Source text - English TERMS OF ASSIGNMENT:
1. This mandate contract shall be transmitted to the other Party in writing or by fax or email. Regardless of the method of transmission, it binds the Parties. All pages of the mandate contract constitute its integral part. This mandate contract can only be accepted without reservations. In the absence of a written refusal to accept the mandate contract for execution within 30 minutes of receipt, it is considered that the mandate contract has been entirely accepted and approved. Any request for re-confirmation of the terms and conditions of the mandate contract, re-inquiry about the validity of the mandate contract or other similar actions on the part of the Contractor shall not affect the validity of the mandate contract, which shall be deemed to have been concluded and accepted without reservation in the original version provided by the Employer.
2. The payment date is calculated from the time of receipt of the original correctly issued invoice with a set of original and properly completed and signed and stamped all required documents, in consideration of the payment rules in place at the Employer, according to which transfers are made once a week, i.e., every Thursday. Therefore, the payment term may be extended or shortened by several days, to which the Contractor agrees and will not demand any claims in the future on this account. The required documents, which are necessary for proper settlement of the execution of the mandate contract between the Employer and their counterparty are, in particular, the original bill of lading in at least two copies and other original documents issued to the Contractor on loading/unloading such as for example Stock Issue Confirmation (CI), delivery documents (delivery note, Lieferschein), pallet receipts, customs documents and others. In case of non-delivery or incompleteness (e.g., lack of signatures/stamps) of required documents or delivery of photocopies of papers or documents that raise doubts about their authenticity, the Employer reserves the right to withhold payment for transportation until the deficiencies are corrected. Payment will be made to the bank account indicated in the VAT invoice issued by the Contractor.
3. In the event of a dispute with the Employer regarding payment, the Contractor shall not contact the shipper or consignee of the goods to inform them of non-payment or to seek compensation from them directly. In case of violating the above prohibition, the Employer shall be entitled to claim liquidated damages in the total freight amount. The Employer shall have the right to claim damages above the liquidated damages.
4. The Employer reserves the right to cancel the order at any time, including on the day of loading, without incurring any costs on this account, to which the Contractor firmly agrees.
5. Receivables under this Contract may be assigned (transferred) to third parties only with the prior written consent of the Employer under pain of nullity. Such Consent can only be given by the Chairman of the Board of Directors or the Proxy.
6. The Employer shall have the right to set off/deduct all contractual penalties under this mandate contract and other receivables from the amount of the Contractor's contractual remuneration. The contractual penalty may also be deducted from the amount of compensation based on a debit note. Before offsetting, the Employer shall notify the Contractor in writing of the amount and basis of the stipulated penalties and other amounts due and shall issue an accounting note to the Contractor.
7. The currency of the freight remuneration is specified on the order document.
8. The Contractor shall issue a VAT invoice following the Law on Value-Added Tax according to the average exchange rate of the National Bank of Poland on the day preceding the unloading.
9. The Contractor declares that he has taken out and paid up third-party liability insurance with a guaranteed amount not less than the value of the cargo being transported, with a clause of protection for damage involving theft or robbery, as well as the required licenses and permits to perform domestic and international transport, copies of which he will attach to the statement of acceptance of the order.
10. The Contractor shall send by registered mail to the Employer at the address: Royal Impero Sp. z o.o. Al. Jana Pawła II 27, 00-867 Warsaw, and emails, all documents from the transport (original waybill in at least two copies, other original documents that he received on loading/unloading such as Stock Issue Confirmation (CI), pallet receipts and others) within 48 hours of the execution of the mandate contract understood as unloading at the recipient's. If the documents are not sent within this period, payment for the services rendered will be extended to 90 days, calculated from the date of receipt of the invoice and all documents from the transport to the Employer.
11. In the event of a delay in the delivery of the documents listed in paragraph 10 beyond 5 calendar days, the Employer will charge the Contractor a contractual penalty of EUR 100. In addition, the Employer shall have the right to claim damages above the liquidated damages.
12. The Contractor's driver shall be responsible for the proper loading, positioning, securing, securing and transporting of cargo. In particular, the Contractor's driver is required to attend to the loading and unloading of the goods, compare the conformity of the goods with the contents of the documents received, the CMR letter and the specifications as to quantity and weight, and check that the goods are intact. In case of any discrepancy, or inability to perform the abovementioned activities, the Contractor shall immediately notify the Employer in writing (email or via the appropriate communicator). Any discrepancies must be noted by the Contractor's driver in the CMR letter. The cargo space of the means of transport should be clean, tight, dry and free of odours. The Contractor is obliged to provide a vehicle that allows the loading of the entire cargo to be transported.
13. If the Contractor takes equipment at the place of loading without the Employer's written consent to secure the cargo for transportation, the Contractor shall be charged with all costs arising therefrom.
14. The Contractor shall inform the Employer and the consignee of the shipment before unloading about the apparent damage to the goods and enter the objections in the bill of lading, as well as take photos of the damage and send them immediately by email or through an appropriate communicator to the Employer.
15. The Contractor is obliged to notify the Employer of any deviations from the contractual conditions (including stoppages caused by the shipper/unloader) arising during transportation within 1 hour of their occurrence (these circumstances must also be confirmed by documents, e.g., an entry on a stoppage card described and stamped by the shipper/unloader).
16. If a pallet exchange is required and does not occur at the time of loading, the Contractor is obliged to return the pallets to the shipper within 14 days from the loading date. Failure to return the pallets will result in the Contractor's obligation to pay a penalty of EUR 18 for each missing item plus administrative costs of EUR 15 for the issuance of a note by the Employer. The pallets can no longer be returned. The Contractor is required to deliver original pallet receipts to the Employer. The Employer reserves the right to withhold freight payment or to deduct the value of unreturned pallets if original pallet receipts are not delivered to the Employer or if the Contractor's driver signs a pallet receipt if the mandate contract did not include pallet exchange. Only new pallets will be accepted for replacement.
17. The Contractor's driver at the place of unloading the goods shall confirm receipt of the goods with a legible signature of an authorized person
by the consignee and stamped by the consignee on the CMR bill of lading and the Stock Issue Confirmation (CI) or other delivery document received (delivery note, Lieferschein). The owner or employee of the consignee's company is considered the authorized person to receive the goods. In the case of delivery to a construction site - the construction manager or foreman, whose name the driver should obtain from the Employer. In case of lack of proper signatures and stamps or lack of signatures and seals on the waybill specified in this section, the Employer shall charge the Contractor a contractual penalty of EUR 100. Furthermore, the Employer shall have the right to claim damages above the contractual penalty from the Contractor.
18. If the goods are transported by refrigerated truck, the Contractor shall check the condition of the goods, in particular, the temperature of the goods substituted for loading and the substance and appearance of the goods. If it is determined that the commodity supplied for loading is thawed, or frost-bitten in the case of plants, fruits and vegetables, as well as wilted or spoiled, even only to a small extent, or the commodity was not in cold storage before loading, the Contractor shall notify the Employer in writing and await their instructions. Along with the documents referred to in item 2 of this mandate contract, the Contractor shall also deliver to the Employer the original thermograph printout, under the pain of withholding payment by the Employer until the original thermograph printout is received. In the absence of the original thermograph printout, the Employer shall have the right to claim a contractual penalty from the Contractor in the amount of 50% of the freight cost. In addition, the Employer shall have the right to claim damages above the contractual penalty from the Contractor.
19. The Contractor's driver at the place of unloading of the goods shall write on the CMR waybill, Stock Issue Confirmation (CI) or other received delivery document (delivery note, Lieferschein) the date and time of delivery of the goods.
20. It is absolutely forbidden to unload and leave the goods, including copies of shipping documents (CMR, Stock Issue Confirmation (CI)), in a place not designated for this in the waybill. If the location of unloading raises concerns about the customer's credibility, the Employer should be contacted before unloading, and written confirmation of the release of goods should be obtained.
21. The Contractor may entrust the execution of the order to a third party only with the written or email consent of the Employer. The Contractor may charge the means of transportation with other goods during the execution of the order only with the written or emailed Consent of the Employer. The Contractor may transship cargo only with the written or email consent of the Employer. In the event of a violation of any of the conditions of the above paragraph, the Contractor shall pay the Employer a contractual penalty of 50% of the freight. The Employer shall have the right to claim damages above the liquidated damages.
22. The Employer shall not be liable for any delay in the loading date beyond his control (e.g., caused by the shipper of the goods or force majeure).
23. 24h free of charge for loading/unloading or customs clearance in EU countries and 48h free of charge for loading/unloading or customs clearance outside the EU. 72h free of charge for loading/unloading in the case of loading/unloading falling on a Friday and the need to stop until Monday. Before the expiration of the said period, the Contractor shall not, without the written Consent of the Employer, move away from the place of loading/unloading or the location of customs clearance, which shall be treated as a withdrawal from the execution of the order and the Contractor shall pay a contractual penalty of 50% of the agreed freight and charge all other costs related to the organization of a replacement car. The Employer shall have the right to claim damages above the liquidated damages.
24. In the event of non-performance or improper performance of this mandate contract by the Contractor (by which the parties understand, in particular, failure to provide a means of transport at the place of loading, providing a means of transport that does not meet the requirements necessary for carriage, abandonment of loading and departure from the site of loading without the Consent of the Employer, loss or misuse of documents, failure to perform or improper performance of instructions for the disposition of goods, delay in providing a set of documents, failure to comply with the obligation to provide information, the occurrence of differences in the actual weight or quantity of goods concerning the order or to the entry in the CMR waybill, total or partial loss of goods or damage to goods or packaging of goods between the time of acceptance of goods for carriage and their release), the Contractor shall pay to the Employer a contractual penalty equal to 80% of the freight. The Employer shall have the right to claim damages above the liquidated damages.
25. In the event of failure to provide a means of transport for loading on time, the Contractor shall pay a contractual penalty in the amount of 3% of the freight value for each commenced hour of delay concerning the deadline (hour) established in the order. The Employer shall have the right to claim damages above the liquidated damages.
26. If the cargo is not delivered on time to its destination, the Contractor shall pay a contractual penalty equivalent to 50% of the agreed freight. The Employer shall have the right to claim damages above the liquidated damages.
27. If the execution of the mandate contract is withheld or the goods are hidden, or other actions are taken by the Contractor or entities dependent on him or used by him to execute this mandate contract, which prevents the proper and timely execution of the Contract due to the fault of the Contractor, the Employer shall be entitled to charge the Contractor with a contractual penalty of EUR 100,000, and in addition, to notify the relevant state authorities, freight exchanges and its counterparties, including the owner of the goods, the shipper and the consignee, of the culpable actions. It is considered a culpable withholding of contract performance to make the execution of the mandate contract conditional on the payment of freight before the implementation of the mandate contract, as well as to demand the payment of freight for previous orders performed for the Employer, even if the receivables are already due. The Employer shall have the right to claim damages above the liquidated damages.
28. The amount of contractual penalties provided for in this mandate contract has been determined by the Employer, taking into account the damage that may result from the non-performance or improper performance of the order by the Contractor, in particular through contractual penalties imposed by the Employer's counterparties, claims for damages asserted by the contractors against the Employer, as well as taking into account the damage resulting from the loss of reputation by the Employer in the international transport market necessary to attract new customers, loss of existing customers, loss or undermining of credibility on transport exchanges. The contractual penalties provided for in this mandate contract shall also apply if the Employer has not suffered any damage. If the damage exceeds the amount of the contractual penalty in question, the Employer shall, in any case, be entitled to claim compensation under the general rules.
29. The Employer's Counterparty claims for late delivery shall be reinvoiced to the Contractor.
30. The Contractor shall be liable for all additional charges related to the transportation performed, not included in the Contract and not agreed with the Employer.
31. Any information obtained by the Contractor or persons acting on behalf of the Contractor from the Employer or persons acting on behalf of the Employer during the term of the Contract as well as for three years after its execution, which is not publicly available, shall be treated by the Contractor as confidential (Company Secret). The Contractor is prohibited from submitting (or informing about the content of) any contracts, settlements, agreements, provisions and other arrangements that the Contractor has made with the Employer to third parties, in particular to the Employer's counterparties, the shipper of the goods, the consignee of the goods, their employees or representatives. The Contractor shall also be obliged to keep confidential all information relating to the Employer's business, particularly the data and addresses of the Employer's counterparties. The freight specified by this mandate contract includes the remuneration for preserving company secrets. In the event of violating the conditions described in the preceding sentences, the Contractor shall pay the Employer a contractual penalty of PLN 100,000.00 (one hundred thousand zlotys). The Employer shall have the right to claim damages from the Contractor above the liquidated damages.
32. The Contractor agrees not to engage in any activity that competes with the Employer during the term of this agreement and for three years after its execution. By competitive activity, the parties understand the establishment of business relations by the Contractor or persons acting on its behalf or for its benefit in the field of shipping and transportation services with the Employer's counterparty. In the event of violating the conditions described in the preceding sentences, the Contractor shall pay the Employer a contractual penalty of PLN 100,000.00 (one hundred thousand zlotys). Furthermore, the Employer shall have the right to claim damages from the Contractor above the contractual penalty.
33. The Parties declare that in matters not regulated by this Contract, the provisions of the Convention on the Contract for the International Carriage of Goods by Road (CMR) and the relevant provisions of Polish law, in particular, the Transport Law and the Civil Code Act shall apply.
34. The parties agree that all disputes arising out of or in connection with this Contract shall be settled by the common court of material jurisdiction in Warsaw (contractual jurisdiction).
Translation - Bulgarian УСЛОВИЯ НА ВЪЗЛАГАНЕ:
1. Настоящият договор за поръчка се предава на другата Страна в писмена форма, по факс или електронна поща. Независимо от начина на предаване, то обвързва Страните. Всички страници на договора за поръчка представляват неразделна част от него. Този договор за поръчка може да бъде приет само без възражения. При липса на писмен отказ за приемане на договора за поръчка за изпълнение в рамките на 30 минути от получаването му се счита, че договорът за поръчка е изцяло приет и одобрен. Всяко искане за повторно потвърждаване на условията на договора за поръчка, повторно запитване относно валидността на договора за поръчка или други подобни действия от страна на Изпълнителя не засягат валидността на договор за поръчка, който се счита за сключен и приет без възражения в първоначалния вариант, предоставен от Възложителя.
2. Датата на плащане се изчислява от момента на получаване на оригиналната правилно издадена фактура с комплект оригинални и правилно попълнени, подписани и подпечатани всички необходими документи, като се вземат предвид правилата за плащане, действащи при Възложителя, според които преводите се извършват веднъж седмично, т.е. всеки четвъртък. Поради това срокът за плащане може да бъде удължен или съкратен с няколко дни, с което Изпълнителят се съгласява и няма да предявява никакви бъдещи претенции по тази причина. Необходимите документи, които са нужни за правилното разплащане по изпълнението на договора за поръчка между Възложителя и неговия контрагент, са по-специално оригиналният коносамент в най-малко два екземпляра и други оригинални документи, издадени на Изпълнителя при товарене/разтоварване, като например Потвърждение за Освобождаване на Стоките (CI), документи за доставка (товарителница, Lieferschein), разписки за палети, митнически документи и други. В случай на липса на доставка или непълнота (напр. липса на подписи/печати) на необходимите документи или предоставяне на фотокопия на документи или документи, които пораждат съмнения относно тяхната автентичност, Възложителят си запазва правото да задържи плащането за транспорт до отстраняване на недостатъците. Плащането ще се извърши по банковата сметка, посочена във ДДС фактурата, издадена от Изпълнителя.
3. В случай на спор с Възложителя относно плащането, Изпълнителят няма право да се свързва с изпращача или получателя на стоките, за да ги информира за липсата на плащане или да търси обезщетение директно от тях. В случай на нарушаване на горната забрана Възложителят има право да поиска неустойка в размер на общата сума на товара. Възложителят има право да претендира за обезщетение за вреди над неустойката.
4. Възложителят си запазва правото да анулира поръчката по всяко време, включително в деня на товарене, без да поема каквито и да било разходи за тази сметка, с което Изпълнителят категорично се съгласява.
5. Вземанията по този Договор могат да бъдат начислени (прехвърлени) на трети лица само с предварителното писмено съгласие на Възложителя при риск от недействителност. Такова Съгласие може да бъде дадено само от Председателя на Съвета на Директорите или от Пълномощника.
6. Възложителят има право да прихване/отчете всички неустойки по настоящия договор за поръчка и други вземания от размера на договорното възнаграждение на Изпълнителя. Договорната неустойка може да бъде приспадната и от сумата на обезщетението въз основа на дебитно известие. Преди прихващането Възложителят уведомява писмено Изпълнителя за размера и основанието на предвидените неустойки и други дължими суми и издава счетоводна бележка на Изпълнителя.
7. Валутата на възнаграждението за превоз се посочва в документа за поръчка.
8. Изпълнителят издава фактура за ДДС съгласно Закона за Данъка Върху Добавената Стойност по средния обменен курс на Националната Банка на Полша в деня, предхождащ разтоварването.
9. Изпълнителят декларира, че е сключил и изплатил гражданска отговорност на застрахования за щети на трети лица с гарантирана сума, не по-малка от стойността на превозваните товари, с клауза за защита при щети, свързани с кражба или грабеж, както и необходимите лицензи и разрешителни за извършване на вътрешен и международен транспорт, копия от които ще приложи към декларацията за приемане на поръчката.
10. Изпълнителят трябва да изпрати с препоръчана поща на Възложителя на адреса: Роял Имперо Сп. з о.о. (Royal Impero Sp. z o.o.) Ал. (Al.) Jana Pawła II 27, 00-867 Варшава, и имейли, всички документи от транспорта (оригинален пътен лист в най-малко две копия, други оригинални документи, които е получил при товарене/разтоварване, като например Потвърждение за Освобождаване на Стоките (CI), разписки за палети и други) в рамките на 48 часа от изпълнението на договора за поръчка, разбирано като разтоварване при получателя. Ако документите не бъдат изпратени в рамките на този срок, плащането за предоставените услуги ще бъде удължено до 90 дни, считано от датата на получаване на фактурата и всички документи от транспорта на Възложителя.
11. В случай на забавяне на доставката на документите, изброени в параграф 10, с повече от 5 календарни дни, Възложителят ще начисли на Изпълнителя неустойка в размер на 100 EUR. Възложителят има право да претендира за обезщетение за вреди над неустойката.
12. Шофьорът на Изпълнителя е отговорен за правилното натоварване, позициониране, закрепване, обезопасяване и транспортиране на товара. По-специално, шофьорът на Изпълнителя е длъжен да следи за товаренето и разтоварването на стоките, да сравнява съответствието на стоките със съдържанието на получените документи, CMR товарителница и спецификациите за количество и тегло, както и да проверява дали стоките са с ненарушена цялост. В случай на несъответствие или невъзможност за изпълнение на горепосочените дейности, Изпълнителят трябва незабавно да уведоми Възложителя в писмен вид (по електронна поща или чрез съответния комуникатор). Всички несъответствия трябва да бъдат отбелязани от шофьора на Изпълнителя в CMR товарителницата. Товарното пространство на превозното средство трябва да бъде чисто, плътно, сухо и без миризми. Изпълнителят е длъжен да осигури превозно средство, което да позволява натоварването на целия товар, който трябва да бъде транспортиран.
13. Ако Изпълнителят вземе оборудване на мястото на натоварване без писменото съгласие на Възложителя, за да обезопаси товара за транспортиране, Изпълнителят поема всички произтичащи от това разходи.
14. Изпълнителят е длъжен да информира Възложителя и получателя на пратката преди разтоварването за видимите повреди на стоките и да впише възраженията в товарителницата, както и да направи снимки на повредите и да ги изпрати незабавно по електронна поща или чрез подходящ комуникатор на Възложителя.
15. Изпълнителят е длъжен да уведомява Възложителя за всички отклонения от договорните условия (включително за спирания, причинени от изпращача/разтоварача), възникнали по време на превоза, в рамките на 1 час от настъпването им (тези обстоятелства трябва да бъдат потвърдени и документално, напр. запис в картата за спиране, описана и подпечатана от изпращача/разтоварача).
16. Ако е необходима замяна на палети и тя не се осъществи по време на товаренето, Изпълнителят е длъжен да върне палетите на изпращача в срок от 14 дни от датата на товарене. При невъзможност за връщане на палетите Изпълнителят ще бъде задължен да заплати неустойка в размер на 18 EUR за всеки липсващ артикул плюс административни разходи в размер на 15 EUR за издаване на бележка от Възложителя. Палетите вече не могат да бъдат връщани. Изпълнителят е длъжен да предаде на Възложителя оригинални разписки за палети. Възложителят си запазва правото да удържи плащането на навлото или да приспадне стойността на невърнатите палети, ако на Възложителя не са предоставени оригинални разписки за палети или ако шофьорът на Изпълнителя подпише разписка за палети, ако договора за поръчка не включва размяна на палети. За замяна се приемат само нови палети.
17. Шофьорът на Изпълнителя на мястото на разтоварване на стоките трябва да потвърди получаването на стоките с четлив подпис на упълномощено лице
