There are several Glossary entries for "con carácter previo", but none of them really seems to fit here. The most feasible thing I can think of is "retrospectively", but don't want to use this unless this definitely is it...
I'd be most grateful for any suggestions (or definite corroboration) to help me make sense of this - many thanks!

I would suggest turning the phrase around to make it possible to use prior:
"...given that prior control is not compulsory..." or similar.
