Nici în ceea ce privește deducerea efectuată de beneficiar a impozitului achitat în amonte nu prezintă importanță aspectul dacă acesta este impozitat în funcție de plățile convenite sau în funcție de plățile încasate. Legiuitorul german nu a făcut uz de posibilitatea prevăzută la articolul 167a din Directiva TVA cu privire la condiționarea deducerii impozitului achitat în amonte de încasarea plății în cazul persoanelor supuse impozitării reale.