от получателя и да постави печат на получателя върху CMR товарителницата и Потвърждение за Освобождаване на Стоките (CI) или друг получен документ за доставка (товарителница, Lieferschein). Собственикът или служителят на фирмата на получателя се счита за упълномощено лице да получи стоките. В случай на доставка до строителна площадка - ръководителят на строителството или бригадирът, чието име шофьорът трябва да получи от Възложителя. В случай на липса на надлежни подписи и печати или липса на подписи и печати върху товарителницата, посочена в този раздел, Възложителят начислява на Изпълнителя неустойка в размер на 100 EUR. Възложителят има право да претендира за обезщетение за вреди над неустойката.
18. Ако стоките се превозват с хладилен камион, Изпълнителят трябва да провери състоянието на стоките, по-специално температурата на стоките, заменени за натоварване, както и съдържанието и външния вид на стоките. Ако се установи, че стоката, доставена за товарене, е размразена или измръзнала в случай на растения, плодове и зеленчуци, както и увехнала или развалена, дори и в малка степен, или стоката не е била на хладно съхранение преди товаренето, Изпълнителят трябва да уведоми писмено Възложителя и да изчака неговите указания. Заедно с документите, посочени в т. 2 от настоящия договор за поръчка, Изпълнителят трябва да предаде на Възложителя и оригиналната термографска разпечатка, под заплаха от задържане на плащането от страна на Възложителя до получаване на оригиналната термографска разпечатка. При липса на оригинална термографска разпечатка Възложителят има право да поиска от Изпълнителя неустойка в размер на 50 % от стойността на превоза. В допълнение, Възложителят има право да претендира за обезщетение за вреди над неустойката от Изпълнителя.
19. Шофьорът на Изпълнителя на мястото на разтоварване на стоките вписва в CMR товарителницата, Потвърждението за Освобождаване на Товари (CI) или друг получен документ за доставка (товарителница, Lieferschein) датата и часа на доставка на стоките.
20. Абсолютно забранено е разтоварването и оставянето на стоките, включително копия на транспортните документи (CMR, Потвърждение за Освобождаване на Товари (CI)), на място, което не е определено за това в товарителницата. Ако мястото на разтоварване поражда съмнения относно надеждността на клиента, преди разтоварването трябва да се установи контакт с Възложителя и да се получи писмено потвърждение за освобождаването на стоките.
21. Изпълнителят може да възложи изпълнението на поръчката на трето лице само с писменото или електронно съгласие на Възложителя. Изпълнителят може да зарежда транспортните средства с други стоки по време на изпълнението на поръчката само с писменото или изпратено по електронна поща съгласие на Възложителя. Изпълнителят може да трансбордира товари само с писменото или електронно съгласие на Възложителя. В случай на нарушение на някое от условията на горния параграф, Изпълнителят заплаща на Възложителя неустойка в размер на 50% от стойността на превоза. Възложителят има право да претендира за обезщетение за вреди над неустойката.
22. Възложителят не носи отговорност за забавяне на датата на натоварване, което е извън неговия контрол (напр. причинено от изпращача на стоките или от форсмажорни обстоятелства).
23. 24 часа безплатно за товарене/разтоварване или митническо оформяне в страните от ЕС и 48 часа безплатно за товарене/разтоварване или митническо оформяне извън ЕС. 72 часа безплатно за товарене/разтоварване в случай, че товаренето/разтоварването се пада в Петък и е необходимо да спре до Понеделник. Преди изтичането на посочения срок Изпълнителят няма право, без писменото съгласие на Възложителя, да се отдалечава от мястото на товарене/разтоварване или от мястото на митническо оформяне, което се счита за отказ от изпълнението на поръчката и Изпълнителят заплаща неустойка в размер на 50 % от договореното навло и поема всички други разходи, свързани с организирането на заместващ автомобил. Възложителят има право да претендира за обезщетение за вреди над неустойката.
24. В случай на неизпълнение или лошо изпълнение на настоящия договор за поръчка от страна на Изпълнителя (под което страните разбират по-специално неосигуряване на транспортно средство на мястото на натоварване, предоставяне на транспортно средство, което не отговаря на необходимите изисквания за превоз, изоставяне на натоварването и напускане на мястото на натоварване без съгласието на Възложителя, загуба или злоупотреба с документи, неизпълнение или лошо изпълнение на инструкции за разпореждане със стоките, забавяне на предоставянето на комплект документи, неизпълнение на задължението за предоставяне на информация, възникване на разлики в действителното тегло или количество на стоките относно поръчката или спрямо вписването в CMR товарителницата, пълна или частична загуба на стоките или повреда на стоките или опаковката на стоките между момента на приемане на стоките за превоз и тяхното освобождаване), Изпълнителят заплаща на Възложителя неустойка в размер на 80 % от стойността на превоза. Възложителят има право да претендира за обезщетение за вреди над неустойката.
25. В случай на непредоставяне на транспортно средство за товарене навреме, Изпълнителят заплаща неустойка в размер на 3% от стойността на товара за всеки започнат час закъснение спрямо крайния срок (час), установен в поръчката. Възложителят има право да претендира за обезщетение за вреди над неустойката.
26. Ако товарът не бъде доставен навреме до местоназначението му, Изпълнителят заплаща неустойка в размер на 50 % от договореното навло. Възложителят има право да претендира за обезщетение за вреди над неустойката.
27. Ако изпълнението на договора за поръчка бъде задържано или стоките бъдат укрити, или бъдат предприети други действия от Изпълнителя или от зависими от него или използвани от него лица за изпълнение на този договор за поръчка, които възпрепятстват правилното и навременно изпълнение на Договора по вина на Изпълнителя, Възложителят има право да начисли на Изпълнителя неустойка в размер на 100 000 EUR, и в допълнение да уведоми за виновните действия съответните държавни органи, борсите за превоз на товари и своите контрагенти, включително собственика на стоките, изпращача и получателя. За виновно задържане на изпълнението на договора се счита поставянето на изпълнението на договора за поръчка зависимо от плащането на навлото преди изпълнението на договора за поръчка, както и изискването за плащане на навлото за предишни поръчки, изпълнени за Възложителя, дори ако вземанията вече са изискуеми. Възложителят има право да претендира за обезщетение за вреди над неустойката.
28. Размерът на неустойките, предвидени в настоящия договор за поръчка, е определен от Възложителя, като са взети предвид вредите, които могат да възникнат от неизпълнението или неточното изпълнение на поръчката от страна на Изпълнителя, по-специално чрез неустойки, наложени от контрагентите на Възложителя, претенции за обезщетение, предявени от изпълнителите към Възложителя, както и като са взети предвид вредите, произтичащи от загубата на репутацията на Възложителя на международния транспортен пазар, необходима за привличане на нови клиенти, загубата на съществуващи клиенти, загубата или подкопаването на доверието в транспортните борси. Предвидените в настоящия договор за поръчка неустойки се прилагат и ако Възложителят не е претърпял вреди. Ако щетите надхвърлят размера на въпросната договорна неустойка, Възложителят във всички случаи има право да поиска обезщетение съгласно общите правила.
29. Претенциите на контрагента на Възложителя за забавена доставка се префактурират на Изпълнителя.
30. Изпълнителят е отговорен за всички допълнителни разходи, свързани с извършения транспорт, които не са включени в договора и не са съгласувани с Възложителя.
31. Всяка информация, получена от Изпълнителя или от лица, действащи от името на Изпълнителя от Възложителя или от лица, действащи от името на Възложителя, по време на действието на договора, както и в продължение на три години след неговото изпълнение, която не е публично достъпна, се третира от Изпълнителя като поверителна (Фирмена Тайна). На Изпълнителя се забранява да представя (или да информира за съдържанието на) каквито и да било договори, спогодби, споразумения, разпоредби и други договорености, които Изпълнителят е сключил с Възложителя, на трети лица, по-специално на контрагентите на Възложителя, изпращача на стоките, получателя на стоките, техните служители или представители. Изпълнителят е длъжен също така да пази в тайна цялата информация, свързана с дейността на Възложителя, и по-специално данните и адресите на контрагентите на Възложителя. Превозът, определен в този договор за поръчка, включва възнаграждението за опазване на фирмените тайни. В случай на нарушаване на условията, описани в предходните изречения, Изпълнителят ще заплати на Възложителя неустойка в размер на 100 000,00 PLN (сто хиляди злоти). Source text - English TERMS AND CONDITIONS
This document, together with any documents herein mentioned, sets forth the terms and conditions (“Terms and Conditions”) governing this project named Get In Visual Commercials (the “Project”) and the specific use of the GET IN app (the “App”) for the Project. By using this App and/or participating in the Project the User is consenting to be bound by these Terms and Conditions.
1. Acceptance of the Terms and Conditions
1.1 Access to, navigation and use of the App and the Project is optional and under the sole responsibility of the User, as set forth in these Terms and Conditions.
1.2 The use of this App and participation in the Project is subject to these Terms and Conditions. These Terms and Conditions are not a part of the User’s labour contract. The User’s commitments related to the participation in the Project are regulated solely by these Terms and Conditions and the Privacy Policy, and no additional documents shall be signed / issued by the User or his/her respective employer for the performance of the Project. The User must read and accept these Terms and Conditions before using and completing the process of registration and participation. If the User does not accept the Terms and Conditions, they will not be able to and must not use the App for these purposes or participate in the Project.
1.3 This use of the App and participation in the Project is reserved for certain employees working as Visual Commercials in the Inditex Group in UK, Ireland, Italy, Sweden, Denmark, Norway, Finland, Germany, Czech Republic, Slovakia, Hungary, Romania, Bulgaria, Kazakhstan, Croatia, Bosnia & Herzegovina, Slovenia, Northern Macedonia, Serbia, Montenegro, Kosovo, Albania, Austria, Belgium and Luxemburg, The Netherlands, Switzerland, Belorussia, France, (the “User/s”).
1.4 The participation and use of the App, as well as participation in the Project, is on a fully voluntary and individual basis.
2. Description of the Project
2.1 The Project consists of an evaluation of the current working conditions of the Users through a different set of questions, games and interactions within the App. The aim of the Project is to better understand the current situation of the Visual Commercials, knowing their needs and concerns to be able to offer them some improvements which may result in a decrease of turnover.
2.2 More specifically, the aspects of the working conditions of the Users that will be evaluated are: working environment, personal development, emotional wellbeing, physical wellbeing, interpersonal relationships, material wellbeing, benefits and social inclusion.
2.3 The Human Resources Department shall not have access to the identity of the Users. That means that the usage of the App will be completely anonymous.
2.4 Each screen/step of the App consists of a series of questions enquiries, which the employee will have to complete within a certain time frame and before acceding to the next questions. There are no correct or incorrect answers.
2.5 The User (as per the definition above) will have to complete some questions and tests about the topics highlighted in paragraph 2.2 above.
3. Access to the App and participation in the Project
3.1 The User must register or access the INET of the Inditex Group before accessing Get In.
3.2 During the User registration and verification process in Get In, credentials shall be exchanged in order to confirm that the App that is being accessed is secure and that the User is an employee of the Inditex Group.
Once a secure connection has been established, the App shall have access to specific User information.
3.3 User data obtained through Get In shall be protected.
3.4 With regard to the operation of the App, management of their account and access, by accepting the Terms and Conditions the User undertakes:
- Not to provide false information or create an account for other users without prior written authorisation.
- Not to create more than one personal account.
- Refrain from creating another account without the prior written consent of the Inditex Group in the event that it cancels the User’s account.
- Keep their contact information up to date.
- Not to share access or their account with other Users or perform actions that could put the App or the Inditex Group at risk.
4. Minimum Age
By accepting these Terms and Conditions, the User declares that they are older than 18 years old or that they are at least of the minimum age required to work, and, in any event, to use the App and participate in the Project. The User accepts full responsibility for this declaration.
5. Modification of the Terms and Conditions
5.1 As far as legally permitted, INDITEX expressly reserves the right to modify these Terms and Conditions without prior notice. Any modification made to the Terms and Conditions by INDITEX shall be implemented on the App upon publication.
5.2 The User acknowledges and accepts that it is their responsibility to check the App and these Terms and Conditions. Therefore, INDITEX invites the User to carefully read the Terms and Conditions before using the App and participating in the Project. However, continued use of the App by the User after such modifications shall be considered an acknowledgement and acceptance of the modifications in the Terms and Conditions by the User, and the User shall be legally bound by these new Terms and Conditions.
6. Correct Use and Restrictions of Use
6.1. The User agrees to use the App and participate in the Project in accordance with the applicable and current legislation, these Terms and Conditions, good customs and public order. Likewise, the User undertakes not to use the App and the Project, their contents or the services provided through them for purposes or effects that are illegal or contrary to the content of these Terms and Conditions, harmful to the interests or rights of third parties or that may, in any way, damage, disable, make inaccessible or deteriorate the App or the Project, its contents, or its services or prevent the normal use of it by other Users.
The User may not impersonate the identity of other Users to access different services and/or content on the App by using their passwords or by other means.
6.2. INDITEX always reserves the right (without being subject to any obligation in this case) to remove or reject the distribution of any content without the Users being responsible for this motive. Similarly, INDITEX reserves the right to access, read, keep and disclose any information it deems reasonably necessary in order to (1) comply with applicable laws, regulations, legal proceedings or government requests; (2) ensure compliance with the Terms and Conditions, including the investigation of any possible violation of this document; (3) detect, prevent, or in any other way take a stand against fraud, security problems or technical issues; (4) address the assistance requests of users; or (5) protect the rights, properties or safety of INDITEX and/or its users or third parties. Likewise, INDITEX reserves the right to analyse the activities of the Users in case of suspected abuse, discriminating conduct, privacy violation or other exceptional circumstances. INDITEX will only be able to exercise this control if it has an overriding interest in protecting both the legitimate commercial interests of any company of the INDITEX Group and the privacy interest of employees and if the action is proportional. The Users acknowledge and agree to use the App for professional purposes. In addition, the User shall use the App only for the purposes for which it is intended.
6.3 The User guarantees that, where applicable (i) the content provided does not contain the picture of a third party different from the User without the consent of the third party or parties in question; (ii) they shall not show or share the photos of minors, except where the relevant content has been submitted by the father, mother, guardian or legal representative of the minor if the minor does not object to such use; (iii) the content does not violate the rights (including, for example, intellectual property rights, industrial property rights, right to personal image or personal privacy, or any other right) or the interests of third parties, or any applicable rule or regulation (including Spanish, international or any other rules or regulations); (iv) the content does not contain any element that could be considered offensive or discriminatory (whether on the basis of, including but not limited to, race, religion, gender, disability, national origin, sexual orientation, political or union affiliation, among others), illegal, threatening, slanderous, defamatory, obscene, pornographic or indecent or inappropriate in any other way towards any third party, any of the brands of the Inditex Group or the Inditex Group itself.
6.4 The User expressly agrees not to destroy, change, disable or in any other way damage the equipment, tools, data, programs or electronic documents found in the App or in the Project.
6.5 The User undertakes not to hinder other Users of the App or the Project by excessive consumption of computer resources (or other resources) used by INDITEX to provide the App and some parts of the Project and not to take any action that could cause damage, interruptions or errors in such systems or resources.
6.6 The User undertakes not to introduce programs, viruses, macros, applets, ActiveX controls, or any other logical device or sequence of characters that cause or may cause an alteration to the computer systems of INDITEX or third parties. The User must comply with the corporate policies/guidelines related to the proper use of the tools/equipment of the Inditex Group, especially in cases in which the App or some parts of the Project are run using the tools/equipment of the Inditex Group.
6.7 Unless otherwise indicated in the section “Specific Market Provisions”, which takes precedence, the use of the App and/or the necessary training, if any, shall take place during business hours, with such use being considered to fall under paid time, and the User shall earn their usual payments in accordance with their labour conditions. If the User voluntarily decides to use the App outside of their working hours, this time shall not be considered working time and the User shall not receive any payment for it. In any event, the use of the App must take place without disrupting the normal activities of the Inditex Group nor interfering with the normal functions of the Users or any other employee of the Inditex Group.
6.8 The User acknowledges that their simple use of the App and participation in the Project does not automatically imply any right or expectation regarding a change in their work, a benefit or substantial change in their current functions, their pay level or any other past or current employment conditions. The employment relationship of the current User with the entity employing them, where applicable, remains unchanged until further communication is done to the employee, if that were the case. Nothing in this App or the Project shall provide any additional employment rights (past, present, or future) apart from those specifically explained in these T&C or imply responsibility in this sense on the part of Inditex or any other entity of the Inditex Group participating in the Project.
6.9 The participation in the Project or the usage of the App shall not be understood to constitute an employment contractual relationship or create any sort of employment agreement between the Users and their employer in those cases in which there are not contracts or agreements signed between the User and their employer.
7. Limitation of Warranty and Liability
7.1 The User expressly accepts that they use the App at their own risk.
7.2 To the extent permitted under applicable law, INDITEX shall not be liable for the irregularities that may exist in the content created, published, provided and/or made available by the Users or for any damages that could result from the addition of content to the sections allowed in the App. INDITEX shall not be liable for content sent by the Users when it has not been duly informed that the stored information is illegal or harms the assets or rights of a third party liable to compensation. As soon as INDITEX is duly informed of the storage of such data, it undertakes to act with due diligence to remove said data or prevent access to it.
7.3. As far as possible, INDITEX undertakes to make every effort to guarantee the quality of the App and avoid any error in its content and operation.
7.4 INDITEX does not guarantee the availability of the App and reserves the right to suspend it at any time or to unilaterally remove from it any content it deems necessary.
7.5 Non-compliance with the Terms and Conditions or any other rules in effect entitles INDITEX to apply the measures and/or sanctions it considers necessary, in accordance with the applicable legislation. The company in charge of implementing and enforcing these Terms and Conditions shall be that which is the employer of the User from time to time.
7.6 Since the User acknowledges and accepts that Pumpúm Dixital (not INDITEX) is the owner and final manager of the App:
7.6.1 INDITEX shall be exempt from all responsibility in the event of any malfunctioning in the electronic communication networks that hinders the normal operation of the App due to reasons outside of the control of INDITEX and, in particular, due to malicious acts by external parties.
7.6.2 INDITEX shall also not be responsible for problems of transmission or data loss that cannot be attributed to INDITEX.
7.6.3 INDITEX shall be exempt from any responsibility resulting from any errors in content that could appear in the App, as well as any malfunction outside of its control.
7.7 INDITEX reserves the right to block or ban any User that uses the App incorrectly.
7.8 In any event, all the rights guaranteed to Users by the legislation in force shall remain guaranteed.
7.9 Nothing in these Terms and Conditions (including without limitation clause 7 or clause 9) shall limit or exclude a party's liability: (i) for death or personal injury caused by negligence; (ii) for fraud or fraudulent misrepresentation; or (iii) for any other liability that cannot be limited or excluded by applicable law.
7.10 If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this paragraph shall not affect the validity and enforceability of the rest of these Terms and Conditions.
8. Intellectual and Industrial Property
The App has been created and developed by PUMPÚN DIXITAL, S.L, with CIF (tax ID code) No. B-27757723 and registered office at Calle Marqués de Valladares, 14, 36201 Vigo, Spain. This company owns and is responsible for the App.
The content included in the App belongs to INDITEX, the other companies in the Inditex Group or third parties who have authorised its use in the App.
Users may access and use the App and its content solely and exclusively for non-commercial purposes.
All rights related to the App and its content are reserved.
The Users authorise Pumpún Dixital and Inditex to reproduce the content created with and uploaded to the App and to make copies of the content and store it. INDITEX may reproduce, make copies of and use said content for recurring purposes within the Inditex Group. INDITEX may publish said content for the purposes of informing on similar actions, informing on recurring activities and activities of the human resources departments of the Inditex Group and other legitimate purposes. These rights of use are granted freely on a global level as long as the Intellectual and Industrial Property rights are in effect. Each User hereby consents to the reproduction, publication, and other use of said content as contemplated in these Terms and Conditions.
9. Policy for Hypertext Links
9.1. INDITEX shall not be held liable for the content, commercial activities, products or services that are included or can be viewed through direct or indirect electronic links via the App.
9.2. The potential presence of links on the App, unless otherwise indicated, is for information purposes only and in no case implies a suggestion, invitation or recommendation regarding them. These links do not represent any type of relationship between INDITEX and the individuals or companies owning the websites that can be accessed through these links. INDITEX reserves the right to unilaterally take down the links appearing on the App at any moment.
10. Data Protection and Privacy
The information related to Data Protection and Privacy is available to the User in the “Privacy Policy” link below (https://getinitx.com/).
11. Reporting Unfit Content
If the User believes that any of the content accessible through the App is offensive, unfit or inappropriate or that it could violate any rights, they can report said content by sending an e-mail to their HR team. In such an event, Inditex shall investigate the credibility and legitimacy of the request.
12. Applicable Law and Jurisdiction
All questions that arise between INDITEX and the User related to the interpretation, adherence to and validity of the Terms and Conditions shall be governed by these clauses and, for all matters not foreseen in these clauses, in accordance with the legislation of the User’s store location. As far as legally possible, the place of jurisdiction is agreed to be the place where the User usually carries their work, where the User last usually carried out their work or the courts corresponding to the User's address.
13. Specific Market Provisions
We would also like to inform you of the Specific Market Provisions that may apply to these Terms and Conditions.
These provisions are included below in the Appendix section of this document and are applicable to the use of the App and the Project to the extent necessary for full compliance with the local regulations in effect. If the Specific Market Provisions are no longer mandatory due to possible legislative changes in local regulations, they shall no longer be applicable for the use and operation of the App and the Project.
SPECIFIC MARKET PROVISIONS

