepaald gebied, die volkomen tussen de regels door kunnen lezen.
'residual' komt op mij over als een 'filler', is bedoeld om volledig te zijn.
Iemand in dit veld moet hier een oplossing voor weten.
Ik zeg niet dat het geen gewicht heeft, maar er wordt te veel gewicht aan toegekend.
Dit kan safe afgetimmerd worden.
Ik weet zeker dat je een redelijk nauwkeurig idee hebt over wat het betekent.
Wat zou je voorstellen, als je een keuze zou moeten maken?

Het is inderdaad niet uitgesloten dat de klant zelf ook niet weet wat hier met 'residual' wordt bedoeld, omdat de gebruiksvoorwaarden klakkeloos geheel of gedeeltelijk van de website van een andere partij zijn overgenomen. In dat geval zou dat reden temeer voor de klant moeten zijn om de term te herzien of zelfs helemaal te schrappen. Immers, citerend uit het eerder genoemde artikel:
One of the questions that I often hear from online business owners is "why can't I just copy someone else's terms of use off their website and use it on mine?"
My answer is, why would you want to invite someone else's liability into your own front yard? It's just not a good practice. It's not something I would ever advise doing.

De klant heeft hier geen antwoord op, bijna 100% zeker.
De betekenis moet aan de context worden ontleend.
De algemene strekking lijkt me duidelijk.
Met jouw ervaring moet je hier iets zinvols in kunnen vullen, niet?

Je vindt het vrijwel alleen in één context: website content disclaimers. En je vindt het steeds in dezelfde riedel - whether express, implied in law or residual -, waarbij die riedel soms tussen komma's, soms tussen haakjes staat:
