Russian term

снять обременение

Russian to English Law/Patents Law (general)
Dear Colleagues,

Please help me translate "снять обременение" in the following context: Заемщик может снять обременение с объекта залога только после выполнения всех своих обязательств по договору займа. Is it possible to have something like "release encumbrance on the mortgaged property" or "clear the mortgaged property of encumbrance" here or something else?

Discussion

Gennady Lapardin Oct 18, 2011:
agree by most interpreters yet it would be translated as pretenzia or isk. Risk of translator's ignorance (or better, missing information) does not preclude (sorry for this word) from using correct term.
By the way, for the future translations, kleimo (in the original meaning) in Russian is not pretenzia, but this is to say: It'is mine.
For back translation, in this case, I understand translations of related follow-ups too.
Jurate Kazlauskaite Oct 18, 2011:
Back translation "claim" can hardly be translated as "обременение"
Gennady Lapardin Oct 18, 2011:
using the term "claim" we have no confusion, while using any other word (encumbrance, burden, etc.), we will get a host of controversial constructions as well as the difficulties in back translation, that's all. The judment in your link shows how the construction of seemingly simple word "exonerate" could be subject of half a page of the judgement.
Check word: Free from which encumrance ? Answer: From the claim. Here it is one and definite, unless the asker says that there are ten others.
Jurate Kazlauskaite Oct 18, 2011:
unless on a voluntary basis
Gennady Lapardin Oct 18, 2011:
or, as the text from the link below says, "by being relieved of the burden of serving an unlawful sentence". Acc. to Black's "encumbrance": 1. A claim.... OR SOME OTHER RIGHT
Jurate Kazlauskaite Oct 18, 2011:
That is why Russian translators have to consult the Codes (with or without removal of encumbrances:)
Gennady Lapardin Oct 18, 2011:
The American advokats prefer to consult dictionaries in stead of the Codes, at least in that case (link below)
Jurate Kazlauskaite Oct 18, 2011:
To free from encumbrances: <<exonerate the property from the mortgage lien>: See paragraph 7 in: http://www.lexisone.com/lx1/caselaw/freecaselaw?action=OCLGe...
Gennady Lapardin Oct 16, 2011:
don't recommend encumbrance это слишком широкое понятие. Например, запрет продавать алкогольные напитки в х м от забора, другие административные или коммунальные обременения (обязательный проход по территории и т.д.)

Здесь, заемщик не может совершить активное действие (release), он может только получить разрешение на освобождение от обременения от заимодателя.

disagree The Misha : This is not what the original says//The original says "remove encumbrances". For once, this is where literal translation pays.