Този документ, заедно с всички посочени в него документи, определя правилата и условията („Общи Условия"), които регулират този проект, наречен Get In Визуален Мърчъндайзър ("Проектът"), и конкретното използване на приложението GET IN ("Приложението") за Проекта. С използването на това Приложение и/или участието си в Проекта потребителят се съгласява да бъде обвързан с настоящите Общи Условия.
1. Приемане на Общите Условия
1.1 Достъпът, навигацията и използването на Приложението и Проекта не са задължителни и са изцяло на отговорността на Потребителя, както е посочено в настоящите Общи Условия.
1.2 Използването на това Приложение и участието в Проекта се подчинява на настоящите Общи Условия. Настоящите Общи Условия не са част от трудовия договор на Потребителя. Ангажиментите на Потребителя, свързани с участието му в Проекта, се уреждат единствено от настоящите Общи Условия и Политиката за Поверителност и не се подписват/издават допълнителни документи от Потребителя или от неговия/нейния работодател за изпълнението на Проекта. Потребителят трябва да прочете и приеме настоящите Общи Условия, преди да използва и завърши процеса на регистрация и участие. Ако Потребителят не приема Общите Условия, той няма да може и не трябва да използва Приложението за тези цели или да участва в Проекта.
1.3 Използването на Приложението и участието в Проекта е запазено за определени служители, работещи като Визуални Рекламисти в Inditex Group в Обединеното кралство, Ирландия, Италия, Швеция, Дания, Норвегия, Финландия, Германия, Чешката република, Словакия, Унгария, Румъния, България, Казахстан, Хърватия, Босна & Херцеговина, Словения, Северна Македония, Сърбия, Черна гора, Косово, Албания, Австрия, Белгия и Люксембург, Нидерландия, Швейцария, Белорусия, Франция ("Потребител/и").
1.4 Участието и използването на Приложението, както и участието в Проекта, са напълно доброволни и индивидуални.
2. Описание на Проекта
2.1 Проектът се състои от оценка на настоящите условия на труд на Потребителите чрез различни въпроси, игри и взаимодействия в рамките на приложението. Целта на Проекта е да се разбере по-добре настоящата ситуация около Визуалните Мърчъндайзъри, да се опознаят техните нужди и проблеми, за да могат да им се предложат някои подобрения, които могат да доведат до напускането им.
2.2 По-конкретно аспектите на условията на труд на Потребителите, които ще бъдат оценявани, са: работна среда, личностно развитие, емоционално благополучие, физическо благополучие, междуличностни отношения, материално благополучие, обезщетения и социално приобщаване.
2.3 Отдел "Човешки ресурси" няма достъп до самоличността на Потребителите. Това означава, че използването на Приложението ще бъде напълно анонимно.
2.4 Всеки екран/стъпка на Приложението се състои от поредица от въпроси, които служителят трябва да попълни в рамките на определен период от време, преди да премине към следващите въпроси. Няма верни или грешни отговори.
2.5 Потребителят (съгласно определението по-горе) ще трябва да попълни някои въпроси и тестове по темите, посочени в параграф 2.2 по-горе.
3. Достъп до Приложението и участие в Проекта
3.1 Потребителят трябва да се регистрира или да получи достъп до INET на Inditex Group, преди да получи достъп до Get In.
3.2 По време на процеса на регистрация и проверка на Потребителя в Get In се разменят идентификационни данни, за да се потвърди, че Приложението, до което се осъществява достъп, е защитено и че Потребителят е служител на Inditex Group.
След като бъде установена защитена връзка, Приложението има достъп до конкретна информация за потребителя.
3.3 Потребителските данни, получени чрез Get In, ще бъдат защитени.
3.4 По отношение на работата с Приложението, управлението на своя акаунт и достъпа, с приемането на Общите Условия Потребителят се задължава:
- Да не предоставяте невярна информация или да не създава акаунт за други потребители без предварително писмено разрешение.
- Да не създава повече от един личен акаунт.
- Да се въздържа от създаване на друг акаунт без предварителното писмено съгласие на Inditex Group, в случай че тя анулира акаунта на Потребителя.
- Поддържа актуална информацията за контакт.
- Да не споделя достъпа или акаунта си с други Потребители и да не извършва действия, които биха могли да изложат на риск Приложението или Inditex Group.
4. Минимална Възраст
С приемането на настоящите Общи Условия Потребителят декларира, че е навършил 18 години или че е навършил поне минималната възраст, която се изисква за работа и във всеки случай за използване на Приложението и участие в Проекта. Потребителят поема пълна отговорност за тази декларация.
5. Модификация на Общите Условия
5.1 Доколкото е позволено от закона, INDITEX си запазва изрично правото да променя настоящите Общи Условия без предварително уведомление. Всяка промяна на Общите Условия, направена от INDITEX, се прилага в приложението след публикуването ѝ.
5.2 Потребителят признава и приема, че е негова отговорност да проверява Приложението и настоящите Общи Условия. Ето защо INDITEX приканва Потребителя да прочете внимателно Общите Условия, преди да използва Приложението и да участва в Проекта. Въпреки това, продължаването на използването на Приложението от Потребителя след такива промени се счита за потвърждение и приемане на промените в Общите Условия от страна на Потребителя и Потребителят е правно обвързан от тези нови Общи Условия.
6. Правилна Употреба и Ограничения на Употребата
6.1. Потребителят се съгласява да използва Приложението и да участва в Проекта в съответствие с приложимото и действащо законодателство, настоящите Общи Условия, добрите практики и обществения ред. Също така Потребителят се задължава да не използва Приложението и Проекта, тяхното съдържание или услугите, предоставяни чрез тях, за цели или последици, които са незаконни или противоречат на съдържанието на настоящите Общи Условия, увреждат интересите или правата на трети лица или които могат по някакъв начин да повредят, изключат, направят недостъпни или влошат качеството на Приложението или Проекта, неговото съдържание или услуги или да попречат на нормалното им използване от други Потребители.
Потребителят няма право да се представя за друг Потребител, за да получи достъп до различни услуги и/или съдържание в Приложението, като използва паролите му или по друг начин.
6.2. INDITEX винаги си запазва правото (без да е задължена в този случай) да премахне или да откаже разпространението на каквото и да е съдържание, без Потребителите да носят отговорност за това. По същия начин INDITEX си запазва правото на достъп, четене, съхраняване и разкриване на всякаква информация, която счита за разумно необходима, за да (1) спазва приложимите закони, разпоредби, съдебни производства или правителствени искания; (2) гарантира спазването на Общите Условия, включително разследването на всяко възможно нарушение на този документ; (3) открива, предотвратява или по какъвто и да е друг начин се противопоставя на измами, проблеми със сигурността или технически проблеми; (4) отговаря на исканията за съдействие на потребителите; или (5) защитава правата, собствеността или безопасността на INDITEX и/или неговите потребители или трети страни. Също така INDITEX си запазва правото да анализира дейностите на Потребителите в случай на съмнение за злоупотреба, дискриминационно поведение, нарушаване на неприкосновеността на личния живот или други извънредни обстоятелства. INDITEX ще може да упражни този контрол само ако има първостепенен интерес да защити както законните търговски интереси на всяко дружество от групата INDITEX, така и интересите на служителите, свързани с неприкосновеността на личния живот, и ако действието е пропорционално. Потребителите потвърждават и се съгласяват да използват Приложението за професионални цели. Освен това Потребителят трябва да използва Приложението само за целите, за които е предназначено.
6.3 Потребителят гарантира, че когато е приложимо (i) предоставеното съдържание не съдържа снимка на трета страна, различна от Потребителя, без съгласието на въпросната трета страна или страни; (ii) няма да показва или споделя снимки на непълнолетни лица, освен когато съответното съдържание е предоставено от бащата, майката, настойника или законния представител на непълнолетното лице, ако то не възразява срещу такова използване; (iii) съдържанието не нарушава права (включително например права на интелектуална собственост, права на индустриална собственост, право на личен образ или лична неприкосновеност или друго право) или интереси на трети страни, или приложимо правило или разпоредба (включително испански, международни или други правила или разпоредби); (iv) съдържанието не съдържа никакъв елемент, който би могъл да се счита за обиден или дискриминационен (независимо дали въз основа на, включително, но не само, раса, религия, пол, увреждане, национален произход, сексуална ориентация, политическа или синдикална принадлежност, наред с другото), незаконен, заплашителен, клеветнически, обиден, неприличен, порнографски или неприличен или неподходящ по какъвто и да е друг начин спрямо трета страна, някоя от марките на Inditex Group или самата Inditex Group.
6.4 Потребителят изрично се съгласява да не унищожава, променя, деактивира или поврежда по какъвто и да е друг начин оборудването, инструментите, данните, програмите или електронните документи, намиращи се в Приложението или в Проекта.
6.5 Потребителят се задължава да не пречи на другите потребители на Приложението или Проекта чрез прекомерно използване на компютърни ресурси (или други ресурси), използвани от INDITEX за предоставяне на Приложението и някои части от Проекта, и да не предприема действия, които биха могли да причинят повреда, прекъсване или грешки в тези системи или ресурси.
6.6 Потребителят се задължава да не инсталира и въвежда програми, вируси, макроси, аплети, ActiveX контроли или каквито и да било други логически устройства или поредици от символи, които причиняват или могат да причинят промяна в компютърните системи на INDITEX или на трети страни. Потребителят трябва да спазва корпоративните политики/насоки, свързани с правилното използване на инструментите/оборудването на Inditex Group, особено в случаите, когато Приложението или някои части от Проекта се изпълняват с помощта на инструментите/оборудването на Inditex Group.
6.7 Освен ако не е посочено друго в раздела "Специфични Пазарни Разпоредби", който има предимство, използването на Приложението и/или необходимото обучение, ако има такова, се извършва в работно време, като това използване се счита за платено време и Потребителят получава обичайните си плащания в съответствие с условията на труд. Ако Потребителят доброволно реши да използва Приложението извън работното си време, това време няма да се счита за работно време и Потребителят няма да получи никакво заплащане за него. Използването на Приложението трябва да се извършва винаги без да се нарушават нормалните дейности на Inditex Group, нито да се пречи на нормалните функции на Потребителите или на друг служител на Inditex Group.
6.8 Потребителят се съгласява, че обичайното му използване на приложението и участието му в проекта не означава автоматично каквото и да е право или очакване за промяна в работата му, полза или съществена промяна в настоящите му функции, нивото на заплащане или други минали или настоящи условия на труд. Трудовото правоотношение на текущия Потребител със структурата, която го наема, когато е приложимо, остава непроменено, докато не бъде извършена допълнителна комуникация със служителя, ако случаят е такъв. Нищо в това Приложение или в Проекта не предоставя никакви допълнителни трудови права (минали, настоящи или бъдещи), освен изрично обяснените в настоящите Общи Условия, и не предполага отговорност в този смисъл от страна на Inditex или на друга структура от Inditex Group, участваща в Проекта.
6.9 Участието в Проекта или използването на Приложението не трябва да се разбира като трудово договорно отношение или създаване на какъвто и да е вид трудов договор между Потребителите и техния работодател в случаите, в които няма подписани договори или споразумения между Потребителя и неговия работодател.
7. Ограничение на Гаранцията и Отговорността
7.1 Потребителят изрично приема, че използва Приложението на свой собствен риск.
7.2 Доколкото е позволено от приложимото законодателство, INDITEX не носи отговорност за нередностите, които могат да съществуват в съдържанието, създадено, публикувано, предоставено и/или направено достъпно от Потребителите, или за всякакви щети, които биха могли да възникнат от добавянето на съдържание към разрешените в Приложението раздели. INDITEX не носи отговорност за съдържание, изпратено от Потребителите, когато не е билa надлежно информиранa, че съхраняваната информация е незаконна или уврежда активите или правата на трета страна, която подлежи на обезщетение. Веднага след като INDITEX бъде надлежно информиранa за съхраняването на такива данни, тя се задължава да действа с необходимото усърдие, за да премахне тези данни или да предотврати достъпа до тях.
7.3. Доколкото е възможно, INDITEX се задължава да положи всички усилия, за да гарантира качеството на Приложението и да избегне всякакви грешки в неговото съдържание и функциониране.
7.4 INDITEX не гарантира наличността на Приложението и си запазва правото да го спре по всяко време или едностранно да премахне от него съдържание, което сметне за необходимо.
7.5 Неспазването на Общите Условия или на други действащи правила дава право на INDITEX да приложи мерките и/или санкциите, които счита за необходими, в съответствие с приложимото законодателство. 7.6 Тъй като Потребителят признава и приема, че Pumpún Dixital (а не INDITEX) е собственик и краен управител на Приложението:
7.6.1 INDITEX се освобождава от всякаква отговорност в случай на неизправност в електронните съобщителни мрежи, която възпрепятства нормалното функциониране на Приложението по причини извън контрола на INDITEX, и по-специално поради злонамерени действия на външни лица.
7.6.2 INDITEX също така не носи отговорност за проблеми с предаването или загубата на данни, които не могат да бъдат приписани на INDITEX.

