English term

order for provision

English to French Law/Patents Law (general) Will
The Court is satisfied that it is appropriate to make the order for provision for the Plaintiff and the order for provision for the Defendant.

La Demanderesse et la Défenderesse sont des sœurs.

Est-ce une ordonnance alimentaire ?

Merci beaucoup

Also agree Makes sense
Eliza Hall Nov 2, 2018:
Agree w Daryo That makes perfect sense and is supported by their link.
Daryo Nov 2, 2018:
it does make sense one of the sisters [La Demanderesse, left out in the will?] demanded to receive "adequate provision for proper maintenance and support" out of the estate of the deceased, possibly also claimed that the other sister shouldn't be entitled to a "order for provision" and the other sister [la Défenderesse] opposed/contested it.

The judge decided that they are both entitled to receive "maintenance" from the estate of the deceased - makes sense.

2.32 If the court determines that the deceased person had responsibility to make adequate provision for an applicant’s proper maintenance and support, and did not do so, it may then make an order for provision (or ‘maintenance order’). 54 In Victoria, the court can only make provision out of the estate of a deceased person.55

It is difficult for me to write more context (lenghty and confidential), but at any rate, I agree with what you say, I believe the Court is granting them both this "ordonnance". Thank you!
AllegroTrans Nov 2, 2018:
I see the problem! But without reading all of your text, I don't think any of us "out here" will understand why the same kind of order is being made for both plaintiff and defendant. You say they are sisters, so perhaps the court has decided that both of them have an entitlement?
Cécile Gaultier (asker) Nov 2, 2018:
Une ordonnance alimentaire OU ordonnance de versement de pension alimentaire. But what throws me off is that the order is for both. That is what I do notunderstand.
Cécile Gaultier (asker) Nov 2, 2018:
Thank you Allegro. This is a judgment order (Australia). Testamentary dispositions in respect of their mother's estate in Australia.
AllegroTrans Nov 2, 2018:
Context (essential) please We need to know 1) which country this is from 2) exactly what kind of proceedings are involved

My take
Peer comment(s):

neutral AllegroTrans : How does provision result in communication in connection with an estate? Can you back this up?

neutral Germaine : Je ne crois pas, non. Et je vous pose la même question: how can you get from one to the other? + Back-translation: "order for provision of information" - ou quelque chose du genre.