7.9 Нищо в настоящите Общи Условия (включително, без да се ограничава до клауза 7 или клауза 9) не ограничава или изключва отговорността на дадена страна: (i) за смърт или телесна повреда, причинени от небрежност; (ii) за измама или измамно въвеждане в заблуждение; или (iii) за всяка друга отговорност, която не може да бъде ограничена или изключена от приложимото право.
7.10 Ако някоя от разпоредбите или част от разпоредба от настоящия договор е или стане невалидна, незаконна или неприложима, тя се счита за променена в минимално необходимата степен, за да стане валидна, законна и приложима. Ако такава промяна не е възможна, съответната разпоредба или част от разпоредба се счита за заличена. Всяка промяна или заличаване на разпоредба или част от разпоредба по настоящата клауза не засяга валидността и приложимостта на останалата част от настоящия договор.
8. Интелектуална и Индустриална Собственост
Приложението е създадено и разработено от PUMPÚN DIXITAL, S.L, с данъчен идентификационен код (CIF) № B-27757723 и регистриран офис на Calle Marqués de Valladares, 14, 36201 Виго, Испания. Тази компания е собственик на Приложението и носи отговорност за него.
Съдържанието, включено в Приложението, принадлежи на INDITEX, на другите компании от Inditex Group или на трети страни, които са разрешили използването му в Приложението.
Потребителите могат да имат достъп и да използват Приложението и неговото съдържание единствено и само за нетърговски цели.

11. Докладване на Неподходящо Съдържание
Ако Потребителят смята, че някое от съдържанието, достъпно чрез Приложението, е обидно, неизползваемо или неподходящо, или че може да наруши някакви права, той може да докладва за това съдържание, като изпрати имейл до своя екип Човешки Ресурси. В такъв случай Inditex проучва достоверността и легитимността на искането.
12. Приложимо Право и Юрисдикция
Всички въпроси, които възникват между INDITEX и Потребителя във връзка с тълкуването, спазването и валидността на Общите Условия, се уреждат от тези клаузи, а за всички въпроси, които не са предвидени в тези клаузи, в съответствие със законодателството на мястото, където се намира магазинът на Потребителя. Доколкото е възможно от правна гледна точка, се приема, че мястото на компетентност е мястото, където Потребителят обикновено извършва своята работа, където Потребителят последно е извършвал своята работа, или съдилищата, съответстващи на адреса на Потребителя.
13. Специфични Пазарни Разпоредби
Бихме искали също така да ви информираме за Специфичните Пазарни Разпоредби, които могат да се прилагат към настоящите Общи Условия.
Тези разпоредби са включени по-долу в раздела "Приложение" на настоящия документ и са приложими към използването на Приложението и Проекта до степента, необходима за пълното спазване на действащите местни разпоредби. Introduction
The right to physical and mental health is closely related to the realization of other human rights. For instance, everyone should have the right to access a wide range of resources and services to achieve optimal health. Unfortunately, when people do not have access to the aforementioned options due to stigma or discrimination, their physical and mental health is affected. Furthermore, people with disabilities frequently encounter societal obstacles since, in many countries, disabilities are associated with prejudice and discrimination and as such, they face obstacles in all aspects of their lives. These obstacles may range from obstacles in an educational setting to a professional setting. In addition to the above, people with disabilities are frequently excluded from many activities in their communities and from programs that aim to develop their competencies, such as sports for development in various contexts (UN, 2019). Surprisingly, around 15% of the global population is thought to be disabled in one or more ways and as such, they are excluded from many activities in their communities. When compared to the general population, people with disabilities usually do not enjoy the same access to opportunities for health services, education, and employment, which increases their likelihood of living in poverty. Moreover, given that people with disabilities are frequently viewed as being powerless and incapable in many societies they are less likely than those without disabilities to engage in sports, recreational, and leisure activities (WHO, 2011, Mitra, Posarac, & Vick, 2013, Brittain & Wolff, 2015).
Additionally, studies involving people with physical impairments show that participation in worthwhile activities can be boosted by merely removing environmental impediments (Law et al., 2015). Lack of adaptable options (such as activities offered at suitable hours, across many levels of expertise, and accessible venues), a lack of social support, and support or companions, a lack of resources, and the perception of stigma and discrimination in recreational areas are a few examples of these environmental barriers (Smyth, Harries, & Dorer, 2011; DeHerdt et al., 2013; Iwasaki, Coyle, Shank, Messina, & Porter, 2013). The obstacles, however, for those with intellectual disabilities go far beyond the physical surroundings and can involve assistance with organizing, planning, and funding as well as support for participating in a sport (Lante et al. 2014). Other unique physical obstacles include being too far from friends, having trouble traveling, not having enough time or money, being afraid to go out, having health problems, and not receiving enough support (Emerson & Hatton 2014). Furthermore, the ignorance of people without disabilities pertaining to the appropriate inclusion of people with disabilities in teams, along with the lack of prospects, training, and competition programs, and the scarcity of accessible facilities with accessibility issues add to the existing barriers (DePauw & Gavron 2005). Similar findings have been found in studies by McConkey et al. (2007) and Abells et al. (2008) where people with disabilities face significant challenges due to their segregated living arrangements, their economic circumstances, their ability to adapt to existing circumstances, their access to appropriate transportation means, and their lack of additional support systems.
Apart from external and physical obstacles, people with disabilities experience internal barriers. These barriers include thoughts, sentiments, and perceptions that may prevent involvement in social activities as argued by Carter-Morris and Faulkner (2003). For example, people with mental disorders frequently experience exhaustion, depression, or anxiety brought on by crowds, which makes it challenging for them to engage in activities with other people (Craik & Pieris, 2006; Roberts & Bailey, 2011). In particular, it has been found that these individuals engage far less in sports, in comparison to other people (Jong, Vanreusel, & Driel, 2011). When access to sport is denied, hindered, or limited, people with disabilities are unable to benefit from participation that is available to other demographic groups (Driver & Bruns, 1999). Compared to people without intellectual disabilities, those with intellectual impairments have worse physical and mental health, tend to be less active, tend to have an unhealthy diet, and lead more sedentary lifestyles (Emerson & Hatton 2014; Lante et al., 2014).
This is supported in research by McGuire et al. (2007) who found that a substantial percentage of people with intellectual disabilities are overweight or obese and that they are more likely to be associated with diabetes, hypertension, and cardiovascular disease. There is no doubt about the link between sedentary habits, chronic disease, and disability. For people with intellectual impairments, many of the factors that contribute to chronic disease are completely changeable (Davis et al. 2014). Similarly, the aforementioned findings are supported by researchers in Greece, who argue that due to the fact that social exclusion is inextricably linked to poverty and unemployment, limited opportunities for access to health care, education or vocational training, accessible transportation, and assistive technologies, identify people with disabilities are among those most at risk of experiencing obesity and chronic diseases among other things (Asonitou, Koutsouki & Charitou, 2010; Kalyvas, Koutsouki, Skordilis, 2011; Magoulios & Trichopoulou, 2012). Unfortunately, many people with disabilities are raised in poverty, and as such their isolation from the social activities in their communities is exacerbated. Intellectual functioning and adaptive behavior are known to be significantly limited in people with intellectual impairments, and these restrictions often start before the age of 18 as found in research by Schalock et al. (2010). Furthermore, in research conducted by Verdonschot et al. (2009), it has been found that people with intellectual disabilities, even in more affluent countries with their welfare benefits and support systems, have low levels of social involvement and a lack of friends.
Other studies on sports and disabilities concentrate on aspects such as human performance and disabilities (Burkett, 2010), body technology and disabilities (Lutgendorf, Mason, van der Woude, & Goosey-Tolfrey, 2009), psychological motivations and disabilities (Lundberg, Groff, & Zabriskie, 2010), rehabilitation (van Langeveld et al., 2011), whereas Vanner et al. (2008) have focused on the quality of life with respect to peoples’ participation in sports. It goes without saying that managing participation, support, and facilitating sports experiences requires an awareness of the barriers that individuals with disabilities face while participating in sports (Sotiriadou & Wicker, 2014). It is generally known that participation in sports may change societal perceptions of individuals with disabilities by showcasing the strengths of the latter and by lessening the inclination to emphasize the impairment instead of focusing on the individual instead. Through sport activities in any appropriate setting, individuals without disabilities may connect in a positive way with people who have disabilities, which may challenge them to reevaluate their stereotypes about the talents of those with disabilities.
It is of utmost importance to highlight that people with disabilities are transformed by sport in an equally important way since they are given the opportunity to realize their full potential and advocate for societal change. Furthermore, it has been found that those who frequently participate in sports can develop positive life skills, autonomy, and the capacity to affect change. Sport teaches people the importance of collaboration, teamwork, and respect for others as well as how to speak coherently. Getting stronger physically and mentally via sport can help people with disabilities become more independent. Unfortunately, women with disabilities are most likely to face double prejudice based on both their gender and their handicap, making the transforming effect of sport particularly important for them. With that being said, participation in sports can aid in changing stereotypes pertaining to gender and reduce negative perceptions of disabled women by allowing them to take part and display their athletic skills.
Similarly, as shown in the research by Coalter (2010) regarding mainstream sports research for disadvantaged populations such as teenagers and immigrants, participating in sports for people with intellectual disabilities benefit their inclusion in society. Although it was mentioned in the White Paper on Sport as it was produced by the European Commission (2007), which also highlighted issues pertaining to one’s access to sporting venues in the capacity of a spectator or an athlete, similar findings have been found in research conducted by Liu (2009). In particular, the researcher has argued that there is an existing inequality pertaining to the access to sports venues by people with disabilities.
Furthermore, and apart from the White Paper on Sport which addressed issues of accessibility in sports, the first international agreement that addressed the rights of people with disabilities and sport is the Convention on the Rights of Persons with Disabilities (CRPD), which is ratified by a large number of member states of the United Nations (UN, 2006). Thus, the United Nations has acknowledged that sport possesses unique traits that can support the process of community development, which is also supported by the findings by Milner & Kelly (2009) that politicians and intellectuals have talked at length about inclusion in the context of different spheres of existence, such as community at large.
Regarding the topics covered by Article 30 of the Convention on the Rights of Persons with Disabilities (UN, 2006), all the members that have signed the convention "...recognize the right of persons with disabilities to take part on an equal basis with others in cultural life," which is defined as participation in recreation as discussed by Gray, Zimmerman, & Rimmer (2012), leisure (Singleton & Darcy 2013), the arts, and sport (Thomas & Smith 2008). The CPWD is based on conceptualizations of disability based on social models that are now utilized in more than 160 countries.
Additionally, the CRPD contains the vision of social inclusion for people with disabilities in multiple articles, including articles 9 and 30, which is also included in many Governments’ policy documents. As discussed by Emerson et al. (2008), the difficulty lies in translating the vision of social inclusion to actual policies and services that will cater to people with intellectual disabilities, who remain among those who are most excluded in numerous societies across the globe. It is also crucial to recognize that, according to CRPD, disability is a constantly changing concept that results from the interaction between people who have long-term disabilities and environmental obstacles that hinder individuals from engaging in society on an equal basis and in full capacity.
In research conducted by Menear (2007), despite the increasing evidence that supports the participation in recreation programs offered in communities for people with mental disabilities, these individuals continue to struggle in adopting a healthy lifestyle because they lack the motivation to exercise. Most of this evidence, which has only recently begun to be synthesized, argues that there are many different community recreational activities that foster physical activity, social interaction, and creative pursuits and which may enhance physical health and lessen the symptoms of mental illness as found in many studies by Penedo and Dahn (2005), Sylvia et al. (2013) and Conn (2010a, 2010b). Other benefits of the participation of people with intellectual disabilities in sports activities include gains in physical wellbeing and physical fitness, osteogenesis, improved cardiovascular and respiratory performance, and better control of weight management. Furthermore, in studies by Ogg-Groenendaal et. al (2014), Mastebroek et al. (2014) and McGarty et al. (2018) it has been found that participation in these activities also produces gains in self-worth, self-efficacy, and positive self-perception which all contribute to improved psychological well-being due to social inclusion and improved levels of independence.
Further to the above, studies conducted by McDevitt et al. (2006), Street et al. (2007), and Sylvia et al. (2013) have concentrated on identifying the psychological and physical health advantages of engaging in organized physical recreation and have produced similar findings. Physical activity has therefore been associated with a variety of benefits, such as enhanced cardiovascular health, higher energy, a stronger feeling of community and belonging, and a decrease in the signs and symptoms of mental illness. As it has been found in Bonsaksen & Lerdal (2012), programs that aim at improving the physical well-being of people with mental disabilities are very important given that they frequently experience sedentary life choices, and as such are at risk to become overweight and at higher risk in suffering from chronic conditions like hypertension, diabetes, and cardiovascular disease.
Furthermore, it has been argued by Cooper et al. (2015) and Emerson et al. (2016) that people with intellectual disabilities will encounter worse health outcomes in comparison to people with no intellectual disabilities. In particular, in research done by Matson & Matson (2015) and Kinnear et al. (2018), people with intellectual disabilities have higher chances of experiencing visual impairment which may restrict or prevent to some extent, their physical activity. Similarly, in research done by Segal et al. (2016), it was argued that due to high levels of inactivity in combination with weight increase as an adverse effect of psychoactive drugs, these individuals with intellectual impairments are more prone than the overall population to be overweight or obese.
Additionally, individuals with intellectual disabilities in comparison to the general population are prone to endure persistent loneliness, mental illness, and social isolation as was found by Schützwohl et al. (2016) and Wilson et al. (2017). In addition, and according to research conducted by Buxbaum et al. (2016), individuals with intellectual disabilities are more likely to be diagnosed with disorders across the spectrum of autism in addition to displaying increased risky behavior, such as aggressive or self-destructive behavior toward others or others, or socially striking behavior that distresses, harms, or disadvantages the individual or others.
Collectively, these co-morbidities and many disorders will significantly change how people with intellectual disabilities engage in leisure activities, how they feel after engaging in them, and how researchers interpret that expression of well-being. In research supported by Scarpa (2011), it has been found that those with disabilities who participate in sports express feelings of accomplishment, improved self-concept and self-esteem, improved social competencies, and increased freedom and mobility. While these advantages apply to both those with disabilities and those without them, it is believed that the advantages for those with disabilities are more important given the lack of inclusion in activities that take place in community settings and in particular, in such settings with limited resources (Dudfield & Kaye, 2013).
More research is required to show how sport for development may advance their rights and encourage their involvement in communities and development initiatives (Brittain & Wolff, 2015; United Nations, 2006; Sanders, 2015) and all international development initiatives must allow for the inclusion and access of people with disabilities, according to Article 32 of CRPD. Furthermore, according to Article 30, states members must adopt appropriate steps to encourage and promote the involvement, to the maximum extent practicable, of individuals with disabilities in mainstream athletic activities at all levels. Similarly, the CRPD compels state members to aim in making sport and recreation facilities accessible to people with disabilities in their capacity as spectators and active participants. This mandates that special needs kids get the "fullest possible inclusion" in physical education in schools and have equal access to "play, relaxation, leisure, and athletic activities."
Implications
It becomes obvious that sports provide a unique platform for overcoming language, cultural, and social obstacles, making them a great choice for inclusion and adaptation methods. Furthermore, sport allows for the promotion of the inclusion and overall well-being of people with disabilities due to its popularity and the positive effects it has on physical, social, and economic development. Therefore, a revised sports agenda that shifts from emphasizing individual deficiencies to comprehending the sophistication of sports techniques using a social model approach to disability has been proposed as a way to foster more inclusive practices and resist historical pressures (Misener & Darcy, 2014), in addition to significantly reducing their loneliness (Stancliffe et al. 2014; Wilson et al. 2015).
Living a more physically active lifestyle has positive effects on one's quality of life, lifelong competencies, and community involvement. Therefore, continued physical activity has been found to contribute to cognitive enhancement while also promoting people's mental wellbeing. One potential external motivator in this demographic has been social support; nevertheless, complete acceptance of people with intellectual disabilities is not fully accomplished as it is found in a study by Siperstein et al. (2009). For the above reason, sport intervention programs (SIPs) aiming at obtaining positive effects for atypical populations, such as those with intellectual disabilities through adapted physical activity have been championed in a number of studies (Kahn, 2002; Bailey, 2005; Allender, Cowburn, G & Foster, 2005; Murphy & Carbone, 2008; Bodde & Seo, 2009; Heath et al., 2013; Dairo et al., 2016). It can be argued that these programs are a subtype of adapted physical activities as these concentrate on a variety of sports activities, including swimming, martial arts, cycling, dance, and promote skills requiring strength, agility, and balance. These are increasingly employed in conjunction with standard physiotherapy techniques or medicinal therapies in individuals with intellectual disabilities (Simplican et al., 2015; Rafferty et al., 2016; Tercedor et al., 2017) and different types of these are determined by the peculiarities of a particular impairment. Water sports, for instance, are regarded as a suitable form of exercise for kids with autism spectrum disorders (D'isanto & Di Tore, 2016; Spieth et al., 2016; Raudenbush, 2018), while the most popular sport intervention programs for people with Down syndrome include activities that promote movement, strength and agility, and balance training (Funk, 2017). In general, sport is a platform that naturally promotes social interactions and complex behaviors while also acting as an appropriate framework for cooperative behavior (Verschuren, 2007; Humphrey et al., 2013).
Furthermore, it is imperative though to understand the distinction between physical from adaptive physical activity. Thus, the former is based on the development of fundamental motor abilities and is described as any bodily movement produced by skeletal muscles that need energy expenditure which may range from leisure activities that involve walking, catching, running, or throwing as it has been found in studies by Andriolo et al. (2011) and Chow et al. (2016). In line with the European Association for Research into Adapted Physical Activity, adapted physical activity is a cross-disciplinary accumulation of research that focuses on disabilities, and exercise and participation restrictions in physical activity. Furthermore, the WHO provides recommendations for moderate-intensity exercises for people without disabilities, however, their recommendations do not meet the ones for people with disabilities (Grondhuis & Aman, 2014).
A significant difference has been shown between Special Olympics programs and non-competitive sport programs, with the exception of well-known instances of physical activities that individuals with disabilities engage in (like those in the Special Olympics). To improve daily fitness levels and encourage persons with intellectual disabilities to exercise regularly at home and in school settings, intervention actions, and educational methods must be created and put into practice (Bota et al., 2011). It is also important to note that Special Olympics have created the Unified Sport program, which is a powerful tool for fostering social inclusion (McConkey et al. 2013) and which includes people with and without disabilities training and competing as groups.
Another policy area that member states of United Nations need to consider is to concentrate on settling and integrating foreigners. The capacity of a newcomer to connect with others on a sports team and develop friends can be significantly impacted by sport activities. These relationships can improve their sense of community attachment and aid immigrants in putting down roots there. Settlement organizations sometimes aren't aware of how sport and physical activity partnerships and programs might aid in integrating immigrants into their new communities. In the same notion, member states should consider offering after-school sports programs in high-need areas, in communities that accommodate a large number of immigrants, foreigners, children or people at risk. Such policies will assist marginalized populations in our cities and towns by promoting social inclusion for people living in underserved neighborhoods. They are all without a doubt important approaches for removing the institutional, psychological, and environmental barriers to inclusion that impact people with disabilities. Examples of institutional obstacles include inadequate legislation, regulations, procedures, or initiatives that are prejudicial against people with disabilities, such as restrictions on employment and social support (Chabot, 2013; Kiuppis, 2018; United Nations, 2019).
1. Manual Introduction
This manual will serve as support material for youth organizations and operators whose work is targeted at youngsters with mental disabilities. Developed training activities has adjusted as local workshops in each partner countries and implemented. In terms of supporting materials, consortium produced local workshops and all local workshops are implemented at local level. Local workshops implementations was done as following:
1) Educational workshops of ETS with young persons with intellectual disabilities
2) Meetings with local stakeholders to present the Training Format
3) Educational workshops to train operators of local NGOs and Sport associations
4) Meetings with local stakeholders to present WAYWARD and the local work phase
5) Educational workshops of ETS with young persons with intellectual disabilities
6) Educational workshops of ETS with young persons with intellectual disabilities
During the implementation phase both direct & indirect target groups were involved in order to gain knowledge & competences through ETS methodology. ETS, Education Through Sport , combining in a positive synergy the inclusive potential of ETS and Sport provides grassroots organizations with a powerful tool to enhance young disabled people’s motivation to participate in society, at the same time countering phenomena of social stigma through positive awareness and providing young people facing mental disability with the transversal backpack of skills for successful integration in all spheres of education, society and, prospectively, labour market.
The practice of physical activity and sports provides multiple benefits for the physical and mental health, it also helps to build healthy lifestyles, contributing to the quality of life and reducing the risks to health.
Local workshops promote the social inclusion of young people with intellectual disabilities in the short and long term, taking advantage of the educational and social integration potential inherent in sports. The local workshops produced in this context appeal to the target group and the workshops implemented thanks to this focus are in line with the European Disability Strategy.
The need for cooperation in the European and international framework on the problem of disability is supported by visible statistical facts. Differences of local workshops were observed among the Consortium and it was concluded that it could be applied in other partner countries.
2. The Project
“Working to Approach Youth Workers as Agents of a Response to Disability” (WAYWARD) is a Capacity Building Youth project involving 7 partner organizations from Greece, Ireland, Italy, Bulgaria, Philippines, Vietnam and Mexico with the overarching am of empowering personal development, overcoming of stereotypes and social inclusion of young people (age 18-25) with mental disability in partner countries through the empowerment of youth workers and NGOs in terms of understanding and methodological toolset based on the ETS (Education Through Sport) methodology.
The World Bank quantifies in a total one billion (15% of the World’s population) the individuals with some form of disability in the World. As a phenomenon, highlights the World Bank, disability is prevalent in developing countries and is generally accompanied by adverse socioeconomic outcomes as lower rates of education, poorer health outcomes, lower levels of employment and higher poverty rates.
As underscored by the World Report on Disability (WHO, 2011), mental health conditions are particularly stigmatized, with several aspect of commonality in this stigma existing across different geographical settings. Negative attitudes and behaviors, continues the Report, have an adverse effect on children and adults with disabilities, leading to negative consequences as low self-esteem and reduced participation.
The EHSIS Eurostat survey (2012) reports that of the 70 million disabled young people aged over 15 years old in Europe (17,6% of the total population), 25,6% reported a disability relating to education and training, 38,6% to employment and 60% to leisure activities.
The WHO (2013) notes that children with disabilities are less likely to attend school, thereby experiencing limited opportunities for human capital formation and facing reduced employment opportunities and decreased productivity in adulthood.
As displayed by the Eurobarometer (2014), disability or illness is one of the main reasons for not participating in Sport among the general population.
At the same time, as illustrated by academic research, participation in Sport is positively linked with a set of positive outcomes (see Weiss, J., Diamond, T., Demark, J., &Lovald, B., 2003).
Project objectives /is supportive of the identified priorities as follows:
a) Identifying the existing barriers of mentally disabled youngsters in partner countries for what concerns integration in Sport, education and society as well as comparing the latter with the existing targeted offer of ETS.
b) Producing a Training Format based on ETS allowing youth workers to fill the gap between existing needs and extant offer through delivering ETS programme targeted at an audience of mentally disabled young people.
c) Testing the educational outcomes achieved on operators in the context of a coordinated phase of local activities where youth workers will pursue direct educational impact on local youngsters with mental disability, while at the same time carrying out awareness-raising and knowledge-transfer activities with stakeholders, thereby furthering diffusion and replication of knowledge.
d) Comparing and integrating the input of local activities in all partner countries for the purposes of developing materials of methodological guidance (Manual) and online education (Web Platform) for external operators, applicable across geographical barriers and based on locally achieved experience.
e) Laying the grounds for an extension of the cooperation through preparing further projects exploring the connection between ETS, personal development and social inclusion of mentally disabled youngsters
WAYWARD results:
1) Training Format enabling operators active in the field of youth to foster motivation, skills and social inclusion potential at the level of mentally disabled young people through ETS.
2) Manual, which will serve as a supporting material for youth organizations and operators in their work with the niche target of mentally disabled youngsters.
3) Multilingual Web Platform whereby to provide visibility to project activities/materials, opportunities of e-learning to external operators by means of online educational modules as well as disclose future activities to be implemented by project partners at the international and local events.

• Direct Target group: 18-25 years old persons with mental disability; youth workers of NGOs interested in the ETS methodology;
•Indirect target group: general public of youth and youth workers, youngsters with mental disability not involved in the activity, NGOs and stakeholders.

MVNGO has 4 offices in Sassari, Uri, Olbia and Tempio Pausania covering all the North of Sardinia with other branches in the rest of Italy. Mission: MVNGO promotes intercultural dialogue, social inclusion through Sport and environmental protection using Non-Formal Education. MVNGO is part of 3 international networks such as YEE, ISCA and MV International. Services: MVNGO is an educational training provider at local and European level and has a consultant role for public and private bodies in order to promote and develop European and trans-continental projects.
AETOI Thessalonikis – The main objectives of AETOI Thessalonikis (AETOI) is supporting people with disabilities. Our organization works directly with about 80 children and adults with disabilities, together for the common goal of social participation and inclusion. The main staff in our organization are physical trainers and we collaborate with psychologists, social workers, educators etc. Besides the managing board, a number of people are offering their voluntary work. Our goal for our staff is to learn further informal and non-formal educational techniques and to improve their techniques for promoting volunteering and supporting social inclusion
Bulgarian Sports Development Association – Bulgarian Sports Development Association was founded in 2010 and is a nonprofit public benefit organization devoted to the development of Bulgarian sport and improving sporting culture in Bulgaria! Our team is motivated, creative and full of innovative spirit that works for development of Bulgarian sport and enhance the sport culture in Bulgaria with a desire and motivation. BSDA membership is voluntary and the association involve both physical and legal persons who are willing to help sport development with time, ideas, effort or financial support. We also organize different events in the areas of: entrepreneurship, citizenship and active society. The team of the organization consists of professionals from different fields as: sport experts, media specialists, tourism and hospitality, education, marketing and others.
Love and Care for People – “LCP” is a non-profit registered charitable organisation based in Ireland. LCP is an integrated and holistic service which provides a safe and supportive environment where women and young people especially those living in hardship, socially excluded, victims of abuse and those with fewer opportunities can experience the joy, laughter and safety that should be a part of everyday life. LCP provides tools for self- sufficiency, opportunities to excel and resources to develop one’s full potential, rebuild lives, enhance economic conditions, and create one’s own future.
Center for Sustainable Development Studies – CSDS was established in 2009 as a legally registered local non-governmental, not-profit organisation. Average employment in organisation reaches 20 people. CSDS aims to promote education for sustainable development through building the capacity of people and organizations to address development challenges in Vietnam. We use education and training as the primary means of empowering individuals and organisations to pursue sustainable development. We also focus on volunteering, particularly youth volunteering, as this provides a context for learning and practice, and a resource for delivering our programs and projects .
The Mexican Association of International Volunteers A.C. was born on December 5, 2014, on the initiative of Mexican volunteers and professionals who wanted to participate in the transformation of the country through the integration of International Volunteering in projects organized in Mexico by civil associations, city councils, communities and organized groups, as well as with the sending of Mexicans to projects abroad with the idea that with this experience they can, upon returning to the country, become more actively involved in the community’s work
2.1 What is Non-Formal Education (NFE)
Non-formal Education (NFE) can be defined as the comprehensive approach of all educational practices which are not included in the formal system of education. NFE can address diverse specific target groups, from youth to elderly people, with and without disabilities, taking place in different environments and contexts.
Learning activities within a non-formal framework are created to meet young people’s needs, aspirations and interests on a voluntary basis and learner-centred. Learning methodologies used in NFE are varied and are mainly focused on establishing environments based on trust and sharing experiences.
“Non-formal education is an organised educational process which takes place alongside the mainstream systems of education and training and does not typically lead to certification. Individuals participate on a voluntary basis and as a result, the individual takes an active role in the learning process. Non-formal education gives young people the possibility to develop their values, skills and competencies others than the ones developed in the framework of formal education. Those skills (also called ‘soft skills’ ) include a wide range of competencies such as interpersonal, team, organisational and conflict management, intercultural awareness, leadership, planning, organising, co-ordination and practical problem solving skills, teamwork, self-confidence, discipline and responsibility. What is special about non-formal education is that individuals, participants are the actors actively involved in the education/learning process. The methods that are being used aim at giving young people the tools to further develop their skills and attitudes. Learning is the ongoing process, one of its crucial features is learning by doing. “Non-formal” does not imply unstructured, the process of non-formal learning is shared and designed in such a way that it creates an environment in which the learner is the architect of the skills development.” (Non Formal Education Book)
To summarise the main differences between Formal education, Informal education and Non-Formal education are:
• Formal education: the hierarchically structured, chronologically graded 'education system', from primary school to the university and including specialised programmes for academic studies, vocational and professional training.
• Informal education: the lifelong process whereby every person acquires attitudes, values, skills and knowledge from daily experience and the educative influences and resources in his or hers living environment – family, work, school, mass media etc.
• Non-Formal Education: any educational activity outside the established formal system - whether operating separately or as an important feature of some broader activity - that is intended to serve identifiable learning clienteles and learning objectives.
2.2 Education Through Sport (ETS)
ETS is a non-formal educational approach that works with sport and physical activities and which refers to the development of key competences of individuals and groups in order to contribute to personal development and sustainable social transformation (Andonova, Acs, & Holmes, 2013). ETS, combining in a positive synergy the inclusive potential of ETS and Sport provides grassroots organizations with a powerful tool to enhance young disabled people’s motivation to participate in society, at the same time countering phenomena of social stigma through positive awareness and providing young people facing mental disability with the transversal backpack of skills for successful integration in all spheres of education, society and, prospectively, labour market.

Throughout the implementation of the action, all inclusion and training through sport techniques are taken into account.

The activity begins with stretching exercises for the arms and legs. Then, the trainer explains the basic rules of the game of table tennis and evaluates the abilities of each participant in this sport. Then, depending on the level of each participant, the coach adjusts the rules of the game to make the activity more competitive.

Step-by-step description: Start the session with an energizer to warm up the muscles and body and get ready for the upcoming activities.
Step 1: The trainer/facilitator creates a circle with the participants and gives instructions. Start with the right hand by shaking and moving in all directions while counting to 10, then continue with the left hand, doing the same action up to 10, with the right foot, and then with the left, and finally with the whole body.
Step 2: Repeat step 1 but now faster and count to 9, then to 8, and so on until you reach0 number 1.
Activity
Step 1: Separate the participants into two groups and arrange them in a row in front of each other.
Step 2: Both groups have two fabrics in different colors for each team, and each participant must possess one.
Both teams are positioned in front of each other, leaving about 2 meters between them, and after the trainer's signal, two of the members who are in line in their teams should throw the fabric in the air as high as possible over their heads and run to catch the fabric of the opposing team without letting it fall to the ground.
Repeat this process with all team members.
Step 3: The team that has caught the most fabrics without letting them fall to the ground is declared the winning team.

Step-by-step description: As start participant will do some warm up activities ( 10 min running etc.)
In the session trainer will divide participants into two groups. Each group will have the same colour of ball. ( ie. Team 1: Yellow Team 2: Green).
Participants divided into two groups will be asked to line up. The aim of each team will be to deliver the balls to the other side in the fastest and cooperative way. When one participant reaches the opposite side, the other participant will bring the ball from the opposite side. Thus, each team will carry the balls to the opposite side. After all the balls have been moved, the balls will be exchanged with the opposing team and the balls will be returned to the point where they started in the same way. The first team to return the balls will be the winner of the game.

Step-by-step description: In this session, where sports are used as an educational tool, the participants will be asked to fulfil some tasks through football.
As start participant will do some warm up activities ( 10 min running etc.)
Step 1. The trainer will assign a role to each participant and write it on the card. These roles will show how the participant will behave in the football match or what rights he will do.
Step 2. The trainer will first divide the group into two and the game will begin with the whistle blowing.
Step 3. When the participants start playing, the trainer will say a role and the participant will act according to the necessity of the role. Meanwhile, other participants will try to guess the role.
Rules: Each participant will touch the ball once and there will be some cones during the match. And participants will be prohibited from touching these cones.

Step 1- Warm-up
Step 2- Participants will be divided into 2 groups. The groups will form a mixed circle. Each participant will be asked to keep in mind the participant who is on their team.
Step 3- At least 5 words will be assigned to each group by the trainer. Participants will be asked to explain these words with gestures without speaking. And they will be asked to know these words from their team members. The participant who knows the word will take a ball in the middle of the circle and leave an area reserved for his group outside the circle. In this way, each team will continue to explain until the words given are finished. In the end, the team that collects the most balls in its corner will win.

Step 1- The trainer will give theoretical information to the participants about the benefits of sports and physical activities.
Step 2- Colored cards will be pasted on certain parts of the activity area. Participants will be given a ball, and a lishi will hold the ball and say a color. (Trainer will constantly change the location of the colors.) Other participants will run in the activity area to find this color and they will find that color. Meanwhile, the participant holding the ball will run to the participant trying to find the color with the ball and touch the ball to him. Step-by-step description: It's an adapted baseball game. Disabled children can even play in a wheelchair. Those who can stand kick the ball, those in wheelchairs throw it with their hands. Young people without disabilities also participate to help with the rules and wheelchairs. While one team throws/kicks the ball the other covers the three bases, if the ball reaches the base first than the pitcher/kicker, he/she is out. Whoever reaches home the most times wins.
Materials: Stand for hydration and collation. First aid kit. A balloon with a bell inside, not very inflated. Pads for the bases.
Duration: Duration 1 hour and 30 minutes. 15 minute welcome, introduction to the activity and explanation of the game. 1 hour of play. 15 minutes of hydration and collation.

Category of the activity Educational workshops of ETS with mentally disabled young people.
Step-by-step description: The call is for inclusion, so any young person with or without disabilities should be invited to participate in a ride on wheels, it can be a bicycle, tricycle or wheelchair. A certified mountain biking guide is needed to give all the safety instructions to the participants. Also a physical therapist who works with people with disabilities for support.
Materials: A stand, roof and table with water and fruit are required for the participants. A first aid kit. Necessary equipment to repair tires, air pump, patches, etc. A support vehicle to pick up those who cannot continue cycling.
Duration: The time for the activity will be 1 hour and 30 minutes. 15 minutes of explanation of the ride, 1 hour of riding and 15 minutes of hydration and snack.
Preparation: Activity guide sheet with the roles of support volunteers, contacts of local government road personnel for support on the streets. Request a paramedic. A person with at least experience in working with people with disabilities in the area of sports or physiotherapy.
Learning Outcomes: The young participants discover that the coexistence of inclusion in a sports activity is possible and fun. They will learn to break down the barriers of communication and prejudice between young people with and without disabilities.

Въведение
Правото на физическо и психическо здраве е тясно свързано с осъществяването на други права на човека. Например всеки трябва да има право на достъп до широк набор от ресурси и услуги, за да постигне оптимално здраве. За съжаление, когато хората нямат достъп до гореспоменатите възможности поради стигма или дискриминация, това се отразява на тяхното физическо и психическо здраве. Освен това хората с увреждания често се сблъскват с пречки от страна на обществото, тъй като в много страни уврежданията се свързват с предразсъдъци и дискриминация и поради това те се сблъскват с пречки във всички аспекти на живота си. Освен външните и физически затруднения, хората с увреждания се сблъскват и с вътрешни пречки. Тези бариери включват мисли, настроения и възприятия, които могат да попречат на участието в социални дейности, както твърдят Carter-Morris и Faulkner (2003). Например хората с психични разстройства често изпитват изтощение, депресия или тревожност, предизвикани от тълпата, което прави предизвикателство за тях да участват в дейности заедно с други хора (Craik & Pieris, 2006; Roberts & Bailey, 2011). По-специално, установено е, че тези личности се занимават много по-малко със спорт в сравнение с други хора (Jong, Vanreusel, & Driel, 2011). По подобен начин гореспоменатите констатации се подкрепят от изследователи в Гърция, които твърдят, че поради факта, че социалното изключване е неразривно свързано с бедността и безработицата, ограничените възможности за достъп до здравеопазване, образование или професионално обучение, достъпен транспорт и помощни технологии, хората с увреждания са сред най-застрашените от затлъстяване и хронични и други заболявания групи (Asonitou, Koutsouki & Charitou, 2010; Kalyvas, Koutsouki, Skordilis, 2011; Magoulios & Trichopoulou, 2012). (2010). Освен това в изследванията, проведени от Verdonschot и др. (2009 г.), е установено, че хората с интелектуални затруднения, дори и в по-богатите страни с техните социални помощи и системи за подкрепа, имат ниско ниво на социална ангажираност и липса на приятели.
Други изследвания на спорта и уврежданията се концентрират върху аспекти като човешките постижения и уврежданията (Burkett, 2010), технология на тялото и уврежданията (Lutgendorf, Mason, van der Woude, & Goosey-Tolfrey, 2009), психологическата мотивация и уврежданията (Lundberg, Groff, & Zabriskie, 2010), рехабилитацията (van Langeveld и др., 2011), докато Vanner и др. (2008) се фокусират върху качеството на живот по отношение на участието на хората в спорта. Изключително важно е да се подчертае, че спортът променя хората с увреждания по също толкова важен начин, тъй като им дава възможност да реализират пълния си потенциал и да се борят за обществена промяна. Освен това е установено, че тези, които често участват в спортни занимания, могат да развият положителни житейски умения, самостоятелност и способност да въздействат върху промяната. Спортът учи хората на значението на сътрудничеството, работата в екип и уважението към другите, както и на това как да говорят логично. Укрепването на физиката и психиката чрез спорт може да помогне на хората с увреждания да станат по-независими. За съжаление, жените с увреждания е най-вероятно да се сблъскат с двойни предразсъдъци, основани както на пола, така и на увреждането им, което прави трансформиращия ефект на спорта особено важен за тях. При това положение участието в спортни занимания може да спомогне за промяна на стереотипите, свързани с пола, и да намали негативното възприемане на жените с увреждания, като им позволи да участват и да покажат своите спортни умения.
По подобен начин, както показва изследването на Coalter (2010) относно основните спортни изследвания за групи в неравностойно положение, като тийнейджъри и имигранти, участието в спортни занимания за хора с интелектуални затруднения е от полза за тяхното включване в обществото. Въпреки че това е споменато в Бялата книга за спорта, тъй като тя е изготвена от Европейската комисия (2007 г.), в която също така са изтъкнати въпроси, свързани с достъпа на човека до спортни обекти в качеството му на зрител или спортист, подобни констатации са установени в изследването, проведено от Liu (2009 г.). По-конкретно изследователят твърди, че съществува неравнопоставеност по отношение на достъпа на хора с увреждания до спортни обекти.
Освен Бялата Kнига за Спорта, в която се разглеждат въпросите за достъпността на спорта, първото международно споразумение, в което се разглеждат правата на хората с увреждания и спорта, е Конвенцията за правата на хората с увреждания (КПХУ), която е ратифицирана от голям брой държави - членки на ООН (ООН, 2006 г.). По този начин ООН признава, че спортът притежава уникални характеристики, които могат да подпомогнат процеса на развитие на общността, което се потвърждава и от констатациите на Milner & Kelly (2009), че политиците и интелектуалците са говорили дълго за приобщаването в контекста на различни сфери на съществуване, като например общността като цяло.
Що се отнася до темите, обхванати от член 30 от Конвенцията за правата на хората с увреждания (ООН, 2006 г.), всички страни членки, които са подписали конвенцията, "...признават правото на хората с увреждания да участват наравно с другите в културния живот", което се определя като участие в развлекателни дейности, както е разгледано от Gray, Zimmerman и Rimmer (2012 г.), свободното време (Singleton и Darcy 2013 г.), изкуствата и спорта (Thomas и Smith 2008 г.). КПХУ се основава на концептуализации на уврежданията, основани на социални модели, които понастоящем се използват в повече от 160 държави.

В изследването на Menear (2007 г.) се посочва, че въпреки нарастващия брой доказателства, които подкрепят участието в програми за отдих, предлагани в общностите за хора с умствени увреждания, тези хора продължават да се борят с въвеждането на здравословен начин на живот, тъй като им липсва мотивация да спортуват. Освен това в проучвания на Ogg-Groenendaal et. al (2014), Mastebroek и др. (2014) и McGarty и др. В допълнение към горепосоченото, проучванията, проведени от McDevitt и др. (2006), Street и др. (2007) и Sylvia и др. (2013), се концентрират върху идентифицирането на психологическите и физическите здравни предимства на участието в организиран физически отдих и дават подобни резултати. (2016), лицата с интелектуални затруднения са по-склонни да бъдат диагностицирани с разстройства от целия спектър на аутизма в допълнение към това, че проявяват повишено рисково поведение, като агресивно или саморазрушително поведение спрямо други лица или други хора, или социално стряскащо поведение, което притеснява, вреди или поставя в неравностойно положение лицето или другите.
В своята съвкупност тези съпътстващи заболявания и много разстройства ще променят значително начина, по който хората с интелектуални затруднения се включват в дейности в свободното си време, как се чувстват след участието си в тях и как изследователите интерпретират този израз на благополучие. В изследване, подкрепено от Scarpa (2011 г.), е установено, че хората с увреждания, които участват в спортни занимания, изразяват чувство на удовлетвореност, подобрена самооценка и самочувствие, подобрени социални компетенции и по-голяма свобода и мобилност. По подобен начин КПХУ задължава държавите членки да се стремят към осигуряване на достъп до спортните съоръжения и съоръженията за отдих на хората с увреждания в качеството им на зрители и активни участници. Това задължава децата със специални нужди да получат "възможно най-пълно приобщаване" във физическото възпитание в училищата и да имат равен достъп до "игри, релаксация, отдих и спортни дейности".
Изводи
Става ясно, че спортът предоставя уникална платформа за преодоляване на езикови, културни и социални пречки, което го прави чудесен избор за методите на приобщаване и адаптация. Освен това спортът дава възможност за насърчаване на приобщаването и цялостното благополучие на хората с увреждания поради своята популярност и положителното въздействие, което оказва върху физическото, социалното и икономическото развитие. 1. Въведение в ръководството

5) Образователни семинари на ETS с младежи с интелектуални затруднения
6) Образователни семинари на ETS с младежи с интелектуални затруднения
По време на етапа на изпълнение бяха включени както преки, така и непреки целеви групи, за да придобият знания и компетенции чрез методологията на ETS. ETS (Образование чрез спорт), съчетавайки в положителна синергия приобщаващия потенциал на ETS и Спорта, предоставя на организациите на местно ниво мощен инструмент за повишаване на мотивацията на младите хора с увреждания за участие в обществения живот, като в същото време противодейства на явленията на социална стигма чрез положителна информираност и предоставя на младите хора с умствени увреждания наръчник с множество умения за успешна интеграция във всички сфери на образованието, обществото и, в перспектива, на пазара на труда.
Практикуването на физическа активност и спорт носи многобройни ползи за физическото и психическото здраве, помага за изграждането на здравословен начин на живот, допринася за качеството на живот и намалява рисковете за здравето.
Местните семинари насърчават социалното приобщаване на младите хора с интелектуални затруднения в краткосрочен и дългосрочен план, като се възползват от потенциала за образователна и социална интеграция, присъщ на спорта. Изготвените в този контекст местни семинари се харесват на целевата група и семинарите, осъществени благодарение на тази насоченост, са в съответствие с Европейската Стратегия за Хората с Увреждания.
Необходимостта от сътрудничество в европейската и международната рамка по проблема с уврежданията се потвърждава от видими статистически факти. Консорциумът наблюдава различия в местните семинари и стига до заключението, че той може да бъде приложен и в други страни партньори.
2. Проектът
"Подход за Работа с Младежите като Посредници за Преодоляване на Проблемите с Уврежданията " (WAYWARD) е проект за изграждане на младежки капацитет, в който участват 7 партньорски организации от Гърция, Ирландия, Италия, България, Филипините, Виетнам и Мексико, като основната цел е да се даде възможност за личностно развитие, преодоляване на стереотипите и социалното приобщаване на младите хора (18-25 г.) с умствени увреждания в страните партньори чрез овластяване на младежките работници и неправителствените организации по отношение на разбирането и методологическия инструментариум, основан на методологията ETS (Образование чрез спорт).
Световната банка изчислява, че хората с някаква форма на увреждане в света са общо един милиард (15% от населението на света). Тя подчертава, че като явление уврежданията са широко разпространени в развиващите се страни и обикновено са придружени от неблагоприятни социално-икономически резултати като по-ниски нива на образование, по-лоши здравни резултати, по-ниски нива на заетост и по-високи нива на бедност.
Както е подчертано в Световния Доклад за Уврежданията (СЗО, 2011 г.), психичните заболявания са особено стигматизирани, като в различните географски условия съществуват няколко аспекта на обща стигматизация. Негативните нагласи и поведение, продължава Докладът, имат неблагоприятно въздействие върху децата и възрастните с увреждания, което води до негативни последици като ниско самочувствие и намалено участие.
Проучването EHSIS на Евростат (2012 г.) съобщава, че от 70 милиона младежи с увреждания на възраст над 15 години в Европа (17,6 % от цялото население) 25,6 % съобщават за увреждане, свързано с образованието и обучението, 38,6 % - с трудовата заетост и 60 % - с дейностите през свободното време.
СЗО (2013 г.) отбелязва, че децата с увреждания по-рядко посещават училище, поради което имат ограничени възможности за формиране на човешки потенциал и се сблъскват с намалени възможности за заетост и по-ниска производителност в зряла възраст.
Както показва проучването на Евробарометър (2014 г.), увреждането или болестта са една от основните причини за неучастие в спортни дейности сред населението като цяло.
В същото време, както показват научните изследвания, участието в спорта е положително свързано с редица положителни резултати (вж. Weiss, J., Diamond, T., Demark, J., & Lovald, B., 2003).
Целите на проекта / са в подкрепа на определените приоритети, както следва:
a) Идентифициране на съществуващите бариери пред младежите с умствени увреждания в партньорските страни по отношение на интеграцията в спорта, образованието и обществото, както и сравняване на последните със съществуващoтo целенасоченo предложение на ETS.
b) Изготвяне на формат за обучение, базиран на ETS, който позволява на младежките работници да запълнят празнината между съществуващите нужди и съществуващото предлагане чрез предоставяне на програма ETS, насочена към аудитория от млади хора с умствени увреждания.
c) Тестване на образователните резултати, постигнати от операторите, в контекста на координирана фаза на местни дейности, при която младежките работници ще осъществяват пряко образователно въздействие върху местните младежи с умствени увреждания, като същевременно ще извършват дейности за повишаване на осведомеността и предаване на знания на заинтересованите страни, като по този начин ще насърчават разпространението и възпроизвеждането на знанията.
d) Сравняване и интегриране на резултатите от местните дейности във всички партньорски държави с цел разработване на материали за методически указания (наръчник) и онлайн обучение (уеб платформа) за външни оператори, приложими при преодоляване на географски бариери и основани на местния опит.
e) Полагане на основите за разширяване на сътрудничеството чрез изготвяне на допълнителни проекти, изследващи връзката между ETS, личностното развитие и социалното приобщаване на младежи с умствени увреждания
Резултати от WAYWARD:
1) Формат за обучение, който дава възможност на операторите, работещи в областта на младежта, да насърчават мотивацията, уменията и потенциала за социално приобщаване на ниво младежи с умствени увреждания чрез ETS.
2) Наръчник, който ще служи като помощен материал за младежки организации и оператори в работата им с целевата ниша на младежите с умствени увреждания.
3) Многоезична уеб платформа, чрез която да се осигури видимост на дейностите/материалите по проекта, възможности за електронно обучение на външни оператори чрез онлайн образователни модули, както и да се оповестят бъдещите дейности, които партньорите по проекта ще изпълняват на международни и местни събития.
Целева група на проекта:
- Пряка целева група: 18-25-годишни лица с умствени увреждания; младежки работници от НПО, които се интересуват от методологията на ETS;
-Непряка целева група: широката общественост на младежите и младежките работници, младежи с умствени увреждания, които не участват в дейността, НПО и заинтересовани страни.
Партньори по проекта
НПО Mine Vaganti - НПО Mine Vaganti е организация с нестопанска цел, създадена в Сардиния през 2009 г. MVNGO има 4 офиса в Сасари, Ури, Олбия и Темпио Паусания, които покриват цялата северна част на Сардиния, и други клонове в останалата част на Италия. MVNGO е част от 3 международни мрежи като YEE, ISCA и MV International. AETOI Thessalonikis - Основните цели на AETOI Thessalonikis (AETOI) е подпомагането на хората с увреждания. Нашата организация работи пряко с около 80 деца и възрастни с увреждания, заедно за общата цел за социално участие и включване. Основният персонал в нашата организация са треньори по физическо възпитание и си сътрудничим с психолози, социални работници, педагози и др. Освен управителния съвет, редица хора предлагат своя доброволен труд. Целта на нашите служители е да усвоят допълнително техники за неформално и самостоятелно обучение и да подобрят техниките си за насърчаване на доброволчеството и подкрепа на социалното приобщаване
Българска Асоциация за Развитие на Спорта - Българската асоциация за развитие на спорта е създадена през 2010 г. и е организация с нестопанска цел в обществена полза, посветена на развитието на българския спорт и подобряването на спортната култура в България! Нашият екип е мотивиран, креативен и изпълнен с новаторски дух, който работи за развитието на българския спорт и повишаване на спортната култура в България с желание и мотивация. Членството в БАРС е доброволно и в сдружението участват както физически, така и юридически лица, които са готови да подпомогнат развитието на спорта с време, идеи, усилия или финансова подкрепа. Ние също така организираме различни събития в областите: предприемачество, гражданство и активно общество. Центърът за Изследване на Устойчивото Развитие - CSDS е създаден през 2009 г. като законно регистрирана местна неправителствена организация с нестопанска цел. Средната заетост в организацията достига 20 души. CSDS има за цел да насърчава образованието за устойчиво развитие чрез изграждане на капацитет на хора и организации за справяне с предизвикателствата на развитието във Виетнам. What information does the organisation collect?
The organisation collects and processes a range of information about you. This includes:
• your name, addresses and contact details, including email address and telephone number, date of birth and gender;
• the terms and conditions of your employment;
• details of your qualifications, skills, experience and employment history, including start and end dates, with previous employers and with the organisation;
• information about your remuneration, including entitlement to benefits such as pensions or insurance cover;
• details of your bank account and national insurance number;
• information about your marital status, next of kin, dependants and emergency contacts;
• information about your nationality and entitlement to work in the UK, including passport, ID and VISA details;
• information about your criminal record;
• details of your schedule (days of work and working hours) and attendance at work;
• details of periods of leave taken by you, including holiday, sickness absence, family leave and sabbaticals, and the reasons for the leave;
• details of any disciplinary or grievance procedures in which you have been involved, including any warnings issued to you and related correspondence;
• assessments of your performance, including appraisals, performance reviews and ratings, training you have participated in, performance improvement plans and related correspondence;
• information about medical or health conditions, including whether you have a disability for which the organisation needs to make reasonable adjustments or allergy information;

The organisation collects this information in a variety of ways. For example, data is collected through application forms, CVs or resumes; obtained from your passport or other identity documents such as your driving licence; from forms completed by you at the start of or during employment; from correspondence with you; or through interviews, meetings or other assessments and through the completion of items on the Just Good Work app.
In some cases, the organisation collects personal data about you from third parties, such as references supplied by former employers, information from employment background check providers, information from credit reference agencies, information obtained from social media monitoring and information from criminal records checks or right to work checks permitted by law.
Data is stored in a range of different places, including in your personnel file, in the organisation's HR management systems and in other IT systems (including the organisation's email system).
Why does the organisation process personal data?
The organisation needs to process data to enter into an employment contract with you and to meet its obligations under your employment contract. For example, it needs to process your data to provide you with an employment contract, to pay you in accordance with your employment contract and to administer any entitlements that may be offered to you.
In some cases, the organisation needs to process data to ensure that it is complying with its legal obligations. For example, it is required to check an employee's entitlement to work in the UK, to deduct tax, to comply with health and safety laws, to enable employees to take periods of leave to which they are entitled, and to consult with employee representatives if redundancies are proposed or a business transfer is to take place. • conduct employee engagement surveys;

Some special categories of personal data, such as information about health or medical conditions, or racial or ethnic origin, is processed to carry out employment law obligations (such as those in relation to employees with disabilities, for health and safety purposes and to ensure that employees have the right to work in the UK).
Where the organisation processes other special categories of personal data, such as information about ethnic origin, sexual orientation, health or religion or belief, this is done for the purposes of equal opportunities monitoring as permitted by the Data Protection Act 2018/reasons of substantial public interest. You can ask us to stop processing this data at any time.
As noted above, the organisation may process criminal records data to assess your suitability for employment both when you are recruited (through appropriate criminal records checks) and in the course of your employment.
Who has access to data?
Your information will be shared internally, including with members of the People & Culture team and payroll, your line manager, managers in the business area in which you work and IT staff if access to the data is necessary for performance of their roles.
Your data may also be shared with employee representatives in the context of collective consultation on a redundancy or business sale.
The organisation shares your data with third parties to obtain pre-employment references from other employers, obtain employment background checks from third-party providers, obtain necessary criminal records checks from the Disclosure and Barring Service, or report suspected offences to the appropriate authorities. What if you do not provide personal data?
You have some obligations under your employment contract to provide the organisation with data. Failing to provide the data may mean that you are unable to exercise your statutory rights.
